In my communications with Mr. Glander• this past June, I had made clear my intention to workup a set of drawings for him and apply for the permits:, I must apologize for procrastinating so long, but my wife had a baby this fall and I simply let things slip by. The basic shell of the house was completed in 1971-72 without a permit, but we have been paying property taxes`on the building since construction began, so -the county has been aware of the home all this time. This is our "country" home -- a place we go to for weekend and vacation fun. I haven't been in any rush to finish it because we don't live in it full.. time. However, I am sensitive to the feelings of my neighbors, several of whom do live there full time; and so I completed the exterior of the building in as timely a fashion as I could so it wouldn't have a look of unfinished construction. P. #71-18-56 Dear Mr. Kirkpatrick: It has been brought to our attention by Mr. Jim Glander, Chief Building Inspector for the Butte County Public Works Department, that you have constructed a two story building (garage under living area) and the carport for which you renewed the permit has not been completed on the property you own off Lumpkin Road above Oroville without obtaining the required permits and inspections. Section 26-1 of the Butte County Code states that the County has adopted the 1979 Edition of the Uniform Building Code. The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from.the County Building Department. Section 26-6 of the Butte County Code' states that: "It shall be unlawful for any person, firm, or corporation to erect, construct, alter,.repair, move, remove, improve, convert, demolish or equip any building or structure in the unicorporated areas of the County or to cause the same to be done contrary to or in violation of any of the provisions of this chapter. "The use or occupancy of any building in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in a manner provided by law." Mr. Corwin Kirkpatrick January 7, 1987 Page 2 Section 1-7 of the Butte County Code provides that any violation of any provision of the Code constitutes a misdemeanor, or in the discretion of the District Attorney, be charged as an infraction. The penalty for a misdemeanor is punishment by a fine not exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to exceed the sum of $500.00. Therefore, you are to cease occupying the two story building (garage under living area) located off Lumpkin Road in the Oroville area, until you have obtained the proper permits, inspections and approvals from the Butte County Department of Public Works. I built most of the building in 1971 and 1972 and have just been working on it when I have some time and money. It has been easy to work on it this way because I haven't been under any pressure to complete it within a certain time. Some day -we hope to retire up there. For the last two years we have had a big expense of legal fees because new land owners above us (Mr. & Mrs. Norman Baker) are suing us for trespassing. They are trying to stop us from coming in on the road we have always used. Hopefully this matter will be settled this year and stop this unnecessary expense. I will try to get started with some drawings on the house and apply for a permit. We have been paying property taxes on both the property and buildings since they were built, so the county has been aware of their existence for a long time.
