Three (3) ground -mounted equipment cabinets are also proposed to be placed near the base of the monopole within an existing lease area. The property is zoned C-2 (General Commercial) and is located on the east side of Old Skyway, at 13700 Old Skyway (Magalia Community Church), Magalia. APN 066- 470-033 (SB) (MUP 04-01) Steve Betts gave a brief summary of the project. He said staff has not heard any negative comment from the public regarding this project. Commissioner Leland left the hearing at this time. Chairman Lambert asked about the meaning of the last line on page 2 of the staff report, "The project would not interfere with possible helicopter operations from the project site." Mr. Betts said there is a big, flat area on the project site, and also a concrete pad which looked like it could be used for an emergency helicopter. He said if there are any helicopter operations on the property, the antennas will not impact them. The hearing was opened to the public. David Albertson stated he works with Ubiquitel, which is an affiliate of Sprint PCS, and was present to answer any questions. Commissioner Nelson asked if the proposed antennas would be above the existing ones. Mr. Albertson answered "yes, they are." Chairman Lambert said the proposed antennas would not be higher than the current existing pole: She asked Mr. Albertson if he had reviewed the conditions and was comfortable with them. Mr. Albertson replied "we are." The hearing was closed to the public and comments confined to the Commission and staff. It was moved by Commissioner Marin, seconded by Commissioner Evans, and unanimously carried to approve the Minor Use Permit for Ubiquitel PCS, MUP 04-01, subject to the findings and conditions as stated according to the staff report of December 11, 2003. . , I. Find that this project is exempt from the provisions of the California Environmental Quality Act under Section 15311. Section 15311 consists of construction of minor structures accessory (appurtenant) to existing facilities. Antennas placed on an existing monopole are considered to be accessory structures. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. II. Approve Minor Use Permit 04-01 for Ubiquitel PCS, subject to the following findings and ■ BUTTE COUNTY PLANNING COMMISSION • MINUTES • DECEMBER 11, 2003 • PAGE 21 the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Commercial and is zoned C-2. The Commercial land use designation allows public utilities as Secondary Uses. The C-2 zone allows collocation of communication facilities with approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the existing monopole or extend horizontally beyond the existing antennas. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with a 182 foot tall monopole. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. The proposed antennas would not result in a significant visual impact to the neighborhood. The radio-frequency emissions from the proposed antennas must meet FCC standards. Only a minor amount of vehicle traffic would be generated during installation of the antennas and equipment cabinets. The communications facility is unmanned and only one to two site visits per month per wireless carrier would be required after installation of the antennas. The proposed antennas and the equipment cabinets would not generate any significant noise levels. 5. The suitability of the site for the type and intensity of use or development which is proposed: ■ BUTTE COUNTY PLANNING COMMISSION • MINUTES • DECEMBER 11, 2003 • PAGE 22 0 • The site is ideally suited for the project because the proposed antennas would be mounted on an existing 182 foot tall monopole. The project would not have an impact on the church and cemetery uses established on the site. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and the Town of Paradise and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of Butte County Code Chapter 24, Section 262. E. This project would collocate antennas on an existing communications monopole, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency emissions generated by the existing and proposed antennas on the monopole would be below the public exposure limits set by the Federal Communications Commission for wireless communication facilities. G. The proposed antennas would not create any impacts to aircraft or helicopter operations because they will not increase the height of the existing monopole nor extend horizontally beyond the existing antennas. H. Wireless telephone services are regulated by the California Public Utilities Commission and are considered to be a public use. Conditions of Approval: Planning Division 1: The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment D" and date-stamped September 23, 2003, and is incorporated herein by this reference. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. • BUTTE COUNTY PLANNING COMMISSION • MINUTES • DECEMBER 11, 2003 • PAGE 23 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to,create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit • BUTTE COUNTY PLANNING COMMISSION • MINUTES • DECEMBER 11, 2003 • PAGE 24 revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. The Facility shall be secured at all times to prevent access by the public. Building Division 18. Building and electrical permits required. Structural calculations prepared by an engineer licensed to practice in the State of California shall be provided verifying adequacy of existing monopole to support added loads. Public Works 19. Obtain encroachment permit and construct driveway approach access to County standards. Environmental Health Division 20. Prior to issuance of a building permit, provide a completed Hazardous Materials and Emissions Questionnaire. County Counsel 21. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-41. 2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or concurrently, with the establishment of the granted use. The use granted by this permit must be established within 12 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, thepermit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 1' Conditions of Approval: Planning Division 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment D" and date-stamped September 23, 2003, and is incorporated herein by this reference. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority. to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered. structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of.the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility. shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement 2 of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or•welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall. cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained 'as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in -the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the- County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. The Facility shall be secured at all times to prevent access by the public. Building Division 18. Building and electrical permits required. Structural calculations prepared by an engineer licensed to practice in the State of California shall be provided verifying adequacy of existing monopole to support added loads. 3 Public Works 19. PROJECT DESCRIPTION/SITE CHARACTERISTICS: • The project would allow the collocation of six panel antennas, 4 to 5 square feet each, centered at the 160 -foot level on an existing 182 -foot tall monopole. Three small equipment cabinets are also proposed to be placed near the base of the monopole, within an existing 1,400 square foot lease area. • The proposed antennas will provide improved personal communications services to the public in the Paradise/Magalia/Paradise Pines area. • The project parcel is developed with a 182 -foot tall monopole, a church, and a cemetery. ■ BUTTE COUNTY PLANNING COMMISSION ■ UBIQUITEL PCS MUP AGENDA REPORT ■ ■ DECEMBER 11, 2003 ■ PAGE 1 OF 9 ■ • The monopole was permitted with Use Permit 92-94 and currently supports six panel antennas and one microwave dish. • Use Permit 01-25 was approved in 2001 to allow the replacement of two vertical antennas with the current panel antennas. • The existing monopole is painted a light blue color and is not lighted. • The area where the existing monopole is located is zoned C-2 and has a General Plan Land Use designation of Commercial. • Surrounding parcels are zoned C-2 and AR -1 (Agricultural Residential — 1 acre parcels). Land uses on the surrounding/nearby parcels include a cemetery, commercial uses, and single family dwellings. • The project site is not located within an Airport Compatibility Zone. • The project site is within the Town of Paradise's Sphere of Influence. • The project parcel is owned by the Magalia Community Church. The existing lease area is owned by AT&T Wireless Services. ANALYSIS: • The project would not result in a significant increase in air emissions, fugitive dust emissions, light, noise, or vehicle traffic. • Only a minor amount of construction activity and soil disturbance would be required due to the project. • The proposed panel antennas are not expected to create any significant visual impacts because they will be flush mounted, thus reducing their visibility. • The large number of trees in the project area helps to shield the existing monopole from view. • The project will not result in an increase in the height of the tower, nor will the proposed antennas extend horizontally beyond the existing antennas. • A photo simulation of the proposed antennas on the existing monopole shows that the proposed antennas would not be highly conspicuous. • The proposed antennas and mounting hardware are required to be painted the same color as the existing monopole to help reduce their visibility. • The Town of Paradise did not object to the project and commented that improved cellular service is beneficial to the area. • The project would not interfere with possible helicopter operations from the project site. ■ BUTTE COUNTY PLANNING COMMISSION ■ UBIQUITEL'PCS MUP AGENDA REPORT ■ ■ DECEMBER 11, 2003 ■ PAGE 2 OF 9 ■ :. • Zoning Consistenc • The project site is designated as Commercial by the Land Use Element Map of the General Plan, which allows public uses as secondary uses (note: cellular phone service providers are considered a public utility because they are regulated by the California Public Utilities Commission). • Butte County Code Section 24-146 states that communications facilities, including the collocation of antennas on existing towers/monopoles, are not permitted in the C-2 zone unless a permit is obtained, subject to the requirements of Butte County Code Section 24- 262. • Butte County Code Section 24-262(d) states that a Minor Use Permit is required for the collocation of antennas. The project has been conditioned to meet the requirements of Section 24-262, including: • Radio-frequency emissions in excess of FCC standards are not allowed. • Facilities that are not in continual use for a period of six (6) months shall be considered to be abandoned. • Verification submitted annually attesting that the radio frequency radiation/ electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. • Access to the site must be at least 12 feet wide and capable of supporting a 40,000 -pound fire apparatus. Radio -Frequency Emissions • A radio-frequency analysis determined that the combined radio-frequency emissions from the existing and proposed antennas would be 0.002% of the FCC standard for public exposure to radio-frequency emissions at the base of the monopole. • The proposed operation of the site would be in compliance with the FCC requirements for public exposure to radio-frequency radiation. ENVIRONMENTAL REVIEW: This application for a Minor Use Permit to allow the collocation of antennas on an existing communications monopole is Categorically Exempt from the provisions of the California Environmental Quality Act under Section 15311. Section 15311 consists of construction of minor structures accessory (appurtenant) to existing facilities. Antennas placed on an existing monopole are considered to be accessory structures. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 are not required. II. Approve Minor Use Permit 04-01 for Ubiquitel PCS, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordance with the purpose of the zone in which the land lies and. the Butte County General Plan because the project site is designated Commercial and is zoned C-2. The Commercial land use designation allows public utilities as Secondary Uses. The C-2 zone allows collocation of communication facilities with approval of a Minor Use Permit. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the existing monopole or extend horizontally beyond the existing antennas. 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with a 182 foot tall monopole. The proposed antennas to be mounted on the existing monopole would not have a harmful effect upon the neighborhood character. The proposed antennas would not result in a significant visual impact to the neighborhood. The radio-frequency emissions from the proposed antennas must meet FCC standards. ■ BUTTE COUNTY PLANNING COMMISSION ■ UBIQUITEL PCS MUP AGENDA REPORT ■ ■ DECEMBER 11, 2003 ■ PAGE 4 OF 9 ■ 0 • Only a minor amount of vehicle traffic would be generated during installation of the antennas and equipment cabinets. The communications facility is unmanned and only one to two site visits per month per wireless carrier would be required after installation of the antennas. The proposed antennas and the equipment cabinets would not generate any significant noise levels. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antennas would be mounted on an existing 182 foot tall monopole. The project would not have an impact on the church and cemetery uses established on the site. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility application to County Agencies and the Town of Paradise and has received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of Butte County Code Chapter 24, Section 262. E. This project would collocate antennas on an existing communications monopole, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency emissions generated by the existing and proposed antennas on the monopole would be below the public exposure limits set by the Federal Communications Commission for wireless communication facilities. G. The proposed antennas would not create any impacts to aircraft or helicopter operations because they will not increase the height of the existing monopole nor extend horizontally beyond the existing antennas. H. The project site is zoned C-2 and has a General Plan land use designation of Commercial. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-41. 2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the delivery of the countersigned permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment D" and date-stamped September 23, 2003, and is incorporated herein by this reference. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. PCS, like cellular telephone systems, employs transceiver. stations that carry and hand off phone signals as the caller moves from one area to another. In addition to wireless voice communication, PCS technology offers paging, message sending, data transmission, and emergency services on a wireless platform. The objective of the proposed project is to provide continuous coverage from Chico through Paradise and Magalia. Site Description and Approval Requests UbiquiTel Wireless hereby respectfully requests a Use Permit to allow for the addition of (6) antenna panels, with related ground mounted equipment on the existing 187'AT&T Wireless monopole located at 13700 Old Skyway, Magalia, CA. The parcel is zoned C-2 anda has a General Plan Land Use designation of Commercial. Surrounding parcels are zoned C-2 and AR -1 (Agricultural Residential -1 acre parcels). Land uses on the surrounding parcels are the church (Magalia Community Church) and single-family dwellings. No new ground structures are proposed nor will the existing lease area be increased in size. All support equipment will be housed in the existing fenced compound. The objective of the proposed project is to provide continuous coverage from Chico through Paradise and Magalia. Location Choice Discussion The proposed location utilizes an existing monopole. The project, as it is proposed, eliminates the need for additional poles or towers within the vicinity as well as meets Ubiquitel PCS' objective of providing continuous coverage along Skyway extending from the Paradise to the Magalia region. Other possible sites in the area were dismissed due to lack of vertical height or the need to construct a new facility. Closing Discussion The establishment and operation of this wireless communications facility, as proposed, will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of proposed use, or be detrimental or injurious to property and improvements in the neighborhood of proposed use, or to the general welfare of the County of Butte. a.) The co -location to the existing monopole will help to reduce the proliferation of freestanding communication sites. b.) The facility is proposed at a location that will not interfere with existing land uses on the subject parcel and throughout the surrounding area. No additional parking, utilities, or services required at this site as a result of this proposal. The location of the facility will not interfere with future uses of the subject parcel and surrounding parcels that are consistent with the provisions of the zoning ordinance for the respective districts or the general plan of the county. c.) The proposed facility will contribute to the provision of an enhanced wireless communication technology for general public and emergency service use. d.) Moore Broadcast Consulting was retained by the Cingular Wireless to make an independent assessment of the RF environment at the Magalia Site Number TWS-000132-A, 13700 Old Skyway, Magalia, CA. The assessment was made to comply with the requirements of Butte County zoning rules paragraph 12 cited below: "Il 2) A report, signed by a qualified radio frequency engineer licensed by the FCC, prepared pursuant to FCC OET 65, stating whether the maximum radio frequency radiation/electromagnetic radiation (RF/EMF) to be emitted by the proposed Facility, taking into account all other Facilities, both existing and known future Facilities, at the proposed site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable. The reports prepared for Facilities shall conform to the reporting requirements set by the County and FCC OET 65 human exposure standards. The report shall also analyze the evidence provided in support of the proposed Facility location, height and radiated power, frequency, the number of channels, and all other related data and present alternatives for the location, height and radiated power, pursuant to the requirements of this section. If the proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also provide additional comprehensive technical and planning information regarding how the applicant shall protect all persons from such excessive exposure consistent with all Federal and State requirements, and any additional County requirements." Provided are predictions for the site with AT&T Wireless facility plus the addition of Ubiquitel proposed facility. The facility studied consists of a monopole with the AT&T Wireless cellular and proposed Ubiquitel PCS services. Analysis The ANSI/IEEE/FCC standards are expressed in terms of power density, electric field strength squared and magnetic field strength squared. The power density S can be calculated per equation (6), page 20 FCC Office of Engineering and Technology (OET) Bulletin 65 as follows: S + EIRP/(p x R), where S is - the calculated power density from a RF antenna in µW/cm2. EIRP is - Effective Radiated Power (ERP) referenced to an Isotropic radiator = ERP (watts) x 1.64 x 106 (micro-watts/watt) x Gain(A) p = 3.142 R is - the line of site distance from the antenna in centimeters The parameters used and calculated are shown in Figure 1. The head is the closest part of the body to the antenna, therefore, the point where the highest level is received by the body. The results are shown graphically as a function of distance from the antenna base (D). The cellular antenna is designed to radiate most efficiently in the horizontal plan. Therefore, the power at angles below the horizontal is reduced. The reduction is expressed as the vertical pattern of the antenna. The Gain(A) ofthe antenna varies as a function of the angle below the main beam, o. The angle o, R and Gain(A) are determined by H - the height above ground of the antenna center of radiation and D - the distance on the ground from a point directly below the antenna. OET Bulletin 65 states, "For a truly worst-case approximation, 100% ground reflection should be assumed resulting in a potential doubling of predicted field strength and a four -fold increase in (far -field equivalent) power density." Equation (6) provides that worst-case approximation. Results Analysis The predicted received fields in AW/CM2 are as shown in Figure 2. The predictions were calculated at 6 feet AGL. The lowest transmitted cellular frequency is 880 MHz, and the lowest PCS frequency is 1900 MHz. The maximum predicted for the existing AT&T Wireless operation is 0.005 µW/cm2. The predicted additional RF field from the proposed Ubitqutel facilities as proposed would add less than 0.03 µW/cm2. The combined RF environment from the existing and proposed facilities would be less than 0.03 µW/cm2, or less than 0.002% of the FCC standards for public exposure. TIA/EIA standards require tower structures to be re -analyzed when modifications create additional forces or change the structure's capacity. This investigation, analysis, and report has been prepared under ' the direction and authorization of UbiquiTel PCS for the purpose of identifying potential structural deficiencies of the monopole. Only the structural integrity of the monopole and ' foundation are included in this report. ' MONOPOLE CONDITIONS ' Th 1 I ' The 80 steel monopole is constructed of ASTM 572 plate steel in five 36 long segments. ' The 12 sided pole tapers from a 52" diameter at the, base to 16"\diameter at the top. The monopole is supported by a reinforced concrete drilled shaft of 7' diameter and 21' embedment. The caisson is reinforced with 20-#11 vertical bars and #4 circular ties at 12" on centers for the full depth of the caisson. The actual dimension of the steel monopole ' and connections are as shown on the manufacturers drawings and included in appendix D. The existing antenna configuration is as follows: (3) 8' Whip antenna at 180' AGL with radial support brackets (1) 4' Diameter microwave dish at 160' AGL with radome (12) 8' Panel antenna at 125' AGL with radial support brackets ' The proposed antenna configuration will consist of the following: (6) 4' Panel antenna at 170' AGL with radial support brackets Coax cables are located within the monopole interior and, therefore, were not included in the analysis. ANALYSIS The purpose of this analysis was to determine the adequacy of the monopole structure to resist loads induced by wind forces on the monopole and antennas. A three-dimensional analysis computer program (RISA 3-D) was used to model and analyze this monopole for the maximum probable wind loads encountered by the structure. Appendix C contains the output from our computer analysis. The maximum probable wind loads used in the analysis were obtained using the TIA/EIA- 222-F standard. The monopole was analyzed for two different load cases. The first load case analyzed the structure using a 75 mph basic wind speed with no ice buildup. The second load case analyzed the structure using a'/2" radial ice build up on all elements and 75% of the wind force using the 75 mph basic wind speed. I RESULTS The monopole was analyzed using the antenna loading described in the previous section and Appendix B. The non -ice case was found to produce the greatest forces on the monopole. The analysis indicated the following: MONOPOLE ELEMENTS: Within allowable stress limits CONCRETE. DRILLED PIER: Within allowable stress limits It is concluded that the monopole, subjected to the proposed wind loading, is adequate for its intended purpose. However, antenna performance should be verified for the increased lateral drift as indicated in the calculation output and appendix F "Summary of Results". 2 LIMITATIONS This structural analysis is limited in scope. The study focused on lateral forces only and did not cover any other load condition. Because many structural conditions could not'be verified, certain assumptions have been made. These assumptions, which include facts relating to the original design, structural properties of the pole materials, and actual construction practices, cannot easily be verified. It should also be noted that the wind loading criteria used for this evaluation was based on prescriptive Uniform Building Code requirements. A = Projected area V = Wind Velocity (MPH) The total wind forces for the monopole and the cables were distributed evenly along the length. The wind load on the discrete accessories (antennae) was based on the maximum cross sectional area and maximum coefficients.
