That -Chapter 28A of the Butte County Code (shall be added to read as follows: Section 28A-1 PURPOSE The purpose of these regulations -is to provide -minimum -requirements for single family dwellings in rural unincorporated areas of low population density, to protect the environment and public health and safety, while allowing for greater flexibility of design and materials.than required by the Uniform Building Code and to define the applicable zones. It applies to the construction, modification and occupancy of new, single family, owner -built dwellings not over two stories in height. Section 28A-1.5 TIME This chapter shall be effective for a period of two years at which time it shall terminate unless extended by subsequent ordinance. Section 28A-2 DESIGNATED AREA These regulations shall be applicable only in an area as shown on a map which is located in the office of the Clerk -of the Board and at the Public Works f. Department. Section 28A-3 OWNER -BUILDER Owner -builder is a person or family who acts as the general contractor. for, or as the provider of, part or -all of the labor -necessary to build housing to be occupied as the principal residence of that person or family, which housing is not intended for sale, lease, rent or employee occupancy. Potable water shall be on the site suitable for drinking, cooking, washing, bathing, flushing and fire (25 gal. per day per person min. supply -and 200 gal. min. storage), unless a continuous supply is available. Bathing, washing and toilet facilities shall be on the site. The t -o i let -s -hal -1 be in a- separate room with a door. The same room may contain washing and bathing facilities. Section 28A-5 FOUNDATION AND STRUCTURE In general, sound construction practices and good workmanship shall be followed for all elements such as footings, beam sizes, lateral supports, anchoring means, weather protection, sealing, ventilation, egress for fire, etc. Any obvious hazard noted by the owner or the inspector shall be corrected. Concrete slab, pier foundations, treated pilings, steel poles or any equivalent materials may be used provided.that the bearing is sufficient for -the load. A raised floor shall have access and ventilation and if the floor level exceeds 2 ft., there shall be lateral bracing. Foundations shall have proper drainage. The Lform Building Code may be used as reference. Section 28A-6 MECHANICAL Fireplaces and heating and cooking appliances, if provided shall be installed and vented in accordance with the requirements of the latest edition of the Uniform Mechanical Code and Chapter 37 of the Uniform Building code, except that an II///// -2- I Section 28A-12 APPEALS An appeal of the application of 2 any rule or regulation contained herein shall be first heard by the 3 Chief Building Inspector. Section 28A-9 TEMPORARY OCCUPANCY Temporary occupancy of an uncompleted structure shall be permitted for the life of the permit, provided that' app-ra:ved_'.s.anlzary _facilities are available at the site an that the work completed does not create any condition that endangers life; health or safety of the public or occupants. The owner shall assume full responsibility for the .occupancy and the structure. Section 28A-10 FEES Fee for the permit shall be established by the Board of Supervisors by resolution. Section 28A-11 INSPECTION Sanitary and other elements which are required to be built to the Uniform Building Code shall be inspecte according to applicable codes. Additional inspections may be required by the County, but at least one shall be made on the sewage system before backfill, before covering the•interior walls and before occupancy. The Building Department shall be responsible for all inspections and inspection trips shall be combined when practiAl. The builder should leave construction open to minimize inspection trips. One or more inspections may be waived by the County if the owner -builder stipulates in writing that the work has been .conduct -ed in compliance with the permit application and the provisions of this code. The owner shall record a NOTICE OF CONSTURCTION as furnished by the -County before occupancy. However, where electrical wiring or appliances are provided, they shall be installed in accordance with the National Electrical Code. Interior insulated wire can be exposed where not subject to abrasion. Circuits of 20 -amps or less may include plugs, lights or other outlets and are not confined to any one room or area including kitchens. Section 28A-8 PERMITS A permit shall be required before construction. Additions and changes after the original construction on those"elements.that conform to the California State Uniform Building Code shall also require a permit or an inspection. The building official shall grant a perriit for the construction of a dwelling or ,appurtenant structure where the permit application shows construction methods that do not violate the requirements of these regulations. No permit shall be required for small or unimportant work or alteration or repair which does not endanger health or safety.
