GENERAL NOTES This foundation plan is designed to be used with MFG'D Home: Make: CHAMPION MODEL: 620 2. Design Loads: Roof Live Load: 20 P.S.F. Floor Live Load 40 P.S.F. Wind Load: 20 P.S.F. Seismic Zone: 4 3. This foundation is for placing MFG'D Homes constructed w/longitudinal or cross joists. 4. All concrete shall have a compression strength of 2000 P.S.I. in 28 days. 5. This foundation plan is designed to be constructed on a fairly level site (with no existing soil problems). 6. MFG'D. Foundation Contractor shall verify all dimensions before constructing the foundation.(The units were shipped to Integrity's sales lot in Oroville on 21 January 1999) where they remained until May 1999 when moved to the site. The foundation contractor had more than ample time to check the dimensions but installed the foundation incorrectly (short) Being the 1 February 1999 moving date stated by Eddie Hyatt of sales indicated, it never occured until 12 June 1999. and we hired Attorney Robert Hewitt as our eyes and ears on 24 March 1999 until mid July when released. On 25 March 1999, my wife and I went to the Bldg. Dept. and requested that the Foundation Plan be pulled for review by Dave III inspector working the counter. Dave indicated that the details specified 6" of thick gravel throughout the entire crawl space under the two units, and said this was standard practice for MFG'D. Homes. However, when I came back up from San Luis Obispo area to check on progress and being the skirting wasn't installed, I headed to the Bldg. Dept, since the foundation had been poured and the units in place, but no evidence of 6" gravel. At 7:30 A.M. Bart League was wipeing off his truck in front of the Bldg. Dept. office 25 May 1999, and he arranged for me a metting.with M;r,haP1 V;Prn e F n at b A.M. Bart informed me that if he had the authority, that the entire job to date would be bulldozed down, condemned, and started from scratch again. Viera informed me prior to my departure that he would contact the engineering -firm in Sacramento which he did. A letter dated 26 May 1999 from the engineering firm ,_.. was.forwarded to me indicating that the 6" of gravel was not essential. (WRONG) This was the beginning of a triangleular conspiracy orchestrated by Michael Viera, Integrity Homes, and David Dalmen of the Engineering Firm to cover each others ass. Page two As noted on the FOUNDATION PLAN; NOTICE TO CONTRACTORS: A REASONABLE EFFORT HAS BEEN MADE TO OBTAIN ALL PERTINENT DIMENSIONS. HOWEVER, THE MANUFACTURER OF THE MANUFACTURED HOME CAN CONSTRUCT THE UNIT WITH DIMENSIONS SLIGHTLY DIFFERENT FROM THOSE SHOWN HEREON. IT'S THE FOUNDATION CONTRACTOR'S RESPONSIBILITY TO VERIFY DIMENSIONS. I.E. ACTUAL LENGTH AND WIDTH OF UNIT, CHASSIS SPACING AND RIDGE BEAM SUPPORT LOCATIONS WHERE APPLICABLE BEFORE CONSTRUCTING FOUNDATION. The responsibility of the foundation contractor is under the jurisdiction of Integrity Homes, "they being the prime site licensed contractor", and also the sole responsibility of the the Butte County Building Department for all pertinent inspections, "not only the soil conditions and site grading, footings and stem -walls and,reinforcement steel, but also the foundation bolts setting and seismic foundation tie -downs (none), and all structural reinforcement concrete or aggregate membranes such as "reinforced concrete bond beams, engineered.foundations, concrete base pedistols that support pier structures that in turn support the floor structure, and/or 6' of gravel specified to cover the entire crawl space area (none). I originally payed for in my deposit, monies to cover all permit inspection costs ($4,000 in exactness). The Bldg. Dept. is responsible for all inspections in it's entirity including all connections and fastening devices as mentioned and finger pointing by Viera is not accepted by any means. The above mentioned has pointed out but two of the culprits responsible. Now comes the most formidable players of graft and corruption of one/third of the nations housing facilities: Champion Homes with operations in both the United States and Canada, and The California State Housing and Urban Develop- ment Department in Sacramento. Although our three and one half year old MFG'D Home went on line 8 January 1999, completed in plant 16 January 1999, and shipped to Integrity Homes 21 January 1999, was passed and spposedly inspected prior to plant disbursement by the State Housing Department. The units undoubted leaked during their setting period on Integrity's sales lot for months, being that soon after occupying the home on 12 June 1999, there were visible water stains to walls and ceilings plus ripples to the ceilings, and the roof had ripples and bulges, which clearly indicated that the roof was poorly.planned, incorrectly constructed .in plant, and improper and substandard materials used in nonconform- ity to the Construction Industry Standards and the Uniform Building Codes. The home has been in constant settlement procedures since the move -in and has been jacked, up, releveled, and etc. seven times to date and in need of another. On 13 November 2002 we noticed a rather large stained area in our kitchen ceil- ing that was quite wet and spreading. Having a MFG'D Home Owners :Policy with State Farm Insurance Companies, I called our Broker's Office, who in turn called the claim's office in Chico. That afternoon Buildrite Construction came out and covered the roof with 6 mil plastic, punctured four hoes in the kitchen ceiling, setup a blower/dryer units and said to let them running for at least forty eight hours, then left without any mention of a starting work schedule for repairs. My wife, a former cancer and heart attack patient, was very anoid with the noise from the units and went over to our youngest daughters home for five days. Page three On 15 November 2002, Friday, both Brenda Avrit of State Farm "Adjuster" and William Jones of Buildrite Construction came out at 2:15 P.M. to view the damage after the:roof had been completely covered, loosened a small eave area of the plastic (punctured holes with toes of their shoes in the lower roof's counter flashing) renailed the furring strip and plastic. Brenda then told me that since she didn't see any evidence of broken composition shingle tabs or blown off shingles -,.,.that State Farm wasn't responsible for any roof repair damage, but said that State farm would take care of the interior water damage. I told her that State Farm is responsible being that the water penetrated the roof and entered onto the 3/8" particle board roof sheathing which was wet and sagging and rippled, and that the Kraft paper water membrane on top of the particle board and under the composition shingles was unworthy of its purpose and used in lieu of the Roofing Industry's Requirements being 15 # roofing gelt.,. and the cheapest quality of composition shingles fastened with staples that are backing out of the particle board with curling tabs. She indicated that because of a combination of inferior workmanship and materials, that the roof can only be considered as non-insureable, with no means of repair suggestions by either her or William. * The weekend of 16 & 17 November, with Thanksgiving around the corner, and some of our children and grand -children coming, I fixed all the interior damage myself. On 23 November at 3:45 A.M. the winds had broken the plastic loose and began flapping on the roof which woke me up; the same happened on the 24th November at 4:00 A.M. and when I went outside to view the damage, the plastic had been completely torn and hanging down from the eaves. I made the report to our Brokers office who informed the claims office, and who contacted William of Buildrite. William called me at 1:30 P.M. the 25th of November, and said he would have someone out that afternoon or the next day Tuesday the 26th. Well, needless to say nobody showed up either day, so on Wednesday the 27th at 8:30 A.M. I called the Buildrite office and was told that William had forgotten and would be gone for the rest of the Thanksgiving weekend but would return the following Monday after I spoke with him on the phone. On Wednesday the 27th Buildrite sent Scott Yarbrough and a helper out to retrieve all the damaged plastic and furring strips with double headed nails, but did so by yanking the plastic and strips off by hand (apparently pissed off) instead of backing the double head 8d nails with a hammer claw which is why souble heads as used. The quantity of the furring strips were not ample for the job and instead of acquiring more to complete the tie -downs to the fiberboard facia boards around the perimeter of the home, they used 3/8" arrow staples, a poor and outlandish means of securement. Ripping off the plastic and strips they also damaged the facia board and the front 8' X 30' decking materials with the 8d's gouging the 2 X 6 decking material that I had to completely repaint again after only two months of previous painting. The holes in the facia by the nails and staples had to be repluged and completely repaited also. Scott mentioned something about putting large tarps and sandbags on the roof and it ended there, and since we were constantly getting forecasts of possible rain, I purchased 4 five gallon cans of fiberized roof sealant, lugged them up the ladder myself (hernia and all) and sealed the entire roof area myself, since nobody offered a remedy or solution to the roof problem. It would be senseless to reroof over the 3/8" particle board since it doesn't have any stability or holding power. My wife and I are starting to push that 80 mark in our lives; this we don't need. Page four Due to past water problems and dampness to the structure which has caused health damages to both of us and forcing us into emergency at the hospital because of acquired repiratory problems, our personal general practitioner has continued asking, why we remain living in these conditions. We were forced into a mediation settlement process by our own legal council and the attorney's representing Integrity Homes and Champion Homes without our consent, and during the process was not permitted to become involved in the presence of those involved or giving the opportunity of self expression. Through the advisement of our attorney Daniel V. Blackstock, it was he who requested and directed us to accept and sign the release of all does from further suit or proscecution and declined to follow through on our request to have our case heard in Superior Court with a jury on hand. In years past, Blackstock was employed by"the Butte County District Attorney's Office and has now closed his office in Oroville. I called ten different roofers to come out to make estimates for damage repairs; none came out or responded. One Licensed General Building Contractor came out and after inspecting the roof,..,.he concluded that the entire roof structure be completely removed and properly start from scratch,.but left no estimated figure since this is not the proper time of year to remove the entire roof, interior furnishings, and relocate to other housing. Hopefully, this report will get to the crux of the matter for a resolution.
