referenced properties. As I mentioned, my client, Ms. Judie L. Sutton, is the record owner of those
two parcels of land. We would like to request a copy of the County's file on both properties,
including applications for building permits, issued building permits, correspondence, and particularly
any notices of violation of building codes (or other applicable laws).
I understand that it will take approximately ten days for the County to process our
request, and then the County will contact me, at the number listed above, to inform me of the cost
for the duplication of the documents. I would appreciate it if the copies could be mailed to this
office (we would of course pay any mailing costs).

PUBLIC RECORDS ACT REQUESTS:
Should you receive a Public Records Act request, you must forward this request
to County Counsel along with a "Request for Legal Services for Public Record Act
Requests, Summons £t Complaints and Subpoenas" form immediately. These requests
are extremely time sensitive. Pursuant to Government Code section 6256, a response
needs to be made within ten (10) days after receipt of the request. County Counsel
will review the request and provide a response or assist in providing a response to the
requestor.
The law on production of public records is more complex than it might appear
and includes many exemptions and nuances which you should not attempt to
determine without legal assistance. Basically, a public record contains information
relating to the conduct of the public's business, prepared, owned, used, or retained
by any state or local agency regardless of physical form. It may include information
that is handwritten, typed, printed, photostated, photographed and every other
means of recording upon any form of communication or representation, including
letters, words, pictures, sounds, or symbols, or any combination thereof, and all
papers, maps, magnetic or paper tapes, photographic films and prints, magnetic or
punched cards, discs, drums, and other documents.
It is important to note that-publi_c_r_eco.r_ds-requests-do-notnecessar-ity-have-to
be in writing. This is often a source of confusion.
If you think that you have received or may have received a public records
request, you should immediately notify your supervisor.
The steps that must be followed in order to have your request processed
quickly and accurately are as follows:
1. The "Request for Legal Services for Public Records Act Requests,
Summons £t Complaints and Subpoenas" form needs to be completely
filled out and must include the supervisor's signature. This form can be
found on the backbone as well as at the end of this manual.
2. The written request must be attached to the form when it is
presented. If the request was oral, a clear statement of the request
must be included along with the name of the party requesting the
records.
3. A primary contact person in the requesting department must be
indicated so that -any further information required can be obtained -from
that department without delay.

Dear Judie Sutton Trustee;
Through our courtesy notice on February 2, 2006, you were notified pursuant to. Section 41-2 of the
Butte County Code of the presence of code violations on your above -referenced property. According
to our records, the courtesy notice has not resulted in abatement or correction of the
following specific violations:
1. The accumulation of junk in public view.
Your failure to eliminate the stated violations is cause for the issuance of this formal warning notice.
This is notice that as of this date, our records indicate that the following violations to the Butte
County Code still exist:
Butte County Code, Chapter 24, Section 24-65 - Applicability of zoning regulations. All uses
of land within a zoned district not specifically authorized or permitted by regulations are
prohibited.
Butte County Code, Chapter 24, Section 24-95 - The AR (Agricultural -Residential) zone does
not "specifically authorize" large accumulations of junk. The storing of more than 100 square
feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition
exists. A "junkyard" is not an allowed use in the AR zone without a Use Permit.
"Automobiles and other vehicles, dismantled, in whole or in part" are considered to be
"junk." Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or
not, from storing junk in public view.
The determination that this violation exists on the property is based on the following. definition in the
Butte County Code:

• Butte County Code, Chapter 24, Section 24-305.451 - Violator. An adult owner, tenant,
occupant, resident or other person having possession, control or any other ownership interest
in or the right of access to the premises, who is suspected or alleged to have violated or to be
in violation of any Butte County Code provisions of the Chapters specified in Butte County
Code Section 24-305.451.
In order to bring the property into compliance with the Butte County Code and avoid further
enforcement actions, you are hereby requested to take the following abatement or correction actions:
1. Remove all "junk" in accordance with the Butte County Code, Chapter 24, Section 24-
305.240.
This is your final warnin . Unless you contact this office and make the proper arrangements to
correct or abate the violation(s) voluntarily, within . ten 10 days from the date of this letter,
enforcement shall be pursued through the issuance of a citation (ordering you to appear in court) for
said violation(s) and for failing to comply with this warning letter.
Upon conviction of said violation(s) or of failing to comply with this letter, the court shall impose
penalties (fines) and a Notice of Violation shall be recorded in accordance with Butte County Code
Section 41-7. The Notice of Violation will include a description of the premises, the violation
concerns, a description of the violation, the date of your convictions and the action necessary to
correct or abate the violation(s).

The Butte County Department of Development Services, Code Enforcement section has determined
by inspection and research that there are currently code violations present on your property at the
above -referenced location. Specifically, the violations include:

On August 24, 2000, this office received a complaint that you were performing grading on your
property without a permit and that you were possibly filling in wetlands.
A field review by County personnel determined that you have or will likely exceed the 1000
cubic yard soil quantity that will trigger the requirement for you to obtain a grading permit from
the County.
You must stop all further grading activities until you have either obtained the necessary grading
permit or obtain a Determination of Grading Permit Exemption.
I have enclosed both a Determination of Grading Permit Exemption form for you to fill out if
you feel your work is exempt under the listed exemptions, and a Grading Permit Application.
Please submit your request for Determination of Grading Permit Exemption or your grading
permit application with the required permit fees to the County as soon as possible. If you have
