It appears that the inspector was supposed to arrive for rough inspection on July 23, 1980; that Mr. Burgess' employees waited around for quite a length of time in 108 degree heat to back -fill the sides of the pool and fill the pool. Since the inspector did not arrive until the afternoon of the 24th, they went ahead and backfilled the pool walls. When he did arrive on the 24th, he wrote up a notice of correction, a copy of which is attached. These corrections are unnecessary for a rough inspection and the notice was incorrect in other particulars as follows: 1. Provide approved set of plans; Please be advised 7. that the permit with the plans was at the job and posted on the wall adjacent to the pool. 2. No inspection of walls before done: This pool is an in -ground installation and not freestanding and,, therefore, no inspection of the walls before filling is necessary. Please see the attached copy of report from McCain Associates indicating that a structural check of the walls does not apply if.the ground line is within 4 inches of the top rim. This is the case here. 3. Provide minimum. 12 inch burial of water circulating pipe with pipes exposed for inspection: Please note that the pipes were exposed for inspection and are going to be covered with decking so that burial under 12 inches of dirt is not necessary since no digging will take place under the deck. 0861 e I Onb we s�baM ��,�®y ?end dp •1dp Jim Glander August 13, 1980 page 2 4. Leaks visible in filter equipment' and 5." Motor not secured in place: Please note that these items do not need correction on a rough inspection bur are matters that should be checked on the final inspection, as all leaks will be corrected by that time and the motor will be secured in place. Last but certainly not least, the inspector involved should be severely reprimanded for making his voluntary and gratuitous comments to the Sullivans. As you will see from the attached letter signed by Mrs. Sullivan, Mr. -Stilwell made the -remark that Leisure Time .and Burgess did not know how to build a pool and told about alleged mistakes made in prior pools'by Leisure Time. This type of behavior on the part of an inspector is not part of his job. His job is to protect the individual permit owner by conducting an adequate inspection and noting any corrections that need to be made. His comments could be regarded as slander and the County as well as Mr. Stilwell could be liable in a lawsuit for slander since such comments as he made certainly injured Leisure Time and Mr. Burgess in their �Y,,A— reputation and business. As you can see from Mrs, Sullivan's letter, Mr. Stilwell was incorrect when he said there were no plans on the job. It appears to me that in addition to slander, Mr. Stilwell was deliberately engaging in a course of harrassment of Leisure Time and interfering with Leisure Time's business interests. Please see that this does not happen in the future and that none of the inspectors for the County engage in any further harrassment of Leisure Time, and that they no longer interfere with.any of the'business relationships of Leisure Time products. Perhaps it would be best if you screen the inspectors who have a personal vendetta against Leisure Time and no longer let then be assigned to inspect any of Leisure Time's jobs. If you wish to discuss this with me, please call me at your convenience to arrange a meeting in person or to discuss the same by phone. Also, I note that there were a number of earlier jobs that have not been finalized yet that we were supposed to get together and finish up.
