Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Paradise Unified School District is hereby granted a Use Permit NAME in accordance with application filed: 5/18/82 to allow the construction and operation of a public scho date on property zoned TM -40 located east of Compton and south of Olivert Drives, south of Ponderosa Way, Paradise Pines area, 8 miles north of Paradise.' 1• Failure to comply with the conditions specifies herein as the basis for approval of appli- cation and issuance of Permit, constitutes cause for the revocation of said permit in accor- dance with, the procedures set forth in the Butte County Zoning Enabling Ordinance. 2 Unless otherwise provided for in a condition to a use permit, all conditions must be com- pleted by the permittee within 12 months of the delivery of the countersigned permit to the permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the permittee, the permit shall become null and void and reapplication shall be required to establish the use. SPECIAL CONDITIONS: 1. Domestic water shall be provided by Del Oro Water Company System. 2. The sewage disposal system plan shall be submitted to the Butte County Department of Public Health for review and approval, and compliance with the Sewage Disposal Ordinance. Obtain clearance from the California Regional Water Quality Control Board for discharges and design of the sewage disposal system. 3. Applicant agrees to study the upgrading of Compton Drive at the beginning of Phase II of the project. 4. Provide sufficient off-street parking spaces as required by the Butte County Parking Ordinance. 5. Outside noise levels shall not exceed 60 dB (Ldn) on adjacent' residential properties. 6. Comply with all other state and local regulations, ordinances and statutes. 8. Construct second emergency access road to West Park Drive, 20 ft. wide to minimum traversable standard. 9. Comply with mitigation measures: 1. Disturbed slopes shall be carefully engineered so as to minimize the erosion potential. 2. Slopes and other disturbed areas shall be stabilized against erosion by placement of a wood chip mulch prior to the rainy season on all unsurfaced excavated or embankment areas for which landscaping is not proposed. 3. Upon completion of excavation and embankment of playfields and/or prior to the first rainy season, diversion dikes shall be constructed along the lower end of the playfields, to prevent collected runoff from flowing onto slope faces below. The diversion shall be outlet to heavily vegetated natural forest area or artificially stabilized areas. 4. All areas reserved for landscaping shall be planted as early in the construction stage as possible. All landscaping shall be maintained in perpetuity. 5. Construction equipment shall be carefully maintained to prevent spillage of fuel, lubricating material, and hydraulic fluid. 6. In areas where human encroachment would produce erosion un- mitigatable by mulching or planting, protection fencing shall be installed to preserve the area free from trampling. 7. All construction wastes and debris and unused stockpiled materials shall be removed from the project site after completion of each phase of the work. 8. Construction traffic shall be restricted to predetermined routes. Markers or temporary fencing shall be utilized to define route locations. 9. SPECIAL CONDITIONS CONTINUES: 10. Those phases of project construction which involve soil dis- ruption shall be limited to the normally dry months of the year. 11. Construct necessary road and drainage improvements per the requirements of the Butte County Public Works Department. 12. In those locations where the centerline profile grade of the access road becomes greater than 60, the roadside gutter shall - be paved. 13. To prevent erosion of the roadway embankment at the drainage swale around the culvert, a rock inlet and discharge apron shall be constructed. 14. A dust pallative of sprinkled water shall be applied to all disturbed areas or traveled routes during construction. 15. Construction equipment shall be thoroughly cleaned prior to leaving project site to prevent tracking mud onto public streets. 16. Trucks hauling aggregates to the project site shall be required to provide canvas load covers. 17. Locate facilities in order that an optimum number of mature trees and shrubs will be preserved. Only those trees and major shrubs which are in direct conflict with facility construction shall be removed. (All brush shall be cleared within 30 feet of every building and all tree limbs within 10 feet of building roofs --per Butte County Fire Department.) Extreme care shall be taken not to damage those which are to remain, including their root systems. 18. When trenching for placement of underground utilities, sewer lines, or drainage pipes: a). feeder roots shall not be cut in an area inside the drip line of the tree branches other than as provided below; b) damaged trunks or exposed roots will be painted immediately with tree paint (care for serious injury should be prescribed by a professional forester or licensed tree service); c) construction encroachment into the drip line may be permitted, but not closer than 5 feet on one side of the tree only, if such encroachment will allow tree to be preserved for landscaping and with minimum root disturbance. Vegetation clearing (excluding mature trees) for the school access road and fire lane through the natural areas shall be limited to 20 feet (as required by the Butte County Fire Department) on each side of the actual physical limits of the.. roadway facilities. Natural vegetation shall be retained to the extent possible around parking lots, adjacent to roads, and. around structures to reduce neighborhood visual impacts. 20. During construction, building materials shall be stored on building pads or roadway and parking areas, to prevent soil compaction. 21. Disturbed sites --especially riparian --shall be revegetated with native plants or other drought resistant plants (plant lists should be obtained from a professional forester or licensed nurseryman) as soon after completion of construction as possible, prior to the winter rainy season. 22. A continuous fence (5 feet high minimum) shall be installed around the perimeter of the developed portion of the school site to preserve the designated open and natural space sectors. 23. Fences or obstacles to deer migration or other animal movement shall not be constructed on the external boundary of the undevel- oped project site. This will allow local and migrating deer to use the undisturbed buffer zones and areas not involved in school development as habitat and migration corridors. 24. A 200 -foot wide forest buffer greenbelt shall be maintained along the northern and eastern property border, to be preserved in its natural, undisturbed forested state in perpetuity. 25. School crosswalk road pavement markings in accordance with Chapter 10 of the Caltrans Traffic Manual shall be placed at the follow- ing intersections: Ponderosa Drive and Creston Drive Ponderosa Drive and Compton Drive South Park Drive and Glendale Drive (both ends) South Park Drive and Andover Drive West Park Drive and Ferguson. SPECIAL CONDITIONS CONTINUES: 26. Bicycle/pedestrian lanes shall be established, signed and striped on major access roads within the S -foot paved area between the edge of the street's traveled way and the face of dike, at the following locations: a. On Creston Drive from Citadel Way to Ponderosa Drive. b. On Ponderosa Drive from the Skyway to Creston Drive. c. On West Park Drive between Andover Drive and Ferguson Drive. d. On West Park Drive between Glendale Drive and Ferguson Drive (both ends) . e. On West Park Drive between Ponderosa Way and Ferguson Drive. 27. Conform to the Butte County Fire Department requirements for fire protection measures, which include: a) Structures shall be designed so that fire apparatus will be able to get within fifty feet of each building. b). No building shall be more than 300 feet from a fire hydrant that can provide a minimum of 1,000 gallons per minute. _ c) All brush shall be cleared from within 30 feet of every building and tree limbs removed that are within 10 feet of the roofs. d) The access road shall be a minimum of 24 feet wide and a 20 foot clear zone (firebreak) to be provided on each side of the road, e) A 30 -foot fuel break (with 10 -foot firebreak) shall be constructed and maintained around the perimeter of the developed portion of the site. f) A fire detection and alarm system shall -be built into each structure. The alarm system shall be connected to a supervise( central alarm station. 28. If sub -surface excavation activities uncover prehistoric artifacts or`other evidence of prehistoric aboriginal occupation, construction in the involved area shall be stopped immediately and a qualified archaeologist shall be contacted immediately in order to determine proper mitigation of adverse impacts of the project to the cultural resources involved. 29. Playfields and handcourts shall not be lighted for nighttime use. 30. Exterior lighting shall be shielded to reduce glare potential. Noise shall be controlled during construction by limiting work to normal daylight hours and requiring proper mufflers on all equipment. 33. Construct pedestrial access/pathways to the school yard from Ferguson Drive and/or from South Park Drive. 34. Contribute a proportionate share for future traffic signals at the intersection of the Skyway and Ponderosa Drive.
