North of 226 Old Forbestown Road
Dear Mr. Westphal:
We sent you a warning letter dated October 16, 1990 notifying you that
you are in violation of the Butte County Code at the above referenced loca-
tion. As of this date, the following violations still exist.
Failure to obtain permits, inspections and approvals for installing
travel trailer *and constructing cabana in violation of the Mobilehome
Parks Act of Title 25, California Code of Regulations, adopted by.
Section 28A-1 of the Butte County Code as follows:
(1) 1018 --Permits Required (any plumbing, electric and accessory
structure.
(2) 1048 --Construction and final inspections required.
The above violation(s) shall be corrected or abated by you by submitting
two complete sets of plans, applying for the required permits, and paying
the appropriate fees'within 30 days of the date of this letter. After permit
issuance and field authorization to proceed, the work must be completed
and approved by this office within the permit specified time.
Unless the violation(s) is(are) so corrected or abated, a citation shall
be issued to you to appear in court for said violation(s) and for failing
to comply with this notice. Upon conviction of said violation(s) or for
failing to comply with this notice,- penalties shall be imposed and a Notice
of Violation recorded in accordance with Section 41-7 of the Butte County
Code.

We sent you a warning letter dated January 17, 1991 notifying you that
you are in violation of the Butte County Code at the above referenced loca-
tion. As of this date, the following violations still exist.

or remove the travel trailer and cabana. \\
All work must stop until these permits are issued and you are authorized
by our field inspector to proceed. This field authorization cannot be made
until the existing work is inspected and approved.
Please be aware that Butte County has entered.int.o a Code Enforcement Program
that seeks voluntary compliance with the Butte County Code, but provides
an effective means of enforcement if such compliance is not obtained. If
voluntary compliance is not obtained, enforcement will be pursued through
the issuance of citations, fines, and the recording of a Notice of Violation.

Dear Virgil,
On behalf of my father, T. A. Westphal Jr., I am writing to advise you
that you must vacate the property on Old Forbestown Rd. where your trailer,
cabana, and various other structures and items are now located.
As you know, my father and his sister, Grace Hays, are the property owners.
You were given verbal permission to move your trailer onto the,site after
my brother and I met.you in Old Forbestown on April 4, 1988. However, we
neglected at that.time to consider that certain Butte County code. requirements.
needed to be met.
Last October, we received a code violation warning letter from the county
regarding your trailer and other structures, and we drove to Forbestown to
look at the property ourselves. We were surprised and very unhappy to see
the poor condition of the property. You had told us you would simply move
your trailer onto the agreed site and you would keep the area neat andic'1'ean.
You did not ask permission nor did we know that you had built a large st=ructure
over the trailer and were raising rabbits in several cages on the property.
Since then, we have been in touch with Butte County officials and have 'reviewed
the county code requirements for mobile home.installations. It's obviouscthat
it would be very difficult, if not impossible, to meet the permit requirements
starting with water rights, then power, septic, structural plans, etc. As
owners of the property, we do not wish to attempt to meet those requirements --
either on the subject property or on any other of our properties in Butte
or Yuba counties. Therefore, we are hereby notifying you to vacate the site
by February 15, 1991. In addition to your mobile home, all buildings, cages,
trash of all kinds, and the abandoned pick up truck must be removed.
I am sure you will be able to find a more suitable location and a location
that will meet county requirements. By the way, I believe you will also be
hearing from the Butte County Building Inspection Department about the violation
and the deadline for vacating the site. We will also be visiting Forbestown
again in the near future.

Dear Virgil,
August 23,1991
I am writing to you again on behalf of my father, T. A, Westphal-jr.,
regarding the code violation notice you received from Butte County, and
to let you know that my brother and sister and I are driving up to
Forbestown in a few days.
The notice from the county was dated July 10, 1991,=and it gave 30 days
for you o correct the violations --which means moving your trailer off
the property and removing the structure you built around.the trailer..;
Whenmy:brother and.I talked with you in Forbestown 5 months ago (March 22),' "
you said you would move off the property if we would give yo.u:some timeo'-
Ve said 2 months, and you agreed; -however, after all this time we have
been told that you have not even started to move..
Attached is. a copy of the letter. I wrote to you on January 10, 1991
explaining why you must move. We have tried to be very fair with you,
but you have not responded to the county or to us and have not-livdd
ap,:to the promise you.made to us in March. As a result, you may soon
receive a citation and will be forced to go to court.
I am sure you do not want this to happen, and it can be avoided if you
will now move your trailer and start taking down the building. However,
iTt'=st be done right away.
As I said, we will be in Forbestown very soon, and we will see you then.
