Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Donald and Shirley Toney are hereby granted a Use Permit in accordance with application filed: August 23, 1994 to allow a two space RV park, on property in the "U" (Unclassified) and S -H (Scenic Highway) zones, located on the north side of Forbestown Road, approximately 200 feet east of Powell Ridge Road, in the east Oroville area . ` Failure to comply with the conditions specified herein as. the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and anew permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns -of the Permittee. SPECIAL CONDITIONS: , 1. Applicant must comply with Environmental Health Division requirements. 2. The R.V. space must meet the Fire Safe Regulations of PRC 4290 and Butte County. 3. The applicant is allowed only one R.V. space on this parcel, unless Environmental Health approves the use of the septic system for an additional R.V. At that time, site plan approval for the location of the second space shall be reviewed by the Director of Development Services, or his designee. 4. Applicant shall maintain a planted buffer between the R.V. space and Forbestown Road. The buffer is to shield the R.V. from view to the traveling public. 5. Record notice that Use Permit will terminate with the sale or transfer of the land. 6. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. NOTE: Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant.
