Based on the photos submitted with the complaint., it appears that the problem centers around.a drainage issue rather than an illegal diversion and use of water. Since this agency has no authority over problems strictly related to drainage, we are unable to further process this complaint. You should be aware, however, that if your intention -is to divert water to storage during times of high flow for use during times of low flow, you will need to file an application with this office. You would also need to refrain from diverting storage waters until such time that -'a permit has been issued. from this office. With regard to the drainage issue, we would like to make you aware of a civil law rule.governing the right of a landowner to have the diffused surface water that falls on his land drain therefrom upon the'land below. The State Supreme Court stated.in 1873 (at 46 Calif. 351). that: The prevailing doctrine appears to be that when two fields are adjacent and one is Lower than the other, the owner of the upper field has a naturaZ easement to have the water that falls upon his Land fZow-off from the same upon the field below, which is charged with a corresponding servitude. This rule has since been refined into a legal principle which has been. stated as: Every'Zandowner must bear the burden of receiving upon his Land the. surface water naturally falling upon Land above it and naturally flowing to it therefrom, and he has the corresponding right to haves the surface water naturally falling upon his;Zand or naturally coming upon it, fZow-freely therefrom upon the Zower`Zand adzjoining, as it would flow under natural. conditions. From these'rights'and. burdens, the principle follows that he has a ZawfuZ"-right'.to complain of others, who, by interfering with natural conditions, cause such surface water to be discharged in greater quantity or in' a different manner upon his Zand, than would occur under natural conditions. When w=ork in a flowing stream is unavoidable, the entire streamflow shall be diverted around the work area by a barrier, temporary culvert, and/or a new channel capable of permitting upstream and down- stream fish movement. Construction of the barrier and/or the new channel shall normally begin in the downstream area and continue in an upstream direc- tion, and the flow shall be diverted only when con- struction, of the diversion is completed. Channel bank or barrier construction shall be adequate to prevent seepage into or from the work area. Channel banks or barriers shall not be made of earth or other substances subject to erosion unless first enclosed by sheet piling, rock riprap, or other protective material. The enclosure and the supportive material shall be removed when the work is completed and the removal shall normally proceed from downstream in an upstream direction. 12. Temporary fills shall be constructed of nonerodible materials and shall be removed immediately upon work completion. 13. Equipment shall not be operated in the lake or its margin except during excavation and as may be neces- 15. Preparation shall be made so that runoff from steep, erodible surfaces will be diverted into stable areas with little erosion potential. Frequent water checks shall be placed on dirt -roads, cat tracks, -or other work trails to control erosion. 16. Wash water containing mud or silt from aggregate wash- ing or other operations shall not be allowed to enter a Iake or flowing streams. 17. a) A silt catchment basin shall be constructed across the stream immediately below the project site. This catchment basin shall be constructed of gravel which is free from mud or silt. - b) Upon completion of the project -and after all flowing water in the area is clear of turbidity, the gravel along with the trapped sediment shall be removed from the stream. 18. If operations require moving of .equipment across a flowing stream, such operations shall be conducted without substantially increasing stream turbidity. For repeated crossings, the operator shall install a bridge, culvert, or rock -fill crossing as specified in comments below. 19. If a stream channel has been altered during the opera- tions, perations, its low flow channel shall be returned as nearly as possible to its natural state without creating a possible future bank erosion problem, or a flat wide channel or sluice -like area. If a lake margin has been altered; it .shall be returned as nearly as possible to its natural state without creating a future bank erosion problem. The gradient of the streambed or lake margin shall be as nearly as possible the same gradient as existed prior to disturbance. 20. Structures and associated materials not designed to withstand high seasonal flows shall be removed to areas above the high water mark before such flows occur. 21. No debris, soil,- silt, sand, bark, slash, sawdust, rub- bish, 'cement or concrete or washings thereof, oil or petroleum products or other organic or earthen material from any logging, construction, or associated activity of whatever nature shall be allowed to enter into or placed where it may be washed by rainfall or runoff into, waters of the State. Glander : Your letter of March 23, 1981, has been referxed to me by Mr. Caswell. I do not know -the source of your information, but it is not complete. I believe that a full disclosure will indicate no permit is necessary. At the "rear", or easterly end, of Mr. Caswell's property is a drain- age creek, which begins north of Kusel Road and continues for a mile-: or so. Mr. Caswell's neighbor, Max Hecker, has failed and refused to clean, dredge or otherwise maintain that portion of the creek which crosses his property. As a result of Mr. Recker's non -action, the cree�. overflows at a point upstream from Mr. H.eckerIs land, crosses Hecker Is land, and innundates Mr. Caswell's. pasture. Mr. Caswell has only taken such action as is lawfully right, in order to protect himself from his neighbor's misfeasance. Additionally, two employees of Butte County Public Works inspected Mr. Caswell's property on September 4, 1980, and advised him to take the action he has taken. It is my opinion that Mr. Caswell's work, specifically authorized by Public Works, does not in fact "obstruct a drainage course", and .ther efor e requires no permit. Mr. Caswell and Mr. Hecker are involved in civil litigation regarding the work suggested by Public Works. Their case is to be heard shortly.
