I'm also mailing the originals. 12 Mark Michelena Associate Planner r Memorandum TO: Jo Sherman, Planning Manager FROM: Mark Michelena, Associate Planner DATE: December 16, 2004 SUBJECT: Oroville Enterprise Zone Review — 036-270-035; 5970 Lincoln Blvd ATTACHMENTS: Map Department of Development Services Planning Division I reviewed the proposed request and discussed the uses with our department and it was determined the indoor/outdoor boat construction/repair would a permitted use (no use permit required) in the M-1 zone. The issue ,is with the caretaker residence. According to the building records, a single family dwelling was built on the property back in 1977 when the zoning was Agricultural Residential (A -R) and Light Commercial (C-1). Since that time the parcel was rezoned (2/28/84) to Light Manufacturing (M-1) which does not allow for a single family residence. The existing single family dwelling is considered a legal nonconforming use. The zone would not allow a second residence, even for a caretaker residence. If the manufacturing business is established on the property, the existing dwelling would be classified as the caretaker facility.. I also discovered when I reviewed the enclosed aerial photograph, there appears to be an access road that runs on the old railroad parcel (now owned by the City of Oroville). It will need to be determined if an encroachment permit was granted for access onto Ophir Road. Also, does the property owner have an easement to use the City's parcel?
