In regards to the "third Dwelling" we have already agreed to change it into a Hobby Room/Game Room ,as per our conversation with Scott Rutherford, and to make all the necessary changes.We are in the process of drawing a set of plans to submit to the building department.ln the meantime we had hoped to finally obtain a building permit for the second Dwelling and have gotten a permit from Environmental Health for a Septic Tank and appropriate lines. Somehow or other something is still holding up the issuance of said building permit and we are,again,not receiving any assistance or explanation as to how to proceed.This has indeed been a very frustrating and discouraging undertaking with seemingly no end in sight. We are in the process of drawing a set of plans to submit to the building department.In the meantime we had hoped to finally obtain a building permit for the second Dwelling and have gotten a permit from Environmental Health for a Septic Tank and appropriate lines.Somehow or other something is still holding up the issuance of said building permit and we are,again,not receiving any assistance or explanation as to how to proceed.This has indeed been a very fiustrating-and discouraging undertaking with seemingly no end in sight. At the meeting issues were brought up that will need your attention. The property has building code violations. I have attached letters that were sent to you by the Butte County Department of Development Services Building Division. Building permits were not issued on two of the dwellings on the property. But the biggest issue is that after reviewing the assessor's records on this parcel is can not be determined when all three dwellings were placed on the parcel. This burden of proof falls on the property owner. At this time, with the General Plan designation of Agricultural Residential (AR) you are only allowed one single family dwelling and a second residential dwelling. One of the existing dwellings would need to be converted in a guest house which limits habitable area to 500 square feet and a limited kitchen area including no more than 10 square. feet of countertop, a 15"x15" sink and no more than a 5 cu.ft. refrigerator. If you wish to continue forward with the Use Permit, we would have to recommend denial. We had not considered improving the building at this time, since we had other projects needing our attention, but the illness of Heidi's father and the subsequent need to take care of him as well as her aging mother,prompted us to "fix -up" -remodel the old building, so they could move in and we could then take proper care of them. It turned out to be a huge project, since most everything had to be completely re -done ... much to our dismay,but time was of the essence and, as it turned out, the father passed away Dec.1,2002.Now the mother needs taking care of as well,she is 81 years old, and we fmd ourselves in this situation. We have,per your request,drawn up plans,had copies made, had an energy study done and are now ready to submit the plans.We do think it should be considered that there had been an existing building and we are enclosing photographs of our daughter's wedding with the building in the background.The pictures were taken in 1995 and the building is clearly displayed in the background.
