First, and as to the March 21, 2001 hearing at 9:00 am at the Oroville branch of Butte County Superior Court (Limited Case Division), we are asking that the hearing be continued to April 25. 2001 or May 2, 2001 or May 9, 2001 since we have just been retained. Also, the additional time will give all of us an opportunity to consider the below resolutions. As a matter of routine Professional courtesy, we trust there is no objection to the continuance. Please advise by the end of this week as to the continuance. As to the substantive matters, and while we understand that Mr. Polley has been cited for alleged permit violations, use and occupancy, and failures to comply, the heart of the issue seems to be a denial of the permit (after payment of fees and submission of application for the permit) due to an alleged lack of a right of way/easement Mar -13-01 11:49A LAW OFFICES 530 345 3008 p.O2 =,. After some initial investigations we found that the Hypes home (uses same access road as Mr. Polley) and the Helm home (adjacent to Mr. Polley's home and also uses same access road as Mr. Polley) uses the same access road (Indian Cemetery Rd) for their home, however, the Hypes and Helms were not denied a permit to build in the manner that Mr. Polley was denied his permit. In fact, in reviewing the Polley and Helms deeds, they are identical in their description of the easements for access, however, for a reason we do not yet understand. Butte County has refused to give Mr. Polley a permit but has given the Helms a permit. The key question seems to be why Mr. Polley appears to be being treated differently under the law than the Helms (or other similarly situated). We are not claiming any kind of intentional conduct at this time toward Mr. Polley by Butte County, but it seems only right to give Mr. Polley, a taxpayer of Butte County, an explanation as to why his permit was denied when those in identical situations (Helms and Hypes) were given permits to build their homes. In closing, and while we will be happy to consider any authority to the contrary, it would seem that the enforcement has been arbitrary, and but for the arbitrary enforcement, our client would have had his permit and we would not be here.
