asmuch as it is unconstitutional and in violation of Article 5 of the
Bill or Pights and in violation of the U. S. Constitution.
Commissioner Gilbert stated that the condition is necessary since the
bussi.ness would increase the traffic- flow. Commissioner Gilbert shade
a motion to approve the zse permit, finding it to be a necessary use
to remedy the teed %n -thy area, finding it to be in conformance with
the Butte County General Plan, that it is an existing use, and correct-
ing- conditions to read:
1. Deed 40 ft.: right-of-way to the County of Butte from the center -
line of LaPorte. Road, or_ the north side of the roadr that prop
erty fronting on the d zmantling yard.
2. Site to be Locally enclosed Frith a s%ght-obscuring fence with
a minimum height of 6 ft.
3. All dismantled or partially dismantled automobiles or other
salvaged materials available for sale shall, be stored within
the fenced area.
The applicant must also comply with all other State and local,
statutes, ordinances and regulations.

homes in the area. My residence is only 300 feet from
the proposed yard site. 7; :feel our mountain area has
a real need, for the service Carl decker can perform.
I work in the 'woods and it has been my experience that
abandoned vehicles are a constant problem and can Present
a very real danger as well. Surely, a well-fbnoed,
neatly maintained ,junk yarcl business with a hard-working
