At the tagular Board of Supervisors' hearing held August 18, 1987, the
Board initiated an amendment to the Gunn Development Agreement,. With
the applicant's concurrence, the Board had suggested the removal of
Condition 8m, The conditi6h reads "Applicant to pay a pro rata share
toward future installation of a flashing yellow light at the
y p d Pentt Road," The condition was drafted
by theecgoardoin resPonse9toatestiino;iy at public hearings held in 1984x,
Residents in the neighborhood expressed concerns that additional
traffic generated by the store may cause the Pentz Road/Highway 191
intersection to become unsafe. Residents suggested that some form of
traffic control be installed in, order to alert drive:rs on both roads to
the presence of the intersections thei.aby reducing safety haitards.
As the Planning Corr4nission is aware, Public Works and Caltrans have
been contacted numerous times concerning
the requirement for
installation of a light. Neither agency suppor,s the condition or aii

Government Code Sections 65867.5 and 65868 establish ptocedures for

At the regular Planning Commission hearing of July 8, 1987 additional

by the Board of Supetvisors in 'response to testimony at the public
hearing. Residences in Central: Butte expressed concerns that
additional trafficgenerated by the store may cause the Pentz
Road/highway 191, intersection to become unsafe. They suggested that

both roads to the, presence' of the interseution, thereby reducing

Public Works and Caltrans have been contaated in prior years' concerning
this condition: Neither agency supports the installation of a flashing
yellow light or other traffic control devices, Because the applicant
is unable to meet this condition; the 'Board of Supervisors determined
.January 20 1987 that the Development Agreement could be modified to
eliminate the requirement. for the ,flashing yellow light Their only
stipulation was that the applicant concur with the amendment (:in
writing) and meet the remainder of the Development Agreement

GUNN DEVELOPMENT AGREEMENT

July 9` 1986
,A development agreement to allow a market, restaurant and
gas pumps on AP#41-12�-76, (now AP041-12-102) was approved
by the Board of Supervisors on June 5 1989.
The agreement, stipulates that the County review it
annually until 1994. Applicant must demonstrate "doid
faith" compliance
The, store and restaurant have been completed and open for
business for some time now. A review of 4 -he' site July 8,
1986 indicates that landscaping has not yet been installed
along Highway 191. Not all of the landscaping in. .front of
the building is in good condition (condition 8'k)
Two freestanding signs totaling approximately 26 square
feet are located at the northwest property cornier.
Condition 8L limits freestanding signs to 10 square feet'.
Applicant has not paid a pro --rata share towards
installation of a f ,4shi:ng light at Pentz and 99. ne
Public Works Director indicated that a flashing light on
Pentz would be a Safety hazard. Cars stopping on Pentz
assume cars on 191 viil stop and its :safe to cross.
Highway, 191 will not havea light, Department of Public:
Works recommends the condition be removed4
r4odification of the development agreement is a project
requiring publishing and a publi.0 hearing. The Board
would have to adopt. an ordinance to authorize the change4

towards future installation of a flashing yellow light- at the
intersection if Highway lye. and Pentz Road." The condition Was penned
by the Boarti of Super�tisors in response to testimony at the public
hearing. Residence in. Central Butte expressed' concerns that
additional traffic generated by the store may cause the Pent2
Road/Highway 1:91 intersection to begt,;-s unsafe They suggested that
some form of traffic control be installea in order to alert drivers on
both roads to the presents of the intersection, thereby reducing
safety hazards,
Public Works and Caltrans have been contacted in prior years concerning
this condition. Neither agency s<<pports thenstallction of a flashing,
yellow light or other traffic control devices. Because the applicant
is uinable to meet this condition, the Board of Supervisors determined

January 20, 1987 that the Development ;Agreement could 'be modifiod to
eliminate the requirement for the flashing yellow ".fight. Their only,
