OWNER -BUILDER INFORMATION
An application for a building permit has been submitted in your name listing yourself as the builder of the property improvements specified.
For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a permit. Building permits are not required to be signed
by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from
possible liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by
law to put their license number on all permits for which they apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should be aware of the following information for your benefit and
protection:
° If you employ or otherwise engage any persons other than your immediate family, and the work (including materials and other costs) is $500 or more for the entire
project and such persons are not licensed as contractors or subcontractors, then you may be an employer.
n If you are an employer, you must register with the state and federal government as an employer and you are subject to several obligations including state and federal
n income tax withholding, federal social security taxes, workers/ compensation insurance, disability insurance costs, and unemployment compensation contributions.
There may be financial risks to you if you do not carry out these obligations, and these risks are especially serious with respect to workers' compensation insurance.
° For more specific information about your obligations under federal law, contact the Internal Revenue Service (and, if you wish, the U.S. Small business
Administration). For more specific information about your obligations under state law, contact the Department of Benefit Payments and the Division of Industrial
Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perforin their work personally or through thier own employees,
without a license contractor or subcontractor, only under limited conditions.
A frequent practice of unlicensed persons professing to be contractor is to secure an "owner -builder" building permit, erroneously implying that the property owner is
providing his or her own labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work
personally.
Information about licensed contractors may be obtained by contacting the Contractors' State License Board's automated telephone information system at 1-800-321
-CLSB (2752) or by accessing thier website at www.CSLB.ca.gov.

ORDINANCE ADDING CHAPTER 28A
TO THE BUTTE COUNTY CODE
RELATIVE TO SINGLE FAMILY DWELLINGS
THE BOARD OF SUPERVISORS OF THE.COUNTY OF BUTTE.DO
ORDAIN AS FOLLOWS:
Section 1. That -Chapter 28A of the Butte County Code
(shall be added to read as follows:
Section 28A-1 PURPOSE The purpose of these regulations
-is to provide -minimum -requirements for single family dwellings in
rural unincorporated areas of low population density, to protect the
environment and public health and safety, while allowing for greater
flexibility of design and materials.than required by the Uniform
Building Code and to define the applicable zones. It applies to the
construction, modification and occupancy of new, single family,
owner -built dwellings not over two stories in height.
Section 28A-1.5 TIME This chapter shall be effective for
a period of two years at which time it shall terminate unless
extended by subsequent ordinance.
Section 28A-2 DESIGNATED AREA These regulations shall
be applicable only in an area as shown on a map which is located in
the office of the Clerk -of the Board and at the Public Works f.
Department.
Section 28A-3 OWNER -BUILDER Owner -builder is a person or
family who acts as the general contractor. for, or as the provider of,
part or -all of the labor -necessary to build housing to be occupied
as the principal residence of that person or family, which housing is
not intended for sale, lease, rent or employee occupancy. '

'Section'HA-4 _SANITATION Each dwelling shall have a
septic tank and drainage field or equal, according to Butte County
Code Chapter 19, for waste and grey water.
Potable water shall be on the site suitable for
drinking, cooking, washing, bathing, flushing and fire (25 gal. per
day per person min. supply -and 200 gal. min. storage), unless a
continuous supply is available.
Bathing, washing and toilet facilities shall be on the
site. The t -o i let -s -hal -1 be in a- separate room with a door. The same
room may contain washing and bathing facilities.
Section 28A-5 FOUNDATION AND STRUCTURE In general, sound
construction practices and good workmanship shall be followed for all
elements such as footings, beam sizes, lateral supports, anchoring
means, weather protection, sealing, ventilation, egress for fire, etc.
Any obvious hazard noted by the owner or the inspector shall be
corrected.
Concrete slab, pier foundations, treated pilings, steel
poles or any equivalent materials may be used provided.that the bearing
is sufficient for -the load. A raised floor shall have access and
ventilation and if the floor level exceeds 2 ft., there shall be
lateral bracing. Foundations shall have proper drainage. The Lform
Building Code may be used as reference.
Section 28A-6 MECHANICAL Fireplaces and heating and cooking
appliances, if provided shall be installed and vented in accordance
with the requirements of the latest edition of the Uniform Mechanical
Code and Chapter 37 of the Uniform Building code, except that an

I Section 28A-12 APPEALS An appeal of the application of
2 any rule or regulation contained herein shall be first heard by the
3 Chief Building Inspector. If the owner -builder is not satisfied
4 with the decision of the Chief Building Inspector, the owner -builder
5 may appeal to an -appeal board established by resolution of the Board
6 of Supervisors. If the owner -builder is not satisfied with the
7 decision of the appeal board, the owner -builder may request review by
g a third party independent arbitrator chosen by both parties.. If the
9 parties cannot agree on an arbitrator, the Supervisor in whose
10 district the project is located shall choose one.
11 The decision of the arbitrator is final except for such
12 action as may be taken by a court as permitted 'or required by law.
13 Section 28A-13 VIOLATIONS AND PENALTIES
14 (a) Any violation of the provisions of this chapter
15' shall be punished by a fine not exceeding $500.
16 (b) Every day any violation of this chapter shall
17 continue, shall constitute a separate offense.
1� (c) The use or occupancy of any building in violation
1q of the provisions of this chapter is hereby declared to be a public
2p nuisance and may be abated in the manner provided by law.
21 (d) All -structures or portions thereof which coLtitute
22 a substandard building shall be declared to be a public nuisance and
°3 shall be abated by repair, rehabilitation, or removal in accordance
2:1 with Health and Safety Code Sections 17980 through 17995.

dwelling, the property line, other structures,
sanitation and bathing facilities, water resources
and water ways.
Permits will be valid for three years and may be obtained
by mail.
Section 28A-9 TEMPORARY OCCUPANCY Temporary occupancy of an
uncompleted structure shall be permitted for the life of the permit,
provided that' app-ra:ved_'.s.anlzary _facilities are available at the site an
that the work completed does not create any condition that endangers
life; health or safety of the public or occupants. The owner shall
assume full responsibility for the .occupancy and the structure.
Section 28A-10 FEES Fee for the permit shall be established
by the Board of Supervisors by resolution.
Section 28A-11 INSPECTION Sanitary and other elements which
are required to be built to the Uniform Building Code shall be inspecte
according to applicable codes. Additional inspections may be required
by the County, but at least one shall be made on the sewage system
before backfill, before covering the•interior walls and before
occupancy. The Building Department shall be responsible for all
inspections and inspection trips shall be combined when practiAl. The
builder should leave construction open to minimize inspection trips.
One or more inspections may be waived by the County if
the owner -builder stipulates in writing that the work has been
.conduct -ed in compliance with the permit application and the provisions
of this code.
The owner shall record a NOTICE OF CONSTURCTION as
furnished by the -County before occupancy.

-alternate method of -venting shall be allowed if .substantially
equivalent in safety. If a fuel consuming heating appliance is
installed, the outside walls, floor and ceilings shall have current
County Code required insulation.
Section 28A-7 ELECTRICAL Electrification and wiring shall
not be required, and where electrical usage is confined to one room of
a structure, the remainder of the structure need not be wired. However,
where electrical wiring or appliances are provided, they shall be
installed in accordance with the National Electrical Code. Interior
insulated wire can be exposed where not subject to abrasion. Circuits
of 20 -amps or less may include plugs, lights or other outlets and are
not confined to any one room or area including kitchens.
Section 28A-8 PERMITS A permit shall be required before
construction. Additions and changes after the original construction
on those"elements.that conform to the California State Uniform Building
Code shall also require a permit or an inspection. The building
official shall grant a perriit for the construction of a dwelling or
,appurtenant structure where the permit application shows construction
methods that do not violate the requirements of these regulations.
No permit shall be required for small or unimportant work or alteration
or repair which does not endanger health or safety. Permit applications

(2) Address and location of the proposed structure(s);
(3) A basic description of the structure(s), including
a floor plan that shows proposed plumbing and electrical,
including type of heater and/or stove installation; with
