District 747 Elliott Road Paradise, CA 95969 Mr. Yamaguchi: Since 7 July 2006, I have been denied the peaceful enjoyment of my property and deck by this unfounded false complaint, filed with the Butte County building department, alledging an unidentified deck safety issue. To deny me the use of my deck by this false unfounded complaint is to deny me my civil right to peaceful enjoyment of my property. Failure by Butte County to enforce the code against filing a false report, or issuing citations for penalties and fines, is contributory to the violation, a waste of manpower hours, a waste of taxpayer monies, and creates a conflict of interest for Butte County. Since this complaint has proven to be unfounded, it is the duty of Butte County public employees, and elected or appointed officials to enforce the applicable code for the violation of filing a false report. Failure to enforce the applicable code for the violation of filing a false report would be contributory to that violation. I never accept excuses for bad behavior since that would condone and continue the bad behavior. I do accept fines, penalties, and apologies. BUTTE COUNTY SEP 1 1 2006 DEVELOPMENT SERVICES C 0 M P LA IN T :, 7 July 2006, Butte County building inspector Richard Nixon, issued me a correction notice for an unidentified deck safety issue. 7 September 2006, Butte County building inspector, Scott Rutherford, accompanied by two armed, uniformed deputy's, and one plain clothed armed officer, inspected my deck based upon a false complaint, made by an unidentified complainant, 6ha1iogdedeskfz4e%6dwwi91 tted. After a brief two minute visual inspection, the inspector declared the false complaint unfounded. Before the inspector and officers departed, I told the inspector that because of this false, unfounded complaint, I was forced, for legal reasons, to place my deck off limits for the summer. I believe this false report violated my civil right to peaceful enjoyment of my property and surroundings.
