lndlcate that uses of the land should be compatible with neighboring
u0es and densities.
The opp'l i cant has planned -the park as a res i dent l a l facility based' on
his belief that the residential densities were discussed ' and tacitly
raporoved'when the property was zoned H -C (Highway Commercial) in 1980
A search of the record of that rezone indicates that the Highway
Commercial Zone was, placed on site in order to recognize the existing
store and to permit the development of a small commercial center on the
property. The record does not reflect any discussion as: to residehtlal
densities. The Land Use Element of the Butte County General Plan does
not directly discuss residtnt'al densities for ureas designated
Commercial by the Plan4, However, ., the Land Use E1 ement does i nd i cats
that residential densities should be related to the intensity and
compatibility of adjacent uses* In the area surrounding the subject,

Commission, the plan was presented and discussed. The

The first work was leading to a general devr),10[Jznent plan
prepared by Cook. Associates in August/Septoltll:adt 1969 and
presented by Gook to Butte, County Planning COMAii8sion and,
the Board of Supervisors. This plan was g:i.v41!'1 unqualified
endorsement in February 1970.

We engaged Royden Stark, Architect,, to desigl'i the Phase G
commercial building in 1971, and later Town Ond'Country
Construction j a general contractor, to build, it. Builds nt;►
was completed and finaled on August 10, 1973.

Several seasonal operations of the store by tis and others
were effected in 1973, 1974, 1975 and 1983.

Dormant period. The period of 1974 to 1980.was dormant
and was caused by a series of events including, but not
limited to, the energy crisis,, the: credit crunch of the
19701s the 7 years the whole area was tied up in the
Craig-Mooretown ;Ridge rezoning effort. This was compl.icat0d
by the fact that I was oil foreign assignment and out of tho
state for abouac 5 years.

In May 1980 after prolonged hearings, both 11P101-16-002
and -003 were designated .Highway Commercial as a result
of the CMR rezoning.

In 1981 and 1983 clearing and 'location of residential
sites was acci3laplished generally in the area how called,
Phase I of the property and discussed with Butte County
officials and the State of California.' Requirements had
increased in number and dif'ficul.ty of compliance by 'all
regulatory agencies. The 1983 .recommendation by both
County and state was. to. clear and level the lana enough to
locate all sites and obtain access. In skiort, they wanted
me to come in with an overall phased plan for the property
because they did not 'want 'to review the project piecemeal
or a phase at a time..

Item 1:
Minor point - the application lists Conrad ft, and Doris 11.
Springer and Proterra Corp. (controlled by Springers) as birth
the applicant and owner. The requested mobile home park -is
Located entirely on that property owned by Protett4
Corporation. The proposed six dwelling units, the proposed
boat and RV storage area and the existing store are located
on property owned by Conrad R. and Doris H. Springer. Tay.
bills for Proterra Corporation and the Springers. are sent to
the same address. It should be noted that in a letter dated
July 23, 1971, C. Springer stated that the northerly parcel.`
(Proterra) had been sold in order, to raise money;, leaving the

tight -of -way required to be deeded to the County per the
condition of approval on the Use Permit granted February 19y
1970 Zara store and service station (see Attachment A).,
Item 2:
A search of County records indicates an application for a bhe
Permit for the storage of inflammables (service station). and.
drive-in (A and W) in August of 1969' signed by Conrad R.
Springer. (see Attachment B) and a re=applicatidn in February
of 1971 also signed by Conrad R. Springer. (see Attachment
C) Neither of these applications or the submitted site plana
indicate a mobile home park, multiple dwelling units, RV'
storage, or any other uce,
Item 3:
The comments from the Environmental Health Department printed
in the staff findings were copied verbatim from the most up -
td -date information available at the time;. Discussions in
the field with the sanitarian are subject to review and/or.
Modification in that off' ce prior, to being ,forwarded to the
Planning bepartment. The map described as i'endlosure "
missing from the tr'ansmi:ttal, but f ile` olop l,es show a
rudimentary' drainage plan, the layout of the Basi water
di,stributian system (but not the individual line to each
mobile: home. space) and the location of t%e existing power
lines which cross the property. Th' plan does not show, any,
sewage disposal, faci-lines. There area hataever, se�reral
unlabeled squares in the area of Phase 1 0£- the park that may
he the location of soil test holes, From the information ;in
the Planning Department files it is not possible to'.be

certain
It is possible that a staff member stated tliot a genetvnl, idea
Of the project was acceptable in that we do noir need doWled
engineering or construction plans. The use potmit'
application form clearly requires ''A detailed plot; p1 in of
adequate scale to; clearly :show: proposed ;buildings and
improvements, folded to 8 1/2 x ll inches, shall aecompany'
and be made part of the Application for Use Prvmi't."
Resolution No. 14-109 as amended establ:t.sbing mobile home
park regulations also requires ii comprehensive site plan. It
must be recognized that there is not times cl>iring a mntiing
such as the one described to perform a drtaited check oi"'the
plan,of a project such as this,
The procedure for processing use Permits includes the 111re-.
ApPlication'i process. This involves review by the 'Land
Development section of Public Works and by the Environmental
Health Department. A project must meet the requirements of
these two departments prior to being released for furtlitir
processing. The pre' -application fee was Paid July :12, 1085
and forwarded to Public Works and Health Departments on ul'y`
17, 1985, In October of` 1986, after 16 months, the Health;
Department gave verbal clearance. In an effort to expedito
the project after such an extended wait, the project Wig
released in the expectation that final design approval `14(
coming from Health. In retrospect it is clear that bf'lo
department should have waited until all requirements were
met.

It is true that, the State Regional Water Quality, Control.'
Board (SRWQCB) and the State Department of Housing and
Community Development: (11M) require plans only after the use.

layout of a project may be dictated by sewage disposal,
requirements. It is not possible to :determine with any
certainty that any given plan will be feasible Uri,t the basic
sewage disposal system design is: completed. I" a project was ,
granteda use permit prior to a workable sewage .disposal
system being designed, wind subsequent testing dictated
project modifications, the previously approved use permit
laould be of no use, and a View (or, modified.) use permit would
be necessary, requiring re -'application.

It is; common practice to allow recreattbnal vehicle use

in vacant,_spaoes within mobile home parks#
especiallywhen a park is nev. Staff was simply attempting
to allow for this flexibility, If the applicants do not wish
to take advantage of this; option; it .can easily be stated as

that "Mobile home parks shall be developed on a parcel of not
lens than 5 acres, with no more than 10 units
per acre." We have proposed 1.7 units (mobile home lots)

much less than 10'units/acre the Board of Supervisors has decreed.
Now in a third attempt to meet Planning Staff requirements

We want a clear statement ;of permissible density and think we
are entitled to that.We have reduced density twice and replanned
twice at considerable expense in an attempt to satisfy the
Planning bepartment's ever -elusive and changing density require-
