The Department of Development Services has reviewed your inquiry about locating a towed -vehicle storage facility on a
parcel in the "M-2" zoning and "Industrial" general plan designation. The proposed use would be located on a portion of the
above -referenced property, that portion bound by Commercial Way to the east, Titan Way to the west, Industrial Way to the
south, and the northerly property line.
The M-2 zone allows any use permitted in the M-1 district pursuant to Chapter 24-180(a)(1). The M-1 zone (Chapter 24-
175(a)(4)) allows similar uses including auto repair and auto body shops, public utility service yards, and truck repairing and
overhauling. The proposed use of a `towed -vehicle storage facility' is not explicitly listed.
The site is 750± feet east of the railroad tracks/Oroville City limits, 1000± feet north of Kusel Road, 1650± feet west of
Lincoln Blvd., and 650± feet south of Ophir Road. The nearest residential zoning is 1300± feet south of the site.
Chapter 24-180(c)(5) states that any use permitted:
which because of operational characteristics specific to the particular business or proposed location, is found by the
director of development services, to have the potential to negatively impact adjoining properties, businesses, or
residents. Generally speaking, any M-2 use will probably require a use permit under this section if the use or
structure will be located less than one hundred (100) feet from the boundary of a zone that allow residential uses.
Pursuant to Butte County Code Chapter 24-180(c)(5), the Director of the Department of Development Services has
determined that the proposed use, at the location described herein and as illustrated on the attached site plan, is allowed as a
permitted use. Uses not described herein may require additional permitting. This determination does not constitute a building
permit, or the granting of any other permit or license required by local, state, or federal agencies with jurisdiction.
