home operated backhoe business on property zoned G-C
(Community Commercial) located at the end of Vine Road,
approximately 630 feet south of its intersection with Holly
Road, identified as AP 65-46-40, Magalia
The Commission waived the reading of`the Staff Findings.
Staff was asked why Condition 3 only listed motor oil as a waste
product. Staff said the only hazardous waste material that came
to his mind was motor oil in connection with',a backhoe business:.
Commissioner Matson did not understand the need for an easement
over Lot 42 when the parcel shows an access onto the cul--de--sac:.
Staff sa3,,d when the subdivision was, approved for the commercial
development it was restricted to access off the frontage road
across Lot 42. He said there were certain access points to
eliminate a lot of curb cuts and separate driveways. He said the
applicant does not have legal access onto Vine.
Commissioner Lynch said theapplicant would need' to apply for a
direct access to Vine for Lot 40 with the Advisory Agency to
I mend the subdivision map.
Commissioner Matson said there is a stipulation that the
leachl.ines can not go within 20 feet of the right-of-way. He
asked if this was done for the possibility of future road
improvement? Staff said this is correct;
Commissioner Matson stated the drainage from this property will
not be intra Vj Ae Road .
The hearing was opened to the publid,
No one was present on this item.
Commissioner Matson said he would like the applicant to apply for
the amendment to the subdivision trap to the access would be
directly unto Vine. Road and not across Lot 42 with an easement.

This
NALYSTS;This is a use Permit request to allow a single family dwelling in the
C -C zone; The property is located at the end of Vine Road, in the
Paradise Pines area
The Paradise Pine's commercial park subdivision was approved in. 1970
with the intention of ;providing commercial lots to serve the Paradise
Pines cemmun.i.ty. There are 47 lots in the subdivision, thirty-nine
lots ar— currently vacant, one lot has 5 apartments on it and 6 lots
I ave commercial uses established. The planning Commission has also..
approved a Use Permit fora single family dwelling on a lot Located
at the southwest corner of Hollywood Road and Vine Road'. Approval
was made October 20, 1.988. Construction has started on this
residence.
All 'of the lots on the east side of Vine Road are 61evolope6 with
single=family residences.
The site -is -not within the adopted domestic watershed protection'
zone, however the drainage improvements for the lots shown on exhibit
IWI direct runoff into the watershed, i'yraina.ge is by paved roadside
ditch to the intersection of Vine and Holly Roads, then into pipes
easterly to Firhaven Creek, The proposed use cif the property wild
not create any more runoff than other uses allowed in the C -C zone.
This subdivision was set up with limited access to Vine Road as shown
on Exhibit "B"• The closest access for this project is on Lot 42
Vehicles will haves to leave Vine Road at this access and use the �8
ft. access easement to reach Lot 40. The development, plan does not.
reflect this requirement. There is also a 20 ft. easement for road
purpn^Qs along fhe southerly bowidary of this pantel: The
app -int's site plan shows the leachlines intruding into this
easement. The applicant must beep all structures and l.eaehfie1.ds out
of this easement.'
The applicant i.s also proposing a 30 x 35 ft. garage structure to
house a backhoe and related maintenance equipment. The applicant has
stated he will have ;no employees and the backhoe will normally be at
