The "Application for Variance" is subject to public hearinga and approval by the Planning Commission,
Any'j'iiciol conditions of approval shall be made a p'trt of the approved "Variance" and shall be binding
on the applicant. The procedures for County action on variance applications are stated in Chapter 24
of the Butte County Code,

VARIANCES frim the terms of the zoning ordinance shall be granted only when, because of special

Having to give up 301 on this 801 wide corner lot
to allow for a setback of 25' and 5' adjacent property
line would leave only 50' for a house,, septic tank, and
leach lines.
With !E�.rge trees and rock problems, it is a difficult
situation. The extra 51 would allow just enough to comply
with regulations.
,After walking the property with Iir. James Bhler, of
the Sanitation Department of paradise', he agreesthat
need every bit I can appropriate.
Appatpntly, the Public Utility Commission haus abandoned
12-ii (my side) of the road, as it is 251 wide instead of
the 501, by installing power poles at the 25' curb site,
I at now 3'7;2' from the curb..I would like to have a 5
encroachment, which Mould still leave the house 39-it from
the curb.

It should be noted that the subdivision map of record that created the

along Barat Ct. This coincides with the 50 ft. (from centerline) setback
required by the zone. If the variance is granted it will be -necessary
for the applicant to MoOify thn subdi,vi.sion map in accordance with. the
Butte County Subdivision Ordinance and the State Subdivision Map Act..

There was no "Recreational Easement" on the subject area at any
time, therefore, the necessity for the Board rescinding their
action of approval,
Bozoky's parcel map can be corrected to reflect his intent (light
& air easement removal) with a certificate which corrects the
language on the .final: map.
I am trying to contact his engineer A. C, Bruhns, but have not
been successful as of this memo.
This c6rrect4on procedure ij quite common with minimal expense:
"ihe Board shoul& consider refunding Bozoky's fee inasmuch as the
abandonment: was unnecessary and could have been avoided if, the
correction certificate had been recommended originally.
