Bruschi This is a formal warning notice. Pursuant to Butte County Code (BCC) Section 41-2, we sent you a courtesy notice dated June 2, 2004, notifying you that you are in violation of the BCC, and 1998 California Building Code (CBC), at the above -referenced location. As of this date, the following violations still exist: Failure to obtain the required permits, inspections and approvals from this office for the construction of an enclosed porch, room addition, awnings and deck repair. (a) - Section 106.1 Permits Required (b) Section 108.1 Inspections Required (c) Section 108.4 Inspection Approval Required Before Use or Occupancy (d) Section 3405 Change in Use Requires Conformance to Code The above violations(s) shall be corrected or abated by you by submitting three (3) complete sets of plans, applying for the required permits, and paying the appropriate fees, including penalties. After permit issuance and field authorization to proceed, the work must be completed and approved by this office within the permit specified time. This is your final warning. Unless you contact this office and make the proper arrangements to correct or abate the violation(s) voluntarily, within ten (10) days from the date of this letter, enforcement shall be pursued through the issuance of a citation (ordering you to appear in court) for said violation(s) and for failing to comply with this warning letter. The ceiling height was less then 8 feet, thereby failing to comply with code requirements. In addition, the premises were far from safe and secure from the elements. Water, as well as what appeared to be urine from your dog which was kept on the "dog run" or the porch above their premises leaked through the ceiling. This resulted in mold and mildew infestation, contamination, and the subsequent ruin or destruction of much of their clothes and personal property. Based, upon the information provided to me, the premises were never legally a valid and proper rental unit, nor was the property zoned for such. Rather, it was an unpermitted ad on "room" under the porch. The fact that you apparently tried to hide this rental unit from your insurance company when they came to make an inspection of your premises lends creedance to the foregoing contension. Due to the constructive eviction, and the health and safety and habitability violations which resulted in that constructive eviction, there was no rent coming due as of April 2004. Accordingly, rent in the amount of $550.00 which was tendered in good faith for the month of April 2004 should be returned in full forthwith. (Note, if the premises were in fact an illegal rental, there would be a claim for all rent paid to be refunded or reimbursed). In addition to the rent refund for owed the month of April, Mr. and Ms. Donelson's security deposit in the amount of $1,100.00 is to be returned in full immediately. There was no rent coming due because of the constructive eviction and the substandard rental. There were no damages beyond normal wear and tear caused by Mr. and Ms. Donelson for which they were responsible. Therefore, no deductions from their deposit would be appropriate or supported by the facts and applicable law. As you no doubt know, pursuant to Civil Code Section 1950.5, their deposit must be returned to them in full within three (3) weeks of moving out, or a proper written accounting providing for how you contend it was used. Neither the deposit return, nor the statutorily required accounting was given. Therefore, in addition to the liabililty for the return of the security deposit itself ($1,100.00), there is also a claim for a statutory claim of up to twice the deposit. ($2,200.00). Since Mr. and Ms. Donelson experienced a constructive eviction or forced move, they are also entitled to reimbursement for their moving expenses. They reasonably estimate this to have been $350.00. In addition, I am informed that the power to the premises was shut off by you without any advance notice to them. This resulted in the loss or destruction of all of their food which was stored in the refrigerator and freezer. Mr. and Ms. Donelson reasonably estimate that the value of their lost food is $300.00. There was also personal property which was damaged, lost or destroyed in the approximate amount of $500.00. Not counting the potential claim for reimbursement of all rent paid during the tenancy, or statutory penalties, the Donelson's claims come to a total of $2,800.00 ($550.00 April rent refund, plus $1,100.00 deposit refund, plus $350.00 moving expenses, plus $300.00 of lost food, and :i 4 $500.00 personal property damage). The foregoing should be paid directly to Mr. and Ms. Donelson within two (2) weeks of receipt of this letter. The reimbursement check should be made out to them but should be mailed directly to my office. If reasonable compensation is not promptly made to Mr. and Ms. Donelson, it is their intent to file a court action to collect all of the damages to which they may be entitled, including full retroactive rent abatement, deposit refund, and all applicable statutory penalties, attorney's fees and court costs. Hopefully this matter can be solved quickly and expeditiously thereby avoiding needless litigation.
