Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set
forth below: Ronald Hague is hereby granted a Minor Variance in accordance with application filed
February 23, 1998, to allow the expansion of a house that is located within the 20 foot front -yard setback.
Failure to comply with the conditions specified herein as the basis for approval of application and
issuance of Permit, constitutes cause for the revocation of said permit in accordance with the
procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-
52.
2. A Minor Variance shall lapse and shall become void one year following the date on which the
Minor Variance became effective, unless prior to the expiration of one year, a building permit is
'issued and construction is commenced and diligently pursued toward completion on the site which
was the subject of the Minor Variance application.
3. The terms and conditions of this minor variance shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
4. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval,. verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or
significant in nature. shall require a formal application for amendment.
FINDINGS:
Section 1: Environmental Findings.
A. Upon careful and deliberate review of the project and the project site environs, the proposed
overhead canopy will have no significant environmental effects and has been determined

to meet the criteria for a categorical exemption under Section 15303 of the California
Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings. ,
A. There are special circumstances applicable to the property (size, shape, topography,
location or surroundings) or the intended use of the property, and because of this, the strict
application of zoning standards Code deprives the property of privileges enjoyed by other
properties in the vicinity under identical zoning classification. These special circumstances
are:
1. The location of the OWID water ditch limits the amount of expansion that can
occur on the rear of the house; and
B. The Minor Variance or its modification is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone and
denied to the property for which the Minor Variance is sought; and
C. This Minor Variance or its modification will not be materially detrimental to the public
health, safety or welfare, or injurious to the property or improvements in such vicinity and
zone in which the property is located because:
1. The expansion of the house will not increase the distance that the house projects
into the front yard setback; and
2. The expansion will not interfere with vehicle safety or sight distance; and
D. This Minor Variance will not constitute a special privilege inconsistent with the limitations
upon other properties in the vicinity and zone in which such property is situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property.
F. This Minor Variance or its modification will- not be incompatible with the Butte County
General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the
Variance for Ronald Hague on APN 073-190-012 to allow an expansion of a house that
is located within the,20 foot front yard setback. Approval shall be subject to the following
conditions:

B. Conditions of Approval:
1. A building permit for the expansion shall be obtained from the Butte County
Building Department.
2.- The expansion of the -dwelling unit shall substantially conform to the plans
submitted with the application.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.

I am in receipt of your letter dated April 22, 1998 regarding revisions made to my
building plans. This letter was hand delivered by you to me at your office on. April 22,
1998. It is my understanding that two other letters regarding revisions have been written
that I have not received. I can only speculate that you were not listening to me when I
pointed out to you that day at your office that I do not live in Oroville as your first letter
states. Maybe that is why I have not received the other two letters.
Nonetheless, I understand now after you have had my plans for two weeks (hand
delivered on April 15th) and sent two letters of revisions, that you have now decided that
these plans should be approved by an engineer. It is very ironic that now after all this
time that you should decide to force me to carry out the most costly and time consuming
revision for these plans.
I can only assume that you are in the position of Plans Examiner because you are not
stupid, so the only other reason I can figure you have decide to have these plans
engineered at this later date was because you were intentionally delaying the project.
By you deciding now to have these plans engineered, I feel that you have not only not
done your job, but you have used my money to obstruct the progress of this project. For
t?^is reason, I am demanding a full,refi:nd of my $632.00 plan. check fee.

Explained the need for the designer to indicate the braced wall panel types and

4-27-98: Received revised building plans.
4-28-98: Review of revised building plans. Letter faxed to the contractor (applicant) as per
his request.
4-29-98: Received phone call from the designer in response to my letter of 4-28-98. He
agreed that the building would require an lateral analysis to meet the bracing
requirements of U.B.C. 2326.
4-30-98: Sent another letter (via fax) to the applicant about the remaining items that the
designer could not resolve from the letter of 4-28-98.
4-30-98: Contractor called requesting that the note on my letters advising the applicant to
"provide school impact fee certification" be deleted from any further
correspondence. He also stated that he a\was taking the plans to an engineer and
he would expect them to be reviewed as soon as he returns them to the Building
Division.
4-30-98: Contractor's wife at the counter requesting all building plans and truss
calculations. I gave her all the items that she requested, excluding the file copy of
the current plans and the old plans with the S.R.A. and Environmental Health
stamps.
5-12-98: Received a copy of a letter from the owner, Mr. Hague, requesting a "full refund"
of. the $632.00 for the plan check fee ($543.00 = Building Division & $89.00 =
S.R.A.)
5-12-98: Mr. Hemstalk delivered the revised engineered copies of the building plans and
lateral analysis to the Building counter. I advised hem that I received a letter from
the owner requesting a "full refund" and he stated that wanted to continue with the
plan review. I informed him that I would be reviewing the building plans on the
following afternoon.
5-13-98: Reviewed revised/engineered building plans in the afternoon. Discovered
numerous problems with the engineering. The phone number and/or address was
not on the engineering or the building plans. Received a phone call from Mr.
Hemstalk and he supplied the phone number for Mr. Silva. Called the engineer
and wrote an additional letter regarding the engineering.
5-14-98: Sent letters to owner, builder and engineer.
5-14-98: Received second copy of the building trusses. Returned by contractor.
5-15-98: Reviewed and approved second copy of trusses. Indexed file.

5-19-98: Received a faxed copy of the engineering revision from Mr. Silva. -Called and
informed him that he would need to place all of the new engineering on the
revised plans: As per my request to expedite the issuance of this permit, he then
came to the Building Division and made the adjustments to the plans.
5-20-98: Plans Approved! Mr. Silva will inform Mr. Hemstalk that the only item need to
issue this permit is the Butte County School Impact Fee Certification.

Dear Mr. Hague:
At the regular meeting of the Butte County Planning Commission held April 23, 1998, your request
for a Minor Variance to allow the expansion of a house that is located within the 20 foot front yard
setback, was approved subject to the conditions listed on the enclosures. Please sign both copies
and return both copies to this Division within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday, May 4, 1998. The appeal fee of $50.00 must be paid at that
time. If you do not appeal and if there are no other appeal within the 10 calendar -day appeal period,
the action of the Planning Commission is final.
A Notice of Exemption (NOE) should be filed for purpose of completing the California
environmental quality Act requirements. The fee for filing the NOE is a $25.00 document handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00 should be
submitted to the Planning Division in order to complete the process.
Please be aware that failure to return the signed copies within 40 calendar days will invalidate the
Planning Commission's approval. Re-application to this Division would then be necessary.
The Use Permit is deemed granted when the enclosures have•been signed by the applicant, with the
counter signature of the Chairman of the Planning Commission, and said permit is received by the
applicant by -registered mail.
Pursuant to Section 66020 (d) (2) of the Government Code you are hereby notified that you have 90
days to register a protest challenging any fees, dedications, reservations, or exactions imposed as
conditions of approval for this project.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set
forth below: Ronald Hague is hereby granted a Minor Variance in accordance with application filed
February 23, 1998, to allow the expansion of a house that is located within the 20 foot front yard setback.
1. Failure to comply with the conditions specified herein as the basis for approval of application and
issuance of Permit, constitutes cause for the revocation of said permit in accordance with the
procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-
52.
2. A Minor Variance shall lapse and shall become void one year following the date on which the
Minor Variance became effective, unless prior to the expiration of one year, a building permit is
issued and construction is commenced and diligently pursued toward completion on the site which
was the subject of the Minor Variance application.
3. The terms and conditions of this minor variance shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
4. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.
FINDINGS:
Section 1: Environmental Findings.
A. Upon careful and deliberate review of the project and the project site environs, the proposed
overhead canopy will have no significant environmental effects and has been determined

to meet the criteria for a categorical exemption under Section 15303 of the California
Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings.
A. There are special circumstances applicable to the property (size, shape, topography,
location or surroundings) or the intended use of the property, and because of this, the strict
application of zoning standards Code deprives the property of privileges enjoyed by other
properties in the vicinity under identical zoning classification. These special circumstances
are:
1. The location of the OWID water ditch limits the amount of expansion that can
occur on the rear of the house; and
B. The Minor Variance or its modification is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone and
denied to the property for which the Minor Variance is sought; and '
C. This Minor Variance or its modification will not be materially detrimental to the public
health, safety or welfare, or injurious to the property or improvements in such vicinity and
zone in which the property is located because:
1. The expansion of the house will not increase the distance that the house projects
into the front yard setback; and
2. The expansion will not interfere with vehicle safety or sight distance; and
D. This Minor Variance will not constitute a special, privilege inconsistent with the limitations
upon other properties in the vicinity and zone in which such property is situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property.
F. This Minor Variance or its modification will not be incompatible with the Butte County
General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the
Variance for Ronald Hague on APN 073-190-012 to allow an expansion of a house that
is located within the 20 foot front yard setback. Approval shall be subject to the following
conditions:

B. Conditions of Approval:
1. A building permit for the expansion shall be obtained from the Butte County
Building Department.
2. The expansion of the "dwelling unit shall substantially conform to the plans
submitted with the application.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in
fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully
by said conditions.
