I am the service manager for defendant Mobile Home Center, Inc. I have personal knowledge of the matters set forth herein and could competently testify thereto if called as a witness in this action, except as to those matters stated on information and belief, which matters I am informed and believe to be true. 2. In my position as service manager, part of my duties are to insure that employees of Mobile Home Center, Inc. ("MHC") under my control prepare a newly purchased modular home for delivery to the customer, after the modular home has been ` placed on the foundation. Under normal circumstances, this proceeds as follows. 3. After the customer has purchased the modular home from MHC; a subcontractor prepares the foundation to accept the particular modular home purchased. The foundation crew prepares the site and -builds the foundation upon I � 1 which the home will be placed. When the foundation is ready, the manufactured home 2 is delivered by a subcontractor, which we refer to as the "transporter." After the 3 modular home has been delivered to the site, a third subcontractor, known as the "set-up 4 crew," moves the modular home from the vehicles on which it was transported and 5 places the modular home on the foundation. The set-up crew is also responsible for 6 adjustments of the structure, mating the units together (in case of multiple units), and 7 insuring that the unit is prepared to accept electrical power, sewer, water and all other connections. 8 4. After the unit has been placed upon the foundation, and the set-up crew 9 has completed their work, it is my responsibility as manager of the service department 10 to have my employees make a personal inspection of the mobile home. We make a 11 detailed punch list of any final corrections or adjustment which need to be made before 12 the unit is ready to turn over to the purchaser. In this inspection, we virtually check 13 every item in the modular home, including the power service, the functioning of the 14 appliances, the sewer connections, the door closings, the fittings of all fixtures, the 15 condition of any floor coverings, any paint scratches or chips or other items which need 16 to be adjusted. It is our goal to make the unit "perfect" before it is released to the 17 customer. 18 5. During this inspection, our servicemen complete any repairs, clean-up or 19 adjustments which are within their capabilities to do at the time. Those items which are 20 not within our capability to correct on the spot, are noted, for later repair. Our 21 inspectors prepare a form describing each and every discrepancy on the home, whether 22 it is repaired or not. This form is known as our "warranty service work order," or "work 23 order." The items which we correct, are noted on the work order as corrected. Other 24 discrepancies are noted, but no correction indicated. 25 6. After this initial inspection, as service manager I send a copy of the 26 warranty service work order by facsimile copier to the MHC manager who sold the unit. It is the manager's responsibility then to see that the remaining items are corrected by Decl. Craig Farris, Beach v. MHC Butte Cuty. Super. Ct. # 115771 - 2 - 1 subcontractors, the manufacturer, or other employees of MHC. 2 7. In the case of the Beach modular home, at No. 14 Aqua Court, in Kelly 3 Ridge Estates, in Oroville, the unit was installed on it's foundation and released to my 4 service department for inspection on September 14, 1992, according to our records. We 5 performed our initial inspection the same day, September 14, 1992. Although my inspector noted a number of items which needed correction, none of these items 6 7 rendered the unit not habitable, and none of them involved any structural defects or 8 safety hazards. A copy of our warranty service work order from September 14,1992, is attached to this declaration as Exhibit "A" and incorporated herein by this reference. 9 8. On September 29, 1992, I sent a copy of our warranty service work order 10 (Exhibit "A") to Paul W. Farris, president of MHC, and acting manager of the Marysville 11 sales office, which handled the sale to plaintiff Beach. Mr. Paul Farris then had 12 subcontractors complete the remaining repairs shown on Exhibit "A", which were not 13 within the capabilities of our service department to complete. 14 9. After our service work was complete, the Butte County Department of 15 Public Works performed its final inspection on September 23, 1992, and issued its 16 certificate of occupancy on the same date. A true copy of the Department of Public 17 Works job card showing the date of the final inspection is attached hereto as Exhibit B 18 and incorporated herein by this reference. A true copy of the Certificate of Occupancy is 19 attached hereto as Exhibit C and incorporated herein by this reference. 20 10. In January 1993, I was requested to make a thorough inspection of the 21 Beach home, and to insure that each and every discrepancy, no matter how small, was 22 corrected. As I recall, I was informed that Mr. Beach was refusing to close escrow on 23 schedule, claiming that there were unspecified defects in the home. I was asked to make 24 sure that there was absolutely nothing wrong with the home. 25 11. I personally took a work crew from my service department, a total of three 26 men, to the Beach home on January 23, 1993. I performed an extremely thorough and detailed examination of every nook and cranny of the Beach home, and noted every Deel. Craig Farris, Beach v. MHC Butte Cuty. Super. Our crew immediately started working on each of the .items which I had noted. Our crew continued to work on the Beach home for the next 5 days, until each and every item which I had noted was fully and properly corrected. A copy of our final check -list and notes of corrections is attached hereto as Exhibit D and incorporated herein by this reference. At the time of the completion of our work on February 1, 1993,.the Beach home was as perfect as it was humanly possible to make it. Its final condition far exceeded that of the typical, brand new modular home. 12. Our attorney has advised me that Mr. Beach has made a declaration under penalty of perjury that "representatives of MHC entered the residence and removed oak cabinets that were included in the manufactured home and cut a hole in the floor." At no time did any representative of MHC remove any oak cabinets, or replace any oak cabinets whatsoever in the Beach modular home. The oak cabinets which are presently in the Beach modular home are exactly the same cabinets which Mr. Beach saw when he first inspected the home on the sales lot of MHC in Marysville, California. There have been absolutely no changes to these cabinets. In addition, no representative of MHC ever cut a hole in the floor of Mr. Beach's home. At no time when I .was in Mr. Beach's modular home did I ever observe a hole cut in the floor. 13. To insure that my information concerning the oak cabinets and the hole in the floor is correct, I personally contacted each member of my service department, and determined that no member of my service department has any information whatsoever concerning any work on any of the oak cabinets in Mr. Beach's home at any time, nor any hole in the floor. I have personally inspected the cabinets as indicated. These are precisely the same cabinets which were in the home while it was on display in the Marysville sales lot, where it was initially seen by Mr. Beach. I have no idea why Mr. Beach would make a statement such as he has made, or what reason he would have to claim that representatives of MHC did such a foolish and wasteful thing.
