5ydngy Winchester - Use Permit (item determined to be categorically
exempt, from environmental reveiw) to allow a second dwelling on a
parcel zoned U (Unclassified) located on the east: side of Lower
Forbestown Road, approximately 1/2 mile south of 'ponderosa Way,
identified as AP 73-10-23, Forbestown Area.
The Commission waived the reading of the Staff Findings;
Vice Chairman Walter stated that the property has a small weekend residence on
it with the same problems as the Sperry property,
The hearing was opened to the public,
Mt. Winchester stated that.his situation is like Mr. Sperry'su He stated the -
permanent home is being built and he wanted the weekend home for his family to
be able to use on visits. i
Commissioner Lynch uestioned how far awayfrom the i
residence was being4 laced. Mr: Winchester stated approximately
the new
P pp' y 130 feet.
Commissioner Lynch asked about moving the construction of the new home closer to
the cabin and possibly connecting the two. Mr. Winchester: 6tated tlla"t there was
a problem with the terrain. He stated that there are two buildings how that
make up he cabin,
Vice Chairman Walter stated that if the cabin is soo sq. ft. or less it could be
converted to a guest house. He stated that if this was a guest house there
could be no cooking area and the small building'would have to be converted to
storage or a shop. He asked staff, if this was done would Mr. Winchester need a
Use Permit? Staff stated the applicant would: not need another Use Permit for
the guest house and the Commisson could make approval, on this Use Permit
temporary with a specific period of time,
The hearing was closed.
COMISSIONER WIBERT WAS PRESENT AT Tills TIME,
It was moved by'Commissioiner 'synch; seconded by Commissioner Peabbdyo and
carried for approval as follows;
A. Find that the project is categorically exempt fton environmental review- and
B: Find that the project complies with Butte County Code Section 24-47
specifically that the proposed uses of the property Will no_ impair the
integrity and character of the zone, in Which the land lies and that the use
would not be unreasonably -incompatible with or injurious to sutrounding
properties of detrimental to the health and general welfare, of the Persons
