We are in the process of purchasing the above%referred to parcel of land.
The parcel was.created prior to March 5, 1938. Enclosed is a copy of the
Deed that was.,recorded when the present owner of the property took title.
The Deed is dated March 5, 1938. The owner of record is still Bertram L.
Bergeson.
The;.preliminary title report shows that there is no deeded Right -of -Way.
The -access road that is being used to subject property goes across about
�.4,,mile of private property. The owners of this private property have
provided us with a gate -key to enable us to have means of ingress and egress
We do not want to close the escrow unless we can be assured that, at a later
date, a building permit will be issued.for one single family residence -on this
40 acre parcel.. As we understand it, this 40 acre parcel existed about
18 years before the county had any R/W requirements.
