Construction of a log house without approvals or permits as per the Butte County Code, Chapter 26-1,
Section 301(a) Uniform Building Code Permits Required.
Upon all work to abate the violation being completed and approved by the affected department,
payment of all fines imposed as to said violation and payment of a fee of $300.00, a Notice of
Compliance shall be submitted to the Recorder of Butte County for recordation pursuant to Butte
County Code Sec. -41-9.
Obtain all approvals and all required permits from the Butte County Department of Development
Services, Building Division, Planning Division and the Environmental Health Department for the
construction of -a log house.
Pursuant to Butte County Code Sec. 41-10, no county permits, licenses or other entitlements shall
be issued when there is an outstanding code violation involving the premises to which the application
therefore pertains, unless all required work to abate the violation has been completed and approved
by the affected artment or a waiver is obtained from the director of the affected department.

Dear Mr. Vierra,
We have decided to purchase a modular home instead of trying to bring our existing home
up to code. After considering the cost and impossible living situations during the long
process of rebuilding, the modular home seems to be our only option.
We will be purchasing a demolition permit for the largest portion of the house and be
applying for an agricultural permit for the remaining log structure. We will be using
structure for a place to store our hay, feed and horse supplies.
There is a considerable down payment needed for the modular home .($10,300), plus we
will need to place a new septic and electrical on our property. This is an incredible
expense for a family of five.
We will write another letter before our next court date in May and let you know our
progress and the estimated time of completion.

Dear Sirs,
Ater much deliberation and research, we have decided how we will correct our status of code
violations. We have contacted and applied for numerous home loans, to no avail. We have also
consulted various engineers who have supplied us with approximate costs to engineer our log
home, and the cost of rebuilding. With this information, we have concluded that it is in our best
interest to dismantle our log home and rebuild with conventional lumber. Our hope that we will be
able to start this process in the spring of 1997.
We are supplying you with our preliminary plans for your records. It is our intention to comply
with Butte Countys' building codes. It has been very difficult for us to not only decide to tear
down our home, but to find a lender who is willing to finance us to accomplish this expensive and
difficult feat.
We appreciate your patience and understanding.

residence at 327 Simpson Ranch Road, Berry Creek (APN 7143-35).

RE: Building Permit Application for Underhill Residence
SUBJ: Agreement for structural engineering, drafting and design services.
Dear Chris and Clint,
Chris and I agreed last evening that I should begin the process to obtain a building permit for your
residence. Clint and Chris indicated in a meeting last Friday that Chris would be handling this matter.
Would you please sign below indicating agreement with the content of this letter and return one copy of this
letter to me?
My fees will be billed at $50.00 per hour, not to exceed $3500, for the approval of the structural plans and
calculations as part of the permit approval process. I will bill you by the month. If, during the process of
my work, you decide that the alterations to your residence appear to be too expensive, then you may
instruct me to stop my work. You agree to pay my fees incurred to the time of your instruction to stop
work. I agree to do the work in such a manner as to minimize my fees, while making a true assessment of
the alterations required.
I enclose my notes of the meeting with Mike Viera wherein he suggests that we execute an agreement and
that I write a letter to him. Mike Viera will forward a copy of this agreement to the Code Enforcement
Officer. Mike suggests that you- contact the Code Enforcement Officer after the Officer recieves a copy of
this letter and before the court date of August 9th so that you might avoid an appearance in court. When
you agree with the Code Enforcement Officer and/or the Municipal Court on a time frame for submittal of
plans and calculations and payment of fees, we can measure and draw the building.
We also agree that Chris will be responsible for obtaining permits and scheduling other contractors. Mike
Evans and I can advise and assist you with the approval process.
Other expense items for you, relative to the permit process, will be permit fees required by Butte County
and fees for inspections of the electrical, mechanical and plumbing systems of your residence. You will also

SUBJ: Meeting with Mike Viera, Butte County Building Inspection, July 25, 2995, 1:OOPM
The Underhills are summoned to court to answer non -response to code violations. I asked Mike
whether they needed an attorney and he said that this action was like answering a traffic ticket. The
judge will ask for a pleading and impose a fine (Mike thought on the order of $100) and give 30 to
90 days to produce plans and specifications and complete payment for the permit. The permit is
then good for one year.
Mr. Viera said that some progress and good faith should be shown by the court date. This could be
the Underhills entering into a contract with a professional to comply with the provisions of the
code. I should then write a letter to Mike stating that they have done so. Mike would then forward
the agreement on to the Code Enforcement Officer, ( Frank Cook).
Mr. Viera also suggested that the Underhills arrange a meeting with Mr. Cook before the court
date and try to reach agreement on a schedule to comply. A court appearance might then be
avoided but the fine still imposed.
I showed Mr. Viera the pictures I took of the house and the pictures that the Underhills took during
construction. He suggested that I 'have my work cut out for me'. Mike is going to talk to the Code
Enforcement Officer and impressupon him the complexity of producing the plans and calculations
thus giving me more time than the 90 days to produce the plans and calculations.
Mr. Viera also stated that the Underhills would have to contract with mechanical, plumbing and
electrical contractors to determine compliance with the respective codes. My responsibility would
be to show the plumbing, lighting, mechanical fixtures on the house plans. The Codes in force at
the time of construction would be those for compliance. 1988 Code for structural, plumbing and
electrical and 1987 for electrical. The inspections should be thorough but without 'tearing the
building apart'. Energy requirements in force at the time would also have to be complied with. The
building departments first notice was in 1987.
Species of the logs would need to be determined. Section 2506(b)1 considers beams of circular
cross-sections. Table 25E is concerned with timber piles and poles and is probably meant for use in
greater exposure: The uniformity of the logs in this structure indicates the applicability of Section
2506(b)l.

property improvements specified
For your protection, you should be aware that as "owner -builder" you are the responsible party of record
on such a permit. Building permits are not required to be signed by property owners unless they are personally
performing their own work If your work is being performed by someone other than yourself, you may protect
yourself from possible liability if that person applies for the proper permit in his or her name..
Contractors are required by law to be licensed and bonded by the State of California and to have a
business license from the city or county. They are also required by law to put their license number on all permits
for which they apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you
should be aware of the following information for your benefit and protection:
0 If you employ or otherwise engage any persons other than your immediate family, and the work (including
materials and other costs) is 5300 or more for the entire project, and such persons are not licensed as
contractors or subcontractors, then you may be an employer.
0 If you are an employer, you must register with the State and Federal Governments as an employer and you are
subject to several obligations including state and federal income tax withholding, federal social security taxes,
workers compensation insurance, disability insurance costs, and unemployment compensation contributions.
0 There may be financial risks for you if you do not carry out these obligations, and these risks are especially
serious with respect to worker's compensation insurance.
0 For more specific information about your obligations under Federal Law, contract the Internal Revenue
Service (and, if you wish, the U.S. Small Business Administration). For more specific information about your
obligations under' State Law, contact the Department of Benefit Payments and the Division of Industrial
Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to
perform their work personally or through their own employees, without a licensed contractor or subcontractor, only
under limited conditions.
A frequent practice of unlicensed persons professing to be contractors is to secure an "ownerbuiidef'
building permit, erroneously implying that the property owner is providing his or her own labor and material
personally. Building permits are not required to be signed by property owners unless they are performing their own
work personally.
Information about licensed contractors may be obtained by contracting the Contractors State License
Board in your community or at 1020 N Street, Sacramento, CA. 95814.
