With reference to the above subject and -your request for inspection of the covered
porch, cabana and covered deck at 129 Provenza, Oroville, the inspection was
made July 23, 1993.
The additions were constructed by the previous owner without permits and in-
spections from this office, so we were not able to perform the required inspect-
ions during construction. We therefore made a reasonable visual inspection,
without going on the roof, under the building, or in the attic and found the
additions appear to conform to the intent of code requirements, except for the
following items which must be done or resolved:
1) Provide Environmental Health Department approval.
2) Provide conforming stair rails, guardrails and intermediate rails
throughout.
3) Verify adequate piers and footings for covered porch, deck and cabana.
4) Mail siding on cabana properly.
5) Verify electric is properly installed and fused.
6) Provide drainage away from mobilehome.
7) Detach covered porch and deck roofs from mobilehome and support
independently.
8) Although a retaining wall less than 4' in height from bottom of footing
to top of wall does not require a permit, the retaining walls at the
front of the mobilehome are collapsing and should be repaired.
9) Comply with any items identified in plan check.
This inspection by the County of Butte does not act as a guarantee or warranty
as to the internal soundness of said additions.

Re: Martin Pine Mobile Home Siting

Dear Jim:
Last Fall we prepared a Site Plan for Mr. Pine's garage. We
have visited the site on several occasions, the most recent
was Tuesday, October 28, 1986.
The pad for the Mobile Home was in the final preparation
stages. The site Contractor dug an observation pit to- 2
feet below the north side of the pad at our request to
verify thatithe pad will not be subjected to detrimental
subterraneous water movement.
The pad is stable and the Mobile Home will be founded on
the cut section of work. There will be some lawn area
adjacent to the Mobile that will occupy the filled area.
The soil is a reddish brown silty clay"-witha small rock
content. Soil bearing value of from 1000'p.s.f`. to 1500
p.s.f. have been demonstrated in these soils.
The wet area some 400-500 feet west of the pad is downgrade
and unrelated to the proposed Mobile Home siting.
The site is appropriate and, the pad is well placed and
prepared. The Permit should be issued.

My completed complaint form is enclosed, along with the
chronological summary you requested in response to my 8/4/93
letter. I apologize for the length of time it has taken me to
complete this task; my life has been chaotic for some time. At
work, I have a fairly responsible position, which normally
entails stress, but this year I have been a key player in a
divestiture. (We refer to these past months as "the weeks from
Hell.") My personal life normally also entails a great deal of
stress because of my husband's problems. The hours I have spent
trying to resolve the problems with the Oroville property add up
to days. Just preparing this complaint was a sizable task!
I am copying several people on this letter in lieu of writing
several -,different ones as a.means of_reducing the work on my end:
1. Rose Hardy - Department of Insurance, File # U-9387683. Ms.
Hardy is reviewing my complaint and I am encouraged after
speaking with her. Also, as suggested by Mr. Wennerberg,
also of the Department of Insurance,I have submitted a
claim to First American Title Insurance, the company that
underwrote the Title policy.
2. Assemblyman Bernie Richter - Assemblyman Richter responded
to my letter and seemed genuinely interested.
Unfortunately, our plight is not "isolated," as Assemblyman
Richter thinks. Every person we have spoken with says
he/she is glad we are pursuing this because most people just
let it go. A consumer brochure regarding purchasing
property is certainly needed. Consumers need to be
protected before the sale. Afterward is too late.
3. Leslie A. Doorley - Better Business Bureau. Because my life
has been so chaotic, and this task has been so formidable,
by default a "reasonable time" has elapsed. I have high
hopes for the assistance from Ms. Hardy. I am absolutely
incredulous that I have heard absolutely nothing from either
realtor...- .I guess everyone hopes I- will just -give up and go

4. Scott Rutherford - Butte County, A.P. J 073-32-0-041. I am
still working on this problem. We asked a second contractor
for a bid so we would have two for comparison. The second
contractor's quote was much lower. However, he was supposed
to come to the property again to measure, etc. before giving
a firmer bid. We have not heard from him again. (Why am I
not surprised?)
I am flying to Oroville tomorrow. I plan to give a copy of
everything to an attorney in that area for his preliminary
review. I need to turn this over to a professional and get the
pressure off of me. Robert is getting worse and I have no time
in my life for migraines or ulcers.
I am only including the complaint, chronological write-up, and
exhibits to the Department of Real Estate. If any others copied

Dear Sir or Madame:
My husband, Robert E. Kongle and I have had several on-going problems with
a home we purchased in Butte County and now are in the position of being
required by the county to make some extensive and expensive repairs. WE
SHOULD NOT HAVE TO PAY FOR THEM since we purposely hired a realtor, Karole
Gaines of Landman in Oroville, to deal with the seller's realtor, Laura
Pugh of ERA in Paradise, to ensure everything was handled properly. In
addition, the escrow process should have caught errors large and small.
Why do we pay realty and escrow fees if the buyer is not assured some
protection under the system?
We purchased the above -referenced property in January, 1992 from Mrs. Ida
M. Pine (Haley). Robert's doctor had told me "do what you have to do to
get Robert a place to get away to or he will self-destruct." In response
Robert and I invested our life's savings, plus took on a mortgage to buy
this property. From the beginning we told Ms. Gaines of Robert's problems
and the reason for our purchasing the property. We emphasized that
everything had to be correct and in good working order.
From the beginning we have HAD problems: electrical, phone lines, and
especially with drainage. With the electrical, the sixth electrician
turned out to be efficient, competent and thorough; he fixed it. The
phone lines - we gave up. Some work; some don't. Drainage - water, from
rain and even the automatic watering system, pours into the embankment and
walk behind the house ano comes up under the house and stays there, which
will cause a host of Problems. The first year, which was still drought
conditions, there were one to two inches of water under the house up until
summer and there were thin cracks in the retaining wall. This year there
was water under the house until mid summer and some of the cracks are up
to 1/4". There are also hairline cracks in the interior walls of the
house, presumably from the settling that is taking place. (The house is a
"manufactured house" set on concrete pads.) Robert built a grate into the
porch decking and nailed screens onto the openings in the "apron" so they
can be left open for air circulation, which has helped.
We contacted Ms. Gaines to ask for help, or at least the name of a repair
person. The repairman she sent recommended installing "french drains."
We had no luck locating someone to do this. Since January, 1992 I have
made 37 long distance calls to Ms. Gaines (since it usually takes several
calls to reach her or receive a return call), regarding several problems,
but mainly trying to find someone to do something about the drainage.

This May we were notified by the county that the permit Mr. Pine purchased
to build the garage was expired (A). We called the county and the
inspector who came out "passed" the garage, but cited us because there are
three other additions for which Mr. Pine did not secure permits:
breezeway, covered porch, and "cabana" (storeroom). Futhermore, the
inspector said some repairs would be necessary to bring the additions up
to code.

The breezeway must be de -attached from the mobil and garage siding and
secured to the ground on proper footings. The posts rest on small
mortared rock pads on the surface of the embankment that is supported
by the rock retaining wall that is cracking from the drainage problem
and the fact that there is no footing under it and no "rebar" (sp?),
not even mortar smear behind it. The wall is under four feet, so -does
not require a permit. However, the wall holds back the embankment
that supports the posts that support the breezeway roof. If the wall
goes, so does the breezeway roof and part of the mobil. Behind the
cabana the wall is holding the embankment back. If the wall goes, the
embankment will slide into the cabana.
The covered porch must be anchored down to the deck surface and
below. Clips must be installed where the roof is attached to the
mobil. Safety posts and railing must also be installed.
The cabana needs some minor adjustments.
We did not know the breezeway and covered porch were not permitted. In
1990, when we first saw the property, we were told by a different realtor
that the cabana was not attached to the house, as this supposedly made it
okay that it was built without a permit. Apparently not. The property
passed escrow, our taxes were raised to reflect the appraised value, which
included these three additions, so it appeared all was well.
A neighbor, who is in the construction industry, recommended Roy Carver, a
general contractor, to do.the repairs. Mr. Carver walked around the
property with the inspector to learn what would be required. A copy of
his bid, for $9300 is attached (C). He explained that everything would
have to be dug by hand dpe to the rocky ground, which drives the labor
costs up. His bid did not NOT include repairing or replacing the rock
retaining wall, as we ha(:' not yet discovered there is no footing. I have
asked Mr. Carver for a bid to repair the rock wall,or to build a new wall
out of slumpstone beside it. The slumpstone wall should be less expensive
than repairing the rock one.
PROPERTY LINES -
From the beginning, Robert questioned where the property lines are. He
even asked if the property could be surveyed prior to escrow close. Ms.
Gaines said that Mrs. Pine stated she would "flag" the corners as she knew
where they are. The weekend before close (Mrs. Pine let us stay in the
house) Ms. Gaines walked around the property with us pointing out where
the lines would be in relation to the flags, which were marked with
ribbon:

Robert was considering having the driveway expanded and sloped away from
the house and garage. (It now slopes toward the house and garage.)
After these other problems cropped up, Robert decided to go ahead and hire
a surveyor Ms. Gaines recommended, Michael Mooney, at a cost of $300, to
survey the area around the house.
It turns out that our driveway is actually on three properties! The
driveway circles around the garage, down in front of the house and back
over to Provenza. This was actually presented as a feature by the first
realtors and Ms. Gaines. The northern property line slices through part
of the driveway and comes within 3' 1-1/2" of the corner of the garage.
The stake north of the garage that we were told marked the property line
is many feet on the other lot. The southeastern corner is 30+ feet above
the stake we were told is that corner, so where our driveway meets
Provenza again is actually on the lot below ours. The stake flagged as
our northwestern corner is actually the southwestern one, and the one
flagged as our southwestern corner is actually the southwestern corner of
the lot below ours.
I contacted Mr. Dean Deniz, of Nevadaco, Inc., which owns the lots North
and South of ours. Mr. Deniz is amenable to a lot line adjustment, so the
lines can be adjusted behind the garage and where the driveway meets
Provenza again. An equal amount of land from our lot would be allocated
to the other two lots elswhere on the property. I have heard the this
process can cost several thousand dollars.
We contacted Ms. Gaines since we thought, as our realtor, she had ensured
that all was correct and legal with the property. She said the cost for
the repairs and a lot line adjustment should come out of the other
realtor's "errors and ommissions." Robert and I both placed several calls
to find out what she had learned. Finally, Robert drove to her office.
The second time, when he parked out of sight, Ms. Gaines was in. Ms.
Gaines said she had contacted the other realtor, who secured Mrs. Pine's
address for us. She then contacted her attorney, who said I should write
to the prior owner, requesting she pay for the permits, repairs, etc. He
said, and Ms. Gaines has stated several times since, that the realtors are
not responsible; this has to be resolved between us and the prior owner,
since Mrs. Pine's Disclosure Statement states that all additions were
permitted and there were no problems with drainage.

By this time more than a.-inonth had elapsed since we were contacted by the
county.
Since then I have spoken to three attorneys in order to select one who
will represent us if we need to proceed with litigation. They all agreed
that first I should write to Mrs. Pine. They did NOT agree that the
realtors hold no responsibility in this, per California Civil Code (CC
SS2079-2079.1). There is also some question why escrow did not uncover
any of these problems.
Ms. Gaines offered to review my letter to Mrs. Pine, but she never
responded regarding the draft I faxed to her. I did not copy her on the
final version I mailed to Mrs. Pine on July 1 (B), along with a copy of
the Mr. Carver's bid.

Ms. Charlotte Jefford, Mrs. Pine's daughter phoned me on behalf of her
mother, stating they were unaware the three additions were not permitted
and knew of no drainage problem. She explained that her father was dying
of cancer while he built his home, so in retrospect she believed that the
additions were not permitted. Furthermore, Mr. Pine had left the cabana
unattached to the mobil since this way it would not have required a permit
in the county were he resided previously. She stated the property stakes
were placed by Cook Associates, who graded the driveway and sited the
garage. (A copy of the receipt Ms. Jefford provided is attached. (E))
Ms. Jefford said I should request a "special inspection" since this is
what Butte County Building Department advised her needed to be done, and
she offered to pay for it. A copy of her letter is attached (D).
Two weeks later I was able to get three days off work to come to Oroville,
so I applied for the Special Inspection. Scott Rutherford, of Butte
County conducted the special inspection on extremely short notice since I
had come so far. The findings were the same as the original inspector's,
plus by this time we had found that there is no footing under the rock
retaining wall. Mr. Rutherford's letter is attached (F). You will note
that we have 30 days to acquire permits, have plans drawn, repairs made
and inspected.
So here we are. We have invested our life's savings in a refuge that has
turned into Purgatory. We live separately because we are better able to
pay our bills from my income than we would be able to on what I could earn
in Oroville supporting just one household. We have some expensive repairs
that need to be done promptly and we do not have the money and we cannot
go further into debt. The property lines are unacceptable as they are and
THEY ARE NOT what we were told we were buying. And worst of all, my
husband is just as stressed out as he was here in the Southern California
rat race.
I ask again: Why do buyers need realtors if they are not required to
ensure there are no ugly surprises like this? Why have the escrow process
if major things like this can slip through? In our lives, and for most
consumers, these are major problems. Of course, we can sue everybody
involved in the purchase of the property, as everyone has suggested. We
should not have to sue. We should not be in this predicament in the first
place. However, since we ARE in it, all should be rectified for us
expeditiously. There should be some fund or insurance to protect
consumers from cases like•,this.
In rural areas, realtors should be required to check with the planning
department to find what has been permitted on a property they list.
Realtors should be required to validate the property lines. Escrow
companies should bear some responsibility, too. If such legislation does
not exist, it should be introduced. Otherwise, areas like Oroville will
never attract people -who have led productive lives and will add to the
local revenue base along with becoming active members in the community. I
have warned three of my friends from taking their early retirment money
and relocating to Oroville.
Along with the attachments I have referenced I am enclosing pictures of
the breezeway, covered porch, cabana, and property lines for clarification
(G).

Dear Mrs. Haley:
I have been advised to write to you regarding the above -
referenced property, which my husband and I purchased from you in
January, 1992. We purchased the property for my husband, Robert
E. Kongle, on the strong recommendation of his doctor that we
have a "peaceful refuge" for my husband to go to to preclude a
nervous breakdown, or worse. We purposely purchased through a
realtor to ensure that everything was legal and correct. My
husband is in worse condition than prior to the purchase due to
several serious problems that exist with the property. These
"problems" were not disclosed in your "Real Estate Transfer
Disclosure Supplement" form 109.5CAL (8-89), as follows:
1. Drainage - Since the sale closed we have been contacting our
realtor and others (as our phone bill will attest) regarding
the fact that there are one to several inches of water under
the mobil at all times, which causes settling, mildew, and
other problems. The existing drainage system does not
handle the water, rather seems to add to the problem.
"French drains" will have to be put in (dug by hand) to
carry the water out. A reputable contractor in the area,
Roy Carver, confirms that the amount of water under the
mobil indicates the problem would have always existed; it
would not have recently developed. Item ZI C 8 of the
Disclosure states there are no problems with drainage.
The following problems evolved when a county inspector contacted
us about Mr. Pine's expired permit for the garage. He stated
that the garage would pass a final inspection, but according to
Butte County records, the three additions following were not
permitted, contrary to items II C 4 and 5. Required repairs are
stated in my layman's terms.
2. Breezeway - This needs to be de -attached from the mobil and
garage wall (per the State of California's requirements) and
anchored to the ground to bring it up to code. The rock
wall,'supporting the posts is cracking badly. Either the
'footing is insufficient, or the reinforcement is inadequate.

3. Covered porch - This needs to be anchored to the ground so
the roof will not blow off in a strong wind and take the
mobil's roof with it. Also, rails on stairs and extra posts
are needed. These changes will bring the porch up to code.
4. Cabana (storeroom on back) - Apparently this will only need
to be permitted and inspected.
When these discrepancies came.to light we checked into other
areas of concern, as follows:
5. Property lines - From the beginning we questioned our
realtor about the exact location of the property lines. We
were told that you had "flagged" the corners, and our
realtor pointed out where the lines would be based on those
flags. We recently had the property surveyed, which
revealed that the property lines are NOT where the "flags"
indicated. The property line with the lot above us goes
behind the well house, then cuts down through our driveway
and within two feet of the corner of the garage. If the
other owner placed a fence on the property line, we would
have difficulty using the garage, part of our driveway would
be cut off from us, and we would not be able to drive around
the garage to the gate on the side. This property is in an
A5 zone, where the setback requirement for all structures is
five feet. Item II C 10 of the Disclosure says there are no
violations of the "setback" requirements.
The dirt road that circles behind the garage and yard is on
the property below us where it meets with Provenza. The
flags and our realtor indicated that the dirt road is
completely on our property.
The price that we paid for the property, its appraised value, and
our increased taxes included the additions and proper drainage,
as stated in your Disclosure, as well as the property -boundaries
as flagged by you and presented to us. Certainly it was
reasonable to expert that the driveway and dirt road are within
our property boundaries and all structures are a proper distance
from the property fines. This is what we were led to believe we
were buying.
I have been advised to write to you requesting you pay for the
permits and repairs. The attached bid by Mr. Carver was
submitted after he walked over the property with the inspector to
determine what repairs will be required to bring the property up
to legally -permitted status, as well as providing proper
drainage.

incorrect property lines and the violation of the setback
requirement with the garage.

I am writiog on behalf of my mother Ida Pine -Haley. Regarding our
conversation by phone last night, we certainly would cooperate in
resolving any problems or questions that have occurred since your
purchase of the Provenza property.
I am including a copy of the permit and other paid .bills for
drilling of the well, which the Public Healt� Dept. couldn't
find.
I have provided a paid bill from Cook Associates that did the
surveying and placed the stakes for marking the property lines.
He also preformed core samples. All of the paper work has been
sent to Lora Puge's office at ERA Realty in Paradise (916-872-
1722). I wish all that information be made available to you. The
building department has cleared the garage, so certainly they
wouldn't have approved it if there was any problems?
I have included as many paid invoices that may or may not have
some value to you. .
As I explained that my father was seriously ill during the con-
struction of this propertyf so we assumed all construction had
permits- Hind sight -Veils us that the breezeway, covered porch
and cabana didn't have permits. After talking to Ann in the
Building Department of Oroville, she indicated that a special
inspection can be requested by you for preexisting porches, etc.
She indicated that it would be $100.00 which we would pay for.
During our discussion last night I mentioned that I had crawled
under the mobile home looking for any water leaks before the
close of escrow. I didn't see any indication of water anywhere'
The Termite report, reported an old water stain by the front
door.That was caused by the rain before the front porch was
built.
I understand the"problem trying to get work done in a rural area.
There isn't much`election. I will try to get some names and
phone numbers for help.
I hope we can resolve the problems so the very pleasant location
can be enjoyable for both you and your husband.

Dear Mr. & Mrs. Kongle:
With reference to the above subject and your request for inspection of the covered
porch, cabana and covered deck at 129 Provenza, Oroville, the inspection was
made July 23, 1993.
The additions were constructed by the previous owner without permits and in-
spections from this office, so we were not able to perform the required inspect-
ions during construction. We therefore made a reasonable visual inspection,
without going on the roof, under the building, or in the attic and found the
additions appear to conform to the intent of code requirements, except for the
following items which must be done or resolved:
1) Provide Environmental Health Department approval.
2) Provide conforming stair rails, guardrails and intermediate rails
throughout.
3) Verify adequate piers and footings for covered porch, deck and cabana.
.4)- Nail siding on cabana properly.
5) Verify electric is properly installed and fused.
6) Provide drainage away from mobilehome.
7) Detach covered porch and deck roofs from mobilehome and support
independently.'',
8) Although a retaining wall less than 4' in height from bottom of footing
to top of wall does not require a permit, the retaining walls at the
front of the mobilehome are collapsing and should be repaired.
9) Comply with any items identified in plan check.
This inspection by the County of Butte does not act as a guarantee or warranty
as to the internal soundness of said additions.
