I took them over to Land Development to read them and determine what they were describing. What they relayed to me is that they have a creation deed for parcel 071-290-061, wh4ch grants access to Craig Access Road. However, the main issue is with Craig Access Road, as it's o ider d a private road from Public Works, since I believe that it's owned by Recreation Department -not sure exactly what agency. Therefore, the deeds would need to also describe access through Craig Access Road to a publicly maintained road, such as Lumpkin. The deed for 071-290-042 was not clearly seperated in the documents that were provided, they thought. that possibly the deed for the neighboring parcel, 071-290-043 may provide for the creation of 042. The reason is that the original deed (1729-123) created a parcel of 071-29-044, 043, 042, and 061 with a total of 16.14 acres. Then, it appears that 061 was created (1734-256), then it was deeded again (2780-365) and then the first mention of 042 was when it was deeded to you in 1983. Therefore, as I mentioned above, it may be that they deeded off 043, which would of created 042 and 044 as an exception. The Land Development Division has determined that both of these parcels will need a Certificated of Compliance (COC), also called a Legal Lot Determination, because of the Craig Access Road issues. The fee for one parcel is $2,403. If you decide that you want to pursue any type of development permits, a COC must be obtained. If any of this is unclear, you can talk to Land Development about the deed references, since they are the ones that understand these deeds. However, the Planning Department is the one that processes the COC applications, so please let us know if you have any questions about the that process. We will go ahead and mail the '72 deed to you: When we bought the property over 20 years ago we thought we had 2 parcels. The title company gave us no information in writing to indicate otherwise. The assessor map shows 2 parcels, we have been paying two tax bills, we have a property description on our deed describing the 2 parcels...... but have not been able to locate any survey map that shows the split. I understand this property is illegally split as per the county, but I'd like to know how this happened. It seems that the previous owner (Haver) initiated the split in 1972, got the assessor to generate the maps and got the separate property descriptions recorded. Shouldn't the application have gone to the planning dept first? It appears the split was nixed at some point. Can you explain? As we talked about yesterday, you only have to do a Legal Lot Determination if there is a problem with the creation deed and I would like the surveyors to read it. I want to make sure that you have a good creation deed in the County's eyes. If, for some reason, there is an issue with the 1972 deed, we can address it after we look at the deed. I'm not sure if we discussed it yesterday, but there is a cost associated with a Legal Lot Determination, which is $2,403 and is due when the application is received. Therefore, I'm sure that you would want us to look at the deed before you proceed with this application to make sure it's truly needed. Please fax a copy of the deed, if possible, to 538-7785, or you can mail it to #7 County Center Drive, Oroville, CA 95965 or bring it in (if you are local) and we can have Land Development take a look at it. It's the first step we need to take in the process. I'm not sure if we discussed it yesterday, but there is a cost associated with a Legal Lot Determination, which is $2,403 and is due when the application is received. Therefore, I'm sure that you would want us to look at the deed before you proceed with this application to make sure it's truly needed.
