For your protection, you should be aware that as "owner -builder" you are the responsible party of record
on such a permit. Building permits are not required to be signed by property owners unless they are personally
performing their own work. If your work is being performed by someone other than yoursel4 you may protect
yourself from possible liability if that person applies for the proper permit in his or her name.
Contractors are. required by law to be licensed and bonded by the State of California and to have a
business license from the city or county. They are also required by law to put their license number on all permits
for which they apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you
should be aware of the following information for your benefit and protection: _
0 If you employ or otherwise engage any persons other than your immediate family, and the work (including
materials and other costs) is S300 or more for the entire project, and such persons are not licensed. as
contractors or subcontractors, then you may be an employer.
0 If you are an employer, you must register with the State and Federal Governments as an employer and you are
subject to several obligations including state and federal income tar withholding, federal social security tares,
workers compensation insurance, disability insurance costs, and unemployment compensation contnbutions.

Code Violation letter from the Building Division dated 26 Feb 93.
a. The third trailer was removed as soon as I found out it was
there and the rain and wet ground allowed. It was moved in without
my knowledge by the lady in #2's son.
b. My tenants: both have been there ten (10) to eleven (11)
years. The one in #1 has worked ,for Robinson's Construction all that
time.
The people in #2. The man was hurt in an accident and has heart
trouble an can't work. His wife works at the olive plant cannery when
they have work for her. If not, she has to go on the County Assistance
program. I charge them very low rent and furnish water, electric and
garbage. If the county kicks them out they can put them in a local
motel for $260.00 a week (makes sense, doesn't it.???). After living
there 10 to 11 years the lady cried when I told her she might have
to move. Of course, the Planning and Building Commission doesn't have
to deal with that.
2. I now know I made a mistake 11 years ago when the property
was zoned C-1 which allowed two units on the property. I thought I
only needed permits to install the electric and the septic. I just
didn't know.

On August 17, 1981, Mr. Rhoads made an application to the building department
for a mobile utilities permit. On August 19, 1981, the building department
determined that the parcel was created in August, 1963, with less than a 60
ft. access, and, therefore,' determined that it may be an illegally created
parcel. Pursuant to Chapter 209 Section 160 of the Butte County Code, if
the building department determines that a parcel may be.created illegally,
they cannot issue a building permit until a certificate of compliance is
obtained, or proof is provided that the property was created legally. In
order to obtain a certificate of compliance, a property owner must make an
application for determination. The charge for the application is $b100.00.
Prior to making the application for determination, Mr. Rhoads talked to
Stuart Edell of this office, to determine what the public works requirements
would be at the time .his lot was created. At that time, .he was told he would
need a 35 ft. deeded easement to a county road or state highway. Mr. Rhoads
made the.application for determination, paid his $100.00 application fee, and
at the subdivision violation committee it was determined that his property
was created in violation of the Butte County Code and Subdivision Ordinance.
At the time it was created, his lot could be .created with a 35 ft. deeded
easement to a county road or state highway. The existing access road is 41
feet wide, but Mr. Rhoads only has a deeded right to use 16 feet of it.
Therefore, a conditional certificate of compliance was issued, requiring he
prolride a 35 ft, wide deeded easement to the property from a county road or
state highway. Mr. Rhoads, in his letter to the Board of Supervisors, filed
November 6, 1981, is appealing this requirement.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the.
special conditions set forth below: Edgar O. Rhoads is hereby granted a Use Permit in
accordance with application filed: May 13, 1993 to allow a two unit mobile home park
on property zoned M-1 (Light Industrial), located on the south side of Odie Way,
approximately 210 feet east of Lincoln Boulevard, 24 Odie Way, Oroville.
1. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the . date of receipt of the countersigned . permit by the
Permittee, the permit shall become null and void and reapplication and a
new permit shall be required to establish the use.
4. The terms and. conditions of this permit shall run with the land and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors,
and assigns of the Permittee.
SPECIAL CONDITIONS:
1. Applicant shall meet the Fine Safe Regulations of Public Resources Code 4290.
2. Applicant shall comply with Environmental Health Department regulations.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances, and regulations.
NOTE: Minor changes may be approved administratively by the Director of
Development Services upon receipt of a substantiated written request by the
applicant. Prior to such approval, a verification shall be made by each
Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally
approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
I hereby declare under penalty of perjury that I have read the foregoing
conditions, that they are in fact the conditions which were imposed upon the granting of
this use permit, and that I agree to abide fully by said conditions.
