a 4.118 acre parcel in a TN}-40 zone on property located on the east side
of Skyway, approximately 1%4 mile south of Coutolenc Road, north of
Paradise; The subject property consists of approximately 7 acres located
on both sides of the Skyway relocation located to the east of Magalia..
That portion of the property located to the West of the Skyway relocation
is rpsentl zoned ARM.A ricultural-Residential Mobile florae 1-acre lots)
This 2;.865 acre parcel meets the requirements of the AR-MH-1 zone. The
4.11.8 acre parcel., to the east of the `Skyway relocation does not'meet the
requirements of the TM40 20 ie in whi.oh it is lucated. The appl:i taut
wishes to divide the property at: the Skyway relocation:
The subect�, site is heavily wooded with increasing slopes to the east
as t}1e property drops off into the Peather River Canyon, Some clearings

California Highway, Patrol.: "The New Skyway is a curving/winding roadway

due to the mountains and the curves, I believe the speed limit was
i established at 35 MPH due to the limited sight distance. A person backing
out of his driveway onto the road, would create a traffic safety problem.
These comments are in general and apply to the entire length of the new

ANALYSIS
This ljroject is a request fdr a Variance to alloy the Creation of a
pa -cel of approximately 4 acres in a TM -40 zone (Timber Mountain - 40
acre minimums). The applicant's property is located on both sides of the
New Skyway Alignment in the Maga;lia area, north of Paradise. The Old
Skyway Alignment is located at the west side of the applicant's property:
Prior to the construction of the New Skyway Alignment (along the old
Southetti.Pacific Railroad right-of-wav) access to the easterly portion
of the applicant's property teas simply by crossing the unused railroad
right -OP -WAY, Upon completion of the New Skyway Alignment this method
Was no longer practical, As such it appears that there is a hardship
being created due to the construction of the New Skyway, A search of
records by the Butte County Department of Public Works has revealed that
the 'applicant has no fee interest in the area of the old railroad right-.

direct rights to the land or any crossings,
A field ,inspection of the property revealed that most of the land to the
east of the Neto Skyway Alignment is exceptionally steep; :from -0 to '60%
slopes. It is questionable whether, a building site and adequate area for

deprive the property of privileges enjoyed by other property in, the
Vicinity and under identical zoning classi°Fications; and
C, Deny the Variance to allow the creation of a 4 acre parcel in a TM -40
