Butte County Advisory Agency FROM,: ;Planning Director SUBJECT;Report on the Tentative Parcel Map of Terry Greeny, AP#028-17-0-0.17 DATE: February 22, 1989 This is a, proposal for a Tentative Parcel. Map to divide 400 acres to create 20 lots of 20 acres each. The present zoning is A-5 (_g parcels) The Lana Use Platy Map of the (Agricultural - 5 acre Butte County General Plan designates this area as Agricultural- Residentiali There are no specific or community plans for the area. The initial study performed for this project identified potential impacts to wildlife and a Focused Environmental impact Report (FEIR) was required. The final. appeal of the FEIR was denied by the Board of Supervisors August 16, 1988. To date, no action has been taken by the applicant toward preparing a FEIR. The California Elivironmontal. Quality Act allows one year to certifythe EIR. (PVblic Resources Code Section 21G80.2.) A The one year period maximum'Ma0-d 2l xterlion is possible. 90-da erten expires . A 90-day extension would be of no help to the applicant since it will take from.6 to 9 month minimum to select a consultant and prepare an.FEIR Similar time limits existunder, the Permit Streamlining Act, Government Code Section 65,943., A decision must be made no later than the Advisory Agency meeting of March 20 1989. Memorandum TO: Advisory Agency FROMt Planning Staff SUBJECT: Terry Greeny, Tentative Parcel Map, AP 028-17-0-00 anA 072-39-0-003 DATE: July 11, 1988 An initial study performed for the above -referenced project revealed that there were potential impacts associated with this project regarding archaeological resourcesi water quality within area streams, and wildlife, specifically migratory deer, The applicant has agreed to attach mitigation measures to the ;project that will reduce or eliminate potential impacts to the environment for all of the impacts identified in the initial study except those regarding migri-itory deer, While the original project approved in 1984 also required an EIR, documents certified in July 1975 were used. Since 198,, additional information has been developed identifying impacts to migratory deer in Butte County- which: are not addressed in any previous EIRs. The information consists of maps prepared by the California Department of Fish and Game and direction by the hoard of Supervisors regarding implementation of the maps and General Plan policies involving; wildlife. A consultant has been contracted to prepare an Energy) Natural Resources, and Recreation Element of the Butte County General. Pian and an tIR which will address migratory deer; The first draft is due in 1989, and will not be ready, in time for consideration of this project Additional information regarding re tig g 'ildlife impacts can be found in the initial study and letters attached thereto, Rec6mmondation': Because of the above stated concerns, it is recommended; that the requirement for a focused<EIR be upheld.
