Schlichting, a resident of Butte County, California, being of sound and disposing mind and memory, and not acting under duress, menace, fraud or undue influence of any person whomsoever, do hereby declare this to be my Last Will and Testament and I hereby revoke all Wills and codicils previously made by me. I have not entered into a contract with any person to make this Will or any other Will, nor have I entered into a contract with any person not to revoke this or any other Will. Article 1 Declarations I.1. Spouse. I am married to Betty L. Schlichting. 1.2. Children. I have four children: Stephen M. Schlichting, Donna L. Gillette, Belinda S. Schlichting, and Valerie L. Hook. 1.3. Statement of Intent. By the provisions of this Article, I intend to dispose of all the rest, residue, and remainder of my property and estate of every kind, character, and description, and wheresoever situated, which is not otherwise effectually disposed of by other means, including any property over which I have power of testamentary disposition at the time of my death pursuant to a power of appointment. Article 2 Disposition of Estate 2.1. Community Proper to Spouse. I give all of my interest in community property to my wife, Betty L. Schlichting, if living, otherwise as set forth in Section 2.2 below. 2.2. Disposition of Residuary. I give my entire residuary estate to the Trustee of the Schlichting Family Living Trust Dated August 4, 1993 ("the Trust") created by myself and my spouse as Settlors. The Trustee shall add my entire residuary estate to the principal of the Trust and hold, administer, and distribute the property in accordance with the provisions of the Trust, including any amendments thereof made before or after the execution of this Will. If the Trust has been revoked, terminated, or declared invalid for any reason, I give my entire residuary estate in trust to the Trustee(s) named therein, or to their successor(s), as Trustee(s), who shall hold, administer, and distribute the property under a testamentary trust in accordance with the provisions of the Trust in effect on the Last Will and Testament of Donald L Schlichting Page 2 date of execution of this Will, in which case the terms of such Trust are incorporated herein by this reference. 2.3. Omission of Heirs. Except as otherwise set forth hereinabove, I have intentionally omitted to provide for all my heirs whether or not mentioned herein and I generally and specifically disinherit each, any, and all persons whomsoever claiming to be or who may be lawfully determined to be my heirs at law, including without limitation: (1) my spouse; (2) any and all individuals named in Paragraph 1.2 above; (3) any child born to me or .adopted by me after the making of this Will; (4) any child who comes into a parent/child relationship with me, as defined in California Probate Code Section 6408(b), either before or after the making of this Will; or (5) the issue of any of the foregoing. Article 3 Appointment of Executor 3.1. Appointment of Executor and Successor. I appoint Betty L. Schlichting as Executor. If Betty L. Schlichting fails or ceases to act as Executor for any reason, I appoint Stephen M. Schlichting and Valerie L. Hook as my Executors. If either Stephen M. Schlichting or Valerie L. Hook fails or ceases to act as Co -Executor for any reason, I appoint the other of them and Belinda S. Schlichting as my Executors. If either the other of Stephen M. Schlichting and Valerie L. Hook or Belinda S. Schlichting fails or ceases to act as Co -Executor for any reason, I appoint the other of them and Donna L. Gillette as my Co -Executors. If either the other of Stephen M. Schlichting, Valerie L. Hook, Belinda S. Schlichting or Donna L. Gillette shall fail or cease to act as Co - Executor for any reason, I appoint the other of them as my Executor. References in my Will to "the Executor" are to the executor acting at the pertinent time. 3.2. Waiver of Bond. No bond shall be required of any executor named in this Will for any purpose. 3.3. Executor's Powers. My Executor shall have power to make a disclaimer for me and have full authority to administer my estate under the Independent Administration of. I direct that no executor shall be personally liable for any loss or damage in connection with the administration of my estate, except in the case of willful misconduct or gross negligence. For all purposes under this will, a person shall be deemed "incompetent" if and so long as a guardian or conservator of his or her person or estate duly appointed by a court of competent jurisdiction is serving, or upon certification by two physicians (licensed to practice under the laws of the state where the person is domiciled) that the person is unable properly to care for himself or herself or for his or her person or property. 4.4. No Contest. A contestant shall be considered to have predeceased me without issue and not to be in existence at the time of my death. For purposes of this Will, a "contestant" means any person who, directly or indirectly, voluntarily participates in any proceeding or action in which such person seeks to void, nullify, set aside, or modify (1) any provision of this Will; (2) any provision of any trust of which I am a Settlor; or (3) any codicil to this Will or any amendment to any trust of which I am a Settlor. Public Resources Code 4291 information will be provided. 1273.10 Driveways [X] (a) All new driveway construction or an extension of an existing driveway shall comply with Public Resources Code 4290 roadway requirements. [X] (b) All driveways shall provide a minimum 10 foot traffic lane and unobstructed vertical clearance of 15 feet along its entire length. Surfaces should be established in conformance with local ordinances, and be capable of supporting a 40,000 pound load. 4" of class 2 aggregate base shall be required for all driveways, turnouts, and turnarounds. 1273.03 Roadway Grades [X] The grade for all driveways shall not exceed 15 percent. Grades above 15% shall have 4" of class 2 aggregate base and 2" of asphalt concrete. No driveways allowed in excess of 20%. 1273.04 Roadwav Radius [X] (a) No roadway shall have a horizontal inside radius of curvature of less than 50 feet and additional surface width of 4 feet shall be added to curves of 50-100 feet radius; 2 feet to those from 100-200 feet. The minimum turning radius for a turnaround shall be 40 feet from the center line of the road. If a hammerhead -T is used, the top of the " 17' shall be a minimum of 60 feet in length. 1273.06 Roadway Turnouts [X] Turnouts shall be a minimum of 10 feet wide and 30 feet long with a minimum 25 foot taper on each end. Revised 02/28/06 c [C F Is E Q U I R E M E N T S 1273.07 Roadway Structures [X] (a) All driveway, road, street, and private lane roadway structures (Bridges, culverts, and other appurtenant structures which supplement the roadway bed or shoulders) shall be constructed to carry at least the maximum load and provide the minimum vertical clearance as required by Vehicle Code Sections 35550, 35750 and 35250. [X] (b) Appropriate signing, including but not limited to weight or vertical clearance limitations, one-way road or single lane conditions, shall reflect the capability of each bridge. [X] (c) A bridge with only one traffic lane may be authorized by the local jurisdiction; however, it shall provide for unobstructed visibility from one end to the other and turnouts at both ends. 1273.11 Gate Entrance [XJ (a) Gate entrances shall be at least two feet wider on both ends then the width of the traffic lane(s) serving that gate. Location and Visibility of Addresses [X] (a) All buildings shall have a permanently posted address, which shall be placed at each driveway entrance and visible from both directions of travel along the road. In all cases, the address shall be posted at the beginning of construction and shall be maintained thereafter, and the address shall be visible and legible from the road on which the address is located.
