This merger application was approved with one condition and the requirement that three notes be
placed on the legal descriptions. One of the conditions limits fencing in areas not used for
residential purposes to 5 strands of barbed wire as follows:
Fencing for areas other than residential areas shall be limited to a maximum of
five (5) wire strands. The lowest of strand shall be at least sixteen (16) inches
above the ground and the upper strand shall be no higher than forty-eight (48)
inches above the ground.
This condition is not required by County code and is normally a mitigation measure that is the
result of an identified environmental impact and requires the applicant to agree to the measure.
In this instance, the applicant had no opportunity to agree to the measure and the Planning
Division requests that the condition not be required as a note on this project.

On January 31, 2003, the Department of Public Works made the finding that the
Certificate of Merger on the above referenced property is exempt from environmental
review, and approved the project subject to the following notes to be added, by the
engineer, to the Certificate of Merger and subject to the following condition:
CONDITION:
1. Prior to the recordation of the Certificate of Merger, provide a 60 -foot access
easement from each resultant parcel to a publicly maintained road.
NOTES (to tie added -to -each legal description):
1. This parcel has not been proven to meet sewage disposal requirements.

must do so in writing, with the appeal fee of $50.00, to the Clerk of the Board of
Supervisors, 25 County Center Drive, Oroville, California 95965, prior to 4:00 p.m.,
February 10, 2003.
If there are no appeals, we will submit the Certificate of Merger to the Butte County
Recorder's office, for recording.
