held November u, 1964, the Board 'upheld your appeal of the denial
by the Advisory Agency of the above-referenced parcel map and
adopted a mitigated negative declaration regarding environmental
impactfor Ah 72-47-48.
Approval of the final snap is subject to the conditions as listed
on the attached sheet. When the conditions of approval are
complied with, it will be in order for Mr. McClendon to file his
"final maps' with the nepartitiont OF Public Works for recordation
within twelity-four (24) months of the date of the Board of
Supervisors'' action.

if the Board decides to uphold the appeal, the following conditions are

The Department of Fish and Game has reviewed the Marc McClendon Tentative
Parcel Map (A.P. 12-47-8) which proposes to split a five -acre parcel from
an existing 11.71 -acre parcel. This parcel lies within critical winter
range of the Mooretown Deer Herd with onsite habitat consisting of oak
woodland and some chaparral.
We recommend that the project conform to the provisions of the majority
report of the Migratory Deer Study Panel which is expected to be adopted
by Bunce County as a general, plan policy to protect migratory deet.

DATE: July 24, 1484
This is a proposa', to divide 10 acres to create two parcels at 5 acres
each The present zoning is M -R (Mountain or Recreation Subdivision
Residential). The Land Use plan Map of the Butte County General Plan
designates this area as Agricultural -Residential. There Are no
specific or community plans for the area.
The proposal does not :conflict with County zoning nor any adopted or
Proposed element of the Butte County General Plan nor any County,
specific or community plan.
Recommend approval. This project will reduce potential impact to deer
habitat if the following mitigation measure and condition are adopted._
Mitigation measure proposed by applicant and modified to meet the
recommendations of the Butte County beer Herd Study Panel report:
i» Place a note On the final map stating "Perimeter- fencing is
limited to 5 strands or less of barbed wire, the bottom and
top wire to be a minimum o+'16 inches and a maximum of 48 inches
above the ground".
The following cdnditinn it recommended by the Department of Fish, and
Game and is in conformity with the provisions of the Deer {-teed report.
