This letter is being sent to you because the records at Lake Oroville Area Public Utility
District indicate that you are the owner of a parcel of land within Unit 7 of Kelly Ridge
Estates.
At the time Unit 7 was created, the developer installed the sanitary sewer line and then
granted easements to the District for operation and maintenance of that sewer facility.
Included within the easement is the right to maintain the overlying area of the easement to
ensure that there is not an unreasonable interference with the District's operations. This
permits the District to clear and remove any brush and/or trees growing within the easements.
The District is also permitted to restrict the construction of any permanent facilities within the
easement as well as to restrict the grading and/or importation of fill over the easement which
would substantially increase the overburden on the sewer line.
While the District can usually authorize sewer connection permits routinely as part of the
County building permit process, the location of the sewer lines within Unit 7 dictates that the
District ensure the owner that any improvements on a lot will not encroach upon the District's
easement in such a manner where the District cannot reasonably operate and maintain the
easement. Therefore, the District will be requiring a site plan or design to be submitted by
the owner/builder as the approved site plan for the area which will confirm no encroachment

This will confirm your recent conversation with our attorney Jeff Meith. As he
mentioned, Lake Oroville Area Public Utility District has had a problem in connection
with Unit 7 of Kelly Ridge Estates which will require more detailed procedures for the
approval of sewer permits.
In Unit 7, the sanitary sewer easement, because of the slope of the land, is in
some cases located within the lots and in a few cases virtually over the center of the
parcels. The District already had one problem with respect to lot 11 which, hopefully,
will be rectified with steps taken by the landowner to raise the sewer line and deposit
funds to ensure its protection in the future. On the majority of lots that option is not
available.
Therefore, the District Board of Directors has suggested that we notify
landowners in Unit 7, as well as the County, that a sewer .connection permit will be
withheld until a satisfactory site plan has been presented to the District which can
confirm that there will be no encroachments located on the District's easement.
We think it might be a good idea for your personnel, at the time they are
receiving applications for building permits in the area, to notify applicants that, in
addition to the routine requirements to get approval from the District, a site plan review
at the District may be required. This should apply to all remaining lots in Kelly Ridge
Estates not just Unit 7.
