In addition, your plans are routed to other regulatory entities including but not limited to Planning, Public Works, Environmental Health, and the California Department of Forestry for their clearances and approvals. There are some things you can do to expedite your permit: 0 Make sure your application is complete. 0 Be responsive to requests from County departments for any additional materials or requirements. The Building Division places its highest priority on processing building permits as quickly as possible and each day that passes without a complete application adds to processing time. Every permit issued by the Building Official shall expire and become null and void if the work authorized by such permit is not started or completed within one year from the date of issuance of such permit. A permit may be renewed (for a fee) prior to expiration an indefinite number of times, provided construction progress has been documented by the Building Division during each year during scheduled inspections. No changes may be made in the original plans and specifications for such work. In order to reinstate action on a permit after expiration, the permittee shall pay a new full permit fee and additional plan checking and documentation may be required. Upon completion of work covered by this permit, please contact this office for final inspection. As a reminder to you, it is illegal to occupy this building or any portion of the building for which this permit is issued without a final inspection. EXPIRATION OF PERMIT APPLICATION AND REFUND POLICY Application for which a permit has not been issued will expire one year after date of application. Refunds may only be made upon written request by the person who originally paid the fees. Refunds for permit applications (not yet issued) must be requested within two years from the date of fee payment. Fees paid at the time of application are for Plan Check and administration. The Plan Check portion of fees is refundable only if the permit is cancelled or withdrawn before any plan checking is done. Building Division costs will be deducted prior to authorizing a refund and a charge of $54.99 to process the refund application will be assessed. Nichols has asked me to respond to your letter concerning the results of the Department of Water Resources' research regarding the use of Craig Access Road at Lake Oroville in Butte County. In 1961, the Davis-Dolwig Act was passed by the State Legislature as the primary statement of State policy concerning recreation and fish and wildlife enhancement at State -constructed water facilities. The Act sets fundamental policies and establishes the responsibilities of the State departments that participate in the program. Three State departments are assigned specific responsibilities under the Act. DWR is responsible for planning recreation and fish and wildlife enhancement and for preservation measures related to State -constructed water projects. DWR is also responsible for acquiring any needed lands. The Department of Parks and Recreation has authority to design, construct, operate, and maintain actual recreation features at these sites. The Department of Fish and Game is responsible for managing the fish and wildlife resources at -State Water Project facilities. In accordance with the Davis-Dolwig Act, DWR acquired the Craig Recreation Area and access road (known as Craig Access Road). DWR bought Craig Road right of way by purchasing a 60 -foot -wide parcel (strip) of land through Section 31, (N %2 Sec. 31, T. 20 R: 6 E. M.D.B.&M.), Section 36, (N'/2 Sec. 36, T. 20 N, R. 5 E. M.D.B.&M.) and Section 35 (S'/2 of the NE.'% and S'/z of the N'/2 of the NE % of Sec. 35, T. 20 N. R. 5 E. M.D.B.&M.) for access to DPR's Craig Recreation Area in Sections 35, 26, 27 and 34. For reference, Craig Access Road is the maintenance road to Craig Recreation Area (beginning west. of Union Bar Road, Section 35) (see map, Attachment "A"). The Craig Recreation Area is strictly a boat -in campground with no public overland access. For landowners in Sections 36, 25 and 26, a deeded easement agreement for ingress and egress to their property was made between DWR and 23 adjoining parcel owners and recorded in the Butte County official records on September 19, 1966 (see attached map). Although these landowners have legal access to their parcel(s), many asked for a letter or permit to use Craig Access Road, and were so issued one from DWR. M�1 s. Tiffany J. Carlson Pag � 9 2001 The right of way was purchased to provide access for maintenance activities at the site and is adequate for this purpose. DWR does not believe that improving the Craig Access Road is a recreational issue nor does it believe it is a Federal Energy Regulatory Commission compliance issue. The beginning of Craig Access Road is the centerline of Lumpkin Road (county paved road) Section 31, referenced in DWR records as ORO -414, purchased by Grant Deed recorded July 22, 1968, in Butte County official records. The legal description in the grant deed for Parcel ORO -414 includes "all rights, title and iihterest to all roads lying within the above described parcel of land." Therefore, DWR purchased any road or road access rights in ORO -414, which may have existed for the benefit of parcel owners in this section. Although Craig Access Road was never a public road, even before purchase, DWR has not restricted use of this right of way. The land -locked status of any property was neither the intent nor result of DWR's purchase of the parcels, which comprise what is known as Craig Access Road. For landowners without a deeded easement to their parcel(s), a letter of permission for egress and ingress was given to them and their successors (upon request) from DWR. The permission is revocable and does not grant an interest in real property. DWR has no legal obligation to grant legal public access. DWR bought an additional 118.68 acres of land (ORO -675) adjacent to Craig Recreation Area (Section 26) on July 17,1978 and sold it to Mike Whittinger on September 21,1989. Included in this transaction was the vested easement agreement for ingress and egress using Craig Access Road, pursuant to the easement agreement of the 23 parties, recorded on September 19, 1966, Butte County. Office of Records in Book No. 1474, pages 17 through 25. The easement agreement allows access via the easterly portion of the Craig Access Road and a 60 -foot -wide dirt road (Union Bar Road Section 25 and 36) as described in the September 19,1966 easement agreement (see map, Attachment "A"). In a response to a May 3, 1990 leiter from Mr. Whittinger, which requested the State allow him to use the existing Craig Recreation Area Road for ingress and egress to his property (Section 26, via section 35), DWR made it clear that Mr. Whittinger already had deeded access easement rights from his property to Craig Access road (via Section 26 Union Bar Road). Permission was granted to Mr. Whittinger and his successors (see Attachment "B") to use the Craig Recreation Area Road (Section 35, west of Craig Access Road to his property on Section 26) on the condition that maintenance of the road would not be the responsibility of the State and the State would have no obligation to improve the road. By accepting the rights provided by this letter, Ms. JUN inj4 rlson Page 3 he and his successors agreed to indemnify and hold harmless the State and DWR from any claims for death, personal injury, or property damage arising out of the exercise of those rights. This letter of permission was Issued on June 8, 1990 (see Attachment "C"). By letter dated March 10,1993 from Frank Conti (Attachment "D"), Mr. Whittinger's permission for the use of Craig Recreation Area Road (west end, Section 35) was revoked by DWR due to his filing with Butte County for a tract map and obtaining a certification (from Butte County) of said tract map and eventual subdivision of his property in Section 26, (ORO -675). Using Craig Recreation Area Road (Section 35) as access for subdivision indicated that Mr. Whittinger intends to "assign" access rights that are assigned to him, pursuant to the June 8, 1990 letter, which he does not legally have the right to do. On the same day, a letter was also sent to Mr. William Cheff, Director of Butte County Department of Public Works by Mr. Conti (Attachment "E"), who then rescinded the certification permit for the subdivision tract. Unfortunately, for the few landowners who wish to divide/develop their land for public resale, and for those landowners who want to minimize traffic and maintain the area's secluded atmosphere, the issue of ownership of Craig Access Road continues. DWR has attempted, by letter dated.September 9, 1999 from Viju Patel for Stephen L. Kashiwada, DWR Deputy Director, to Mr. Dennis Driver, Oroville Recreation Advisory Committee, to work with Butte County and local developers on a cooperative plan to both improve the first 800 feet of Craig Access Road from Lumpkin Road and continue to issue right of way access to individuals as requested by Butte County. Some developers feel that an assessment district is needed between landowners for the improvement of Craig Access Road to Butte County standards and then transfer of right of way from DWR to Butte County. DWR has previously offered and is willing to transfer ownership of Craig Access Road to Butte County in its current condition because Butte County is the logical owner. As stated earlier, in its current condition, the road is adequate for its intended purpose to DWR. In summary, DWR owns fee title to Craig Access Road from Lumpkin Road to the Craig Recreation Area and will continue to use it as access to Craig Recreation Area, primarily for the benefit of DPR. Upon request, DWR will continue to issue a conditional form of individual documentation to owners for access to parcel(s) using Craig Access Road. For DWR to improve the road to county road standards prior to transfer to Butte County could be construed as a "gift of State funds," which is not MJUN�O�arlson Page 4 permissible by State law. DWR maintains its willingness to convey (transfer) ownership of Craig'Access Road in deed to Butte County (retaining easement for DWR/DPR) in its current condition.
