STMT, FINDINGS - Apri._' 81 198,1
Division of Forestry. Applicant, will clear all
flammable Vegetation away from the proposed structure
for a dintance of 30 feet in accordance with P bl.ic
Resources Coda Section 11291,. No other fire dep r°tment
input.
ANALYSIS: This project in a request to allow a garage 6 feet
from the property line, within the required setback. i
At the time the aab ject parcel warn created the
sideyard setback required was 5 feet in an A-?
zone, The adoption, of the TM-5 Lone, applied in
197 required: a. "10 foot setback. Since t;he property
consists of 0.56 Gores, an a pro-existing non-
conforming lot, the additional setback requirement
is of concern. As the lot was originally designed
(with 5 foot setbrac)cs) thorn were 14,6$6 sq. ft
available for developmen4 under the TM-5 zone there
are 13,497 sq. ft•i available, an 8% reduction.
The non-conforMing size of the Parcel creates conditions
for granting variance. The Butte County Counsel
has addressed a similar situation on small lots in
the townsite of Dayton which were tuned A-40. A
copy of Ilia memo to the Planning Department is attached.
