The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from the County Building Department. Section 26-6 of the Butte County Code states that: ":It shall be unlawful for any person, firm, or corporation to erect, construct, alter, repair, move, remove, improve, convert, demolish or equip any building or structure in the unincorporated areas of the County or to cause the same to be done contrary to or in violation of any of the provisions of this chapter. "The use or occupancy of any building in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in a manner provided by law." Section 1-7 of the Butte County Code provides that any violation of any provision of the Code constitutes a misdemeanor, or in the discretion of the District Attorney, be charged as an infraction. The penalty for a misdemeanor is punishment by a fine not exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to exceed the sum of $500.00. Owner agrees to provide all necessary utilities to the mobilehome site. Tenants will make connection to such utilities at their expense. Tenants may enclose an area to be mutually agreed upon by Owner and Tenants for -Tenants exclusive personal use. Said enclosure may be removed b;, l marts upon their departure. Tenants shall, in the absence of Owner, care for the property and structures located thereon and shall ensure that the animals owned or cared for by Owner, including, but not limited to, cats, dogs and domestic fowl, receive food, water, medications, heat and shelter as provided by Owner. While Owner is physically residing on the subject property, it will be the joint duty of Owner and Tenants to maintain the property in good condi- tion, including watering and cutting the grass and caring for the bushes, trees, etc. Tenants understand that the subject property has on it, or adjacent to it, a canal, a highway well traveled by automobiles and trucks, pools, tall trees, and other possible dangers, both latent and patent, which could attract children. It is further understood that Tenants are the custodial parents of three young children and Tenants agree to assume the sole respon- sibility of caring for and supervising said minor children. Tenants release owner from any responsibility to supervise the minors, or warn the Tenants about any attractive nuisances or dangers on or adjacent to the subject property whether latent or patent and Tenants agree to hold Owner harmless from any injury or loss their children might suffer as a result of such nuisances or dangers. Tenants agree to indemnify and hold harmless the Owner from any harm suffered by Tenants or their children or guests. With regard to utilities, Owner and Tenants agree to the following: ELECTRICITY- Owner shall provide separately metered 110/120V electric service to the mobilehome site. Owner's responsibility shall end at the outside edge of a circuit breaker box to be provided and installed by Tenant which box shall be Tenants' property. As P.G.&E. bills Owner for electricity used by both Owner and Tenants as one account, Tenants will pay Owner an amount equal to the perce?ltage used by Tenants. Such p,r- centage shall be determined by taking Tenants meter reading on the same day P.G.&E. reads Owner's meter and comparing Tenants consumption to the total usage as indicated on the utility company's billing. WATER- Owner shall provide sanitary water for domestic use. Such water service shall be located within four (4) feet of mobilehome and Owner's responsibility shall end at the point where mobilehome connects to such service line. There shall be no charge to Tenants for water or maintenance of water lines. SEWAGE DISPOSAL- Owner shall provide for availibility and maintenance of sanitary waste disposal system which shall meet all public health requirements. GARBAGE- Tenants shall provide for their own garbage disposal at their own expense. FUEL GAS- Tenants shall provide for their own fuel gas requirements. TELEPHONE- Tenants shall install at their expense, personal telephone service. In the event of any action required to enforce any provision of this Agreement, the prevailing party shall be entitled to reasonable attorneys fees'and costs.
