Dave Elam stated that he has a problem with flooding, that it is localized, ►fie stated that the house is on a -small rise. He wanted the carport at the circle drive. Commissioner Walter discussed this being built without a permit and continued Without a permit. He did not want the carport that far from the louse, The hearing was closed. This carport is much larger than the normal 1-2 czar capacity carport found throughout the County., The subject property is approximately 1.9 acres, with numeroom cauitable locations for a carport. There is no Physical reason relatiinq to topography, lot size, or lot configuration which would require the carport to be placed wittrin the setback. A check was made of 'Planning and Building Department rocords, and Public. Works aerials, to determine whether any other structur08 within tho neighborhood were located within the setback._ Out of the 6� p4Arcels fronting on Milers Ranch Road, located on the Assessor's pages north'► and south of the subject property (Page 12, 13, 14 and 49) five structures were found to be Within the setback. Three of these, structures arra within 50 Feet;, one within 46 feet and one within 30 feet of the centerline. Two of the structures within 50 feet of the centerline complJled with the setback when they were constructed: The setback on Miners Ranch Road changed from 50 feat to 55 feet in approxiimsately x,976.: The structure within 30 feet ;appears to pre-date the zoning requirements. Only one variance to the front yard setback has beati issued in Book 72, Pages 12, 13, and 14� This was on parcel 72=-14-25 approximately 213 of a mile from the subject parcel, for a carport within 46 feet of the centerline. The majority of structures on Miners Ranch Road currently damply With setback, requir!ments. Approval of this variance without good cauoo$ would sot a procedent for a reduced setback through this corridor. Butte `csunty Code Section 24-49 sets out the necessary findings for gran.tlilg a-variance. One of those findings reads "'the strict application of this'cha ter deprives such P p property of privileges enjoyed by other property in the vicinity and under identical toning classification."
