NOTICE TO BUILDERS
Before your building permit can be issued, your plans must be checked for compliance with the California Building Codes. In
addition, your plans are routed to other regulatory entities including but not limited to Planning, Public Works, Environmental
Health, and the California Department of Forestry for their clearances and approvals. There are some things you can do to
expedite your permit:
0 Make sure your application is complete.
0 Be responsive to requests from County departments for any additional materials or requirements.
The Building Division places its highest priority on processing building permits as quickly as possible and each day that passes
without a complete application adds to processing time.
Every permit issued by the Building Official shall expire and become null and void if the work authorized by such permit is not
started or completed within one year from the date of issuance of such permit. A permit may be renewed (for a fee) prior to
expiration an indefinite number of times, provided construction progress has been documented by the Building Division during
each year during scheduled inspections. No changes may be made in the original plans and specifications for such work. In
order to reinstate action on a permit after expiration, the permittee shall pay a new full permit fee and additional plan checking
and documentation may be required. Upon completion of work covered by this permit, please contact this office for final
inspection. As a reminder to you, it is illegal to occupy this building or any portion of the building for which this permit is
issued without a final inspection.
EXPIRATION OF PERMIT APPLICATION AND REFUND POLICY"
Application for which a permit has not been issued will expire one year after date of application.
Refunds may only be made upon written request by the person who originally paid the fees. Refunds for permit applications
(not yet issued) must be requested within two years from the date of fee payment. Fees paid at the time of application are
for Plan Check and administration. The Plan Check portion of fees is refundable only if the permit is cancelled or withdrawn
before any plan checking is done. Building Division costs will be deducted prior to authorizing a refund and a charge of
$54.99 to process the refund application will be assessed. Refunds on permits (issued) may be requested prior to the expiration
of the permit, provided no work has been done pursuant to the permit. An Inspection may be required (and deducted from any
refund amount) to determine no work was done.

OWNER -BUILDER INFORMATION
An application for a building permit has been submitted in your name listing yourself as the builder of the property improvements specified.
For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a permit. Building permits are not required to be signed
by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from
possible liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by
law to put their license number on all permits for which they apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should be aware of the following information for your benefit and
protection:
° If you employ or otherwise engage any persons other than your immediate family, and the work (including materials and other costs) is $500 or more for the entire
project and such persons are not licensed as contractors or subcontractors, then you may be an employer.
° If you are an employer, you must register with the state and federal government as an employer and you are subject to several obligations including state and federal
° income tax withholding, federal social security taxes, workers/ compensation insurance, disability insurance costs, and unemployment compensation contributions.
There may be financial risks to you if you do not carry out these obligations, and these risks are especially serious with respect to workers' compensation insurance.
° For more specific information about your obligations under federal law, contact the Internal Revenue Service (and, if you wish, the U.S. Small business
Administration). For more specific information about your obligations under state law, contact the Department of Benefit Payments and the Division of Industrial
Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their work personally or through thier own employees,
without a license contractor or subcontractor, only under limited conditions.
A frequent practice of unlicensed persons professing to be contractor is to secure an "owner -builder" building permit, erroneously implying that the property owner is
providing his or her own labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work
personally.
Information about licensed contractors may be obtained by contacting the Contractors' State License Board's automated telephone information system at 1-800-321

enclosed PLAN REVIEW RESPONSE FORM. Your complete and clear response will expedite the re-

COMMENTS:
1. A Deed Restriction and Limited Use Facility must be recorded to limit the use of the shop and storage
area of this building. The deed restriction will state that the shop and storage area of this building
shall not be used for sleeping, living, meal preparation and eating. This deed restriction will be
prepared by Butte County and must be signed notarized and recorded by the property owners. The
submitted copy of the vesting grant deed will be used to prepare the deed restriction.
2. Submitted trusses will need to have a minimum floor live load of 40 pounds per square foot for
residential storage incorporated into the truss design.

Division IV—CONVENTIONAL LIGHT -FRAME CONSTRUCTION
SECTION 2320 — CONVENTIONAL LIGHT -FRAME
CONSTRUCTION DESIGN PROVISIONS
2320.1 General. The requirements in this section are intended
for conventional light -frame construction. Other methods may be
used provided a satisfactory design is submitted showing com-
pliance with other provisions of this code.
Only the following occupancies may be constructed in accord-
ance with this division:
1. One-, two- or three-story buildings housing Group R Occu-
pancies.
2. One-story Occupancy Category 4 buildings, as defined in
Table 16-K, when constructed on a slab -on -grade floor.
3. Group U Occupancies.
4. Top -story walls and roofs of Occupancy Category 4 build-
ings not exceeding two stories of wood framing.
5. Interior nonload-bearing partitions, ceilings and curtain
walls in all occupancies.
When total loads exceed those specified in Tables 23 -IV -J-1,
23 -IV -J-3, and 23 -IV -R-1, 23 -IV -R-2, 23 -IV -R-3, 23 -IV -R-4,
23 -IV -R-7, 23 -IV -R-8, 23 -IV -R-9, 23 -IV -R-10, 23 -IV -R-11 and
23 -IV -R-12; 23 -VII -R-1, 23 -VII -R-3, 23 -VII -R-7, 23 -VII -R-9,
23 -VIII -A, 23 -VIII -B, 23 -VIII -C, 23 -VIII -D, an engineering
design shall be provided for the gravity load system.
Other approved repetitive wood members may be used in lieu of
solid -sawn lumber in conventional construction provided these
members comply with the provisions of this code.
2320.2 Design of Portions. When a building of otherwise con-
ventional construction contains nonconventional structural ele-
ments, those elements shall be designed in accordance with
Section 1605.2.
2320.3 Additional Requirements for Conventional Construc-
tion in High -wind Areas. Appendix Chapter 23 provisions for
conventional construction in high -wind areas shall apply when
specifically adopted.
2320.4 Additional Requirements for Conventional Construc-
tion in Seismic Zones 0, 1, 2 and 3.
2320.4.1 Braced wall lines. Where the basic wind speed is not
greater than 80 miles per hour (mph) (129 km/h), buildings shall
be provided with exterior and interior braced wall lines. Spacing
shall not exceed 34 feet (10 363 mm) on center in both the longitu-
dinal and transverse directions in each story.
2320.4.2 Braced wall lines for high wind. Where the basic
wind speed exceeds 80 mph (129 km/h), buildings shall be pro-
vided with exterior and interior braced wall lines. Spacing shall
not exceed 25 feet (7620 mm) on center in both the longitudinal
and transverse directions in each story.
EXCEPTION: In one- and two-story Group R, Division 3 build-
ings, interior braced wall line spacing may be increased to not more
than 34 feet (10 363 mm) on center in order to accommodate one single
room per dwelling unit not exceeding 900 square feet (83.6 m2). The
building official may require additional walls to contain braced panels
when this exception is used.
2320.4.3 Veneer. Anchored masonry and stonewall veneer shall
not exceed 5 inches (127 mm) in thickness and shall conform to
the requirements of Chapter 14.
2320.4.4 Lateral force -resisting system. Buildings in Seismic
Zone 3 that are not provided with braced wall lines in accordance
with Section 2320.4 or that are of unusual shape as described in
Section 2320.5.4 shall have a lateral -force -resisting system de-
signed to resist the forces specified in Chapter 16.
2320.5 Additional Requirements for Conventional Construc-
tion in Seismic Zone 4.
2320.5.1 Braced wall lines. Buildings shall be provided with
exterior and interior braced wall lines. Spacing shall not exceed
25 feet (7620 mm) on center in both the longitudinal and trans-
verse directions in each story.
EXCEPTION: In one- and two-story Group R, Division 3 build-
ings, interior braced wall line spacing may be increased to not more
than 34 feet (10 363 mm)on center in order to accommodate one single

23 -IV -R-4, 23 -IV -R-7, 23 -IV -R-8, 23 -IV -R-9 and 23 -IV -R-10,
23 -VII -R-1. 23 -VII -R-3, 23 -VII -R-7, 23 -VII -R-9, 23 -VIII -A,
23 -VIII -B, 23 -VIII -C and 23 -VIII -D, an engineering design shall
be provided for the lateral -force -resisting system.
2320.5.3 Veneer. Anchored masonry and stonewall veneer shall
not exceed 5 inches (127 mm) in thickness, shall conform to the
requirements of Chapter 14 and shall not extend above the first
story.
2320.5.4 Unusually shaped buildings. When of unusual shape,
buildings of light -frame construction shall have a lateral -force -
resisting system designed to resist the forces specified in Chapter
16. Buildings shall be considered to be of unusual shape when the
building official determines that the structure has framing irregu-
larities, offsets, split levels or any configuration that creates dis-
continuities in the seismic load path and may include one or more
of the following.
2320.5.4.1 When exterior braced wall panels, as required by Sec-
tion 2320.11.3, are not in one plane vertically from the foundation
to the uppermost story in which they are required.
EXCEPTION: Floors with cantilevers or setbacks not exceeding
four times the nominal depth of the floorjoists may support braced wall
panels provided:
1. Floor joists are 2 inches by 10 inches (51 mm by 254 mm) or
larger and spaced at not more than 16 inches (406 mm) on cen-
ter.
2. The ratio of the back span to the cantilever is at least 2 to 1.
3. Floor joists at ends of braced wall panels are doubled.
4. A continuous rim joist is connected to ends of all cantilevered
joists. The rim joist may be spliced using a metal tie not less
than 0.058 inch (1.47 mm) (16 galvanized gage) and 11/2inches
(38 mm) wide fastened with six Ad nails.
5. Gravity loads carried at the end of cantilevered joists are lim-
ited to uniform wall and roof load and the reactions from head-
ers having a span of 8 feet (2438 mm) or less.
2320.5.4.2 When a section of floor or roof is not laterally sup-
ported by braced wall lines on all edges.
EXCEPTION: Portions of roofs or floors which do not support
braced wall panels above may extend up to 6 feet (1829 mm) beyond
a braced wall line.
2320.5.4.3 When the end of a required braced wall panel extends
more than 1 foot (305 mm) over an opening in the wall below. This
provision is applicable to braced wall panels offset in plane and to
braced wall panels offset out of plane as permitted by Section
2320.5.4.1, exception.

I. WHEREAS, on this 14th day of May,. 2008, GARY & TRACEY
MCELROY, hereinafter referred to as owner(s), is the record owner of the following real
property:

in Exhibit "A" attached hereto and hereby incorporated by reference, hereinafter
referred to as "the subject property"; and
II. WHEREAS, the Building Division of the Butte County Department of .
Development Services is acting on behalf of the People of Butte County; and
III. WHEREAS, the owner applied to the Building Division for a building
permit in order to develop the subject property described above; and
IV. WHEREAS, Building Permit No. B07-2647 was applied for on 12/26/2007
by the owner in accordance with the provisions of the Butte County Code and the
California Building Code; and
V. WHEREAS, the use allowed by Building Permit No. B07-2647 has been
reviewed and approved for only the limited purposes set forth below; and
VI. WHEREAS, it is intended that this Deed Restriction and Notice of Limited
Use Facility shall constitute an enforceable restriction and remain in effect until a
change in use or character of use has been approved by the Butte County Building
Official or a change in law has occurred, either of which change allows the uses
otherwise restricted herein to be conducted on the real property described herein.

Under either circumstance allowing such change in use, Owner shall be entitled to have
this Deed Restriction and Notice of Limited Use Facility rescinded by the execution of a
subsequent document entitled Rescission of Deed Restriction and Notice of Limited
Use Facility by the Director of Development Services; and
VII. WHEREAS, Owner acknowledges that Owner will comply with the limited
use restrictions that were incorporated in reviewing and approving Building Permit No.
B07-2647which enabled Owner to undertake the limited use authorized by this permit.
NOW, THEREFORE, with the issuance of Building Permit No. B07-2647 to
Owner by Butte County, Owner hereby affirms Owner's desire to develop a limited use
facility, as set forth below, which establishes restrictions on the use and enjoyment of
this limited use facility. The undersigned Owner, for himself/herself and for his/her
heirs, assigns, and successors in interest, acknowledges and agrees to those
restrictions.
This limited use facility shall be utilized in compliance with those limitations
prescribed by the California Building Code occupancy classification assigned by the
building official, except the following uses are not allowed: the _gara_ge/shop is not to
be used for living or sleeping. Additionally, the space will not be heated.
If any provision of these restrictions is held to be invalid or for any reason
becomes unenforceable, no other provision shall be thereby affected or impaired.
This deed restriction and notice of limited use facility shall remain in full force
and effect during the period that this permit, or any modification or amendment thereof,
remains effective, and during the period that the development authorized by this permit,
or any modification of this development, remains in existence in or upon any part of,
and thereby confers benefit upon, the subject property described herein, and to that
extent, this deed restriction and notice of limited use facility is hereby acknowledged
and agreed to by Owner to restrict the use and enjoyment of this limited use facility and
shall be binding on Owner and all his/her assigns or successors in interest.
Owner agrees to record this Deed Restriction and Notice of Limited Use Facility
in the Recorder's Office for the County of Butte as soon as possible after the date of

This department received a complaint alleging health or safety hazards in
the above mentioned rental dwelling. The Butte County Assessor's records
indicate you are the owner of the property.
On April•4, 1987, I visited the property and made an inspection. The fol-
lowing conditions were observed which are in violation of the Health and
Safety Code of California Section 17920.3 B -1,6,7,9,10,11,13,15;-E; F; H;
J; K; L; 0,
1) There is no approved source of water.
2) There is no weather protection jj?�me and windows are missing.
3) There is hazardous wiring.around the building and meter.
4) There is trash and debri through out the lot.
5) There is no approved source of heat.
6) Plumbing is not all connected or vented.
7). The out buildings are deteriorated.
These conditions shall be corrected as follows and within THIRTY (30) DAYS
from receipt of this notice. Obtain all required permits from the Butte
County Building Department, 747 Elliott, Paradise, prior to making repairs.

3) Has sufficient fall, and 4) has vents.
2) Bring well up to code so that it meets Bulletin 84 water well standards.
3) . Provide doors and windows and weatherproof structure.
4) Bring all wiring to code.
5) Remove garbage, trash and debri from the property.
6) Remove deteriorated out buildings that are in danger of collapse.
7) Provide an'approved source of heat.
A re -inspection will be made. The building shallnot be occupied until all
repairs are made and approved. Failure to comply will result in the Franchise
Tax Board being notified of your non compliance. You will then be prevented
from claiming state tax deductions for taxes, depreciation, amortization, or
interest expenses connected with the property as long as it. -remains substand-
ard.
This notice is given to you pursuant to Sections 17299 and 24436.5 of the
California Revenue and Taxation Code.
