We are in receipt of your letter of August 14 2006 regarding the above referenced billboard project.
As you note, this property in located in the Enterprise Zone. We have reviewed your request that the
County, "continue the processing of the above stated application." After review of the Butte County
Code sections detailed below (copy here attached), we have concluded that it would be contrary to
the October 1, 1991 Memorandum of Understanding between the City of Oroville and Butte County
and contrary to the Butte County Chapter 3 Codes listed below for the County to entertain
processing and/or issuance of a building permit for this project.

Butte County Chapter 3 Code:
Section 2-134 Purposes.
The purposes of this article are to implement the provisions of that certain
memorandum of understanding regarding enterprise zone projects entered into by
and between the County of Butte and the City of Oroville and dated October 1,
1991, as said memorandum of understanding may be amended from time to time,
and specifically to coordinate and facilitate new industrial and commercial
developments in the unincorporated area of the Oroville Enterprise Zone. (Ord. No.
3016, § 1, 6-23-92)
Section 2-135 Processing of project applications.
(a) Planning commission functions. Notwithstanding any other provisions in this
Code to the contrary, the City of Oroville Planning Commission is appointed to act
in lieu of the County Planning Commission and to perform all of the duties thereof
as 'to all industrial and commercial projects within the unincorporated area of the
Oroville Enterprise Zone as it is not established by the State of California and as
the boundaries thereof may hereafter be lawfully amended. For purposes of this
section, "projects" shall include development permits, use permits, and variances.
Appeals from actions of the Oroville Planning Commission pursuant to this section
shall be made to the board of supervisors in the same manner and subject to the
same county fees as appeals from actions of the Butte County Planning
Commission.
(b) Project application procedures and standards. Such project applications shall be
filed with the City of Oroville, subject to the fees and adopted procedures and
standards of the city as they'now exist or may exist.at the time of such application.
Such projects will be subject to city design review requirements and improvement
standards. However, the zoning regulations applicable to all such projects will be
those specified in the applicable county zoning ordinance, and county sewage
disposal requirements shall apply, except as to those projects which connect to a
publicly -owned, maintained and operated sewage system, in which case the
requirements of the. public entity which owns, maintains and operates the sewer
system shall apply.
(c) Projects to which this section is not applicable. The Butte County Planning
Commission shall retain its present authority as to all other projects within said
area, including all residential projects and all general plan, zoning and specific plan
amendments and enactments. Applications for such projects will continue to be
processed in accordance with the procedures and standards of the County of Butte.

Dear Mr. Durling; .
Curre).Aly the City is working on updating its sign regulations to not allow the future
installation of any billboards and feels that processing this application will be detrimental
to the future of the City. Being that his location is not within the City of Oroville, but the
Enterprise Zone, the City feels that i.f we were to sign off ou the application we would be
further contributing to a blighted situation.
Therefore, the City is deferring back to Butte County Planning Division to continue the
application process on the above stated project.

Hello Steve,
Thank you for allowing us to review this application for a new billboard on SR 70 at Palermo Road
Although this proposed location. is not within the City's sphere of influence, the City is very much opposed to
construction of more billboards at our "gateway." In fact, there is some local support for a proposal to require that
existing billboards in the City should be amortized and removed.
Please require all billboard applicants to provide you information about the location of all existing signs (on both
sides of the same roadway) within at least one mile of the proposed new location. Information about "saturation"
may support denial of this application.

Please see the attached scanned documents as reference.
Today Lynda Upthegrove was directed to us by the City of Oroville Planner (Jake). The attached August 14 letter
from Eric Teilman essentially tells the applicant that the City is no longer issuing billboard construction permits
within the Oroville Enterprise Zone, because they are in the process of re -drafting their zoning code to restrict the
building of new billboards. By their attached letter of August 14, the City is thus, "deferring back to the County" for
any further action on the request for a building permit for the sign. Our Chapter 3 Code (see below) would seem
to preclude any further action on our.part in this regard. Also attached is an e-mail comment from the City on a
billboard project (UP 06-13) that we are processing for the same applicant on Palermo Road (not within the Oro.
Enterprise Zone) that further explains the City's views.
Essentially, this applicant is asking the County to issue the building permit, since the City says they won't. I told
her that in my assessment it was unlikely that we would. Interestingly, Carl is processing GPA/ZC 06-01 on the
parcel adjacent to the,current sign application (at 5929 Lincoln Blvd., APN 0787100-048). The ZC is M-1 to MDR.
A sign adjacent to a residential zone would trigger the County's sign ordinance.

OWNER -BUILDER INFORMATION
An application for a building permit has been submitted in your name listing yourself as the builder of the property improvements specified.
For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a permit. Building permits are not required to be signed
by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from
possible liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by
law to put their license number on all permits for which they apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should be aware of the following information for your benefit and
protection:
° If you employ or otherwise engage any persons other than your' immediate family, and the work (including materials and other costs) is $500 or more for the entire
project and such persons are not licensed as contractors or subcontractors, then you may be an employer.
° If you are an employer, you must register with the state and federal government as an employer and you are subject to several obligations including state and federal
° income tax withholding, federal social security taxes, workers/ compensation insurance, disability insurance costs, and unemployment compensation contributions.
There may be financial risks to you if you do not carry out these obligations, and these risks are especially serious with respect to workers' compensation insurance.
° For more specific information about your obligations under federal law, contact the Internal Revenue Service (and, if you wish, the U.S. Small business
Administration). For more specific information about your obligations unders state law, contact the Department of Benerit Payments and the Division of Industrial
Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform thier work personally or through thier own employees,
without a license contractor or subcontractor, only under limited conditions.
A frequent practice of unlicensed persons prefessing to be contractor is to secure an "owner -builder" building permit, erroneously implying that the property owner is
providing his or her own labor and material personally. Building permits are not requir3ed to be signed by property owners unless they are performing their own work
personally.

NOTICE TO BUILDERS
Before your building permit can be issued, your plans must be checked for compliance with the California Building Codes. In
addition, your plans are routed to other regulatory entities including but not limited to Planning, Public Works, Environmental
Health, and the California Department of Forestry for their clearances and approvals. There are some things you can do to
expedite your permit:
0 Make sure your application is complete.
O Be responsive to requests from County departments for any additional materials or requirements.
The Building Division places its highest priority on processing building permits as quickly as possible and each day that passes
without a complete application adds to processing time.
Every permit issued by the Building Official shall expire and become null and void if the work authorized by such permit is not
started or completed within one year from the date of issuance of such permit. A permit may be renewed (for a fee) prior to
expiration an indefinite number of times, provided construction progress has been documented by the Building Division during
each year during scheduled inspections. No changes may be made in the original plans and specifications for such work. In
order to reinstate action on a permit after expiration, the permittee shall pay a new full permit fee and additional plan checking
and documentation may be required. Upon completion of work covered by this permit, please contact this office for final
inspection. As a reminder to you, it is illegal to occupy this building or any portion of the building for which this permit is
issued without a final inspection.
EXPIRATION OF PERMIT APPLICATION AND REFUND POLICY
Application for which a permit has not been issued will expire one year after date of application.
Refunds may only be made upon written request by the person who originally paid the fees. Refunds for permit applications
(not yet issued) must be requested within two years from the date of fee payment. Fees paid at the time of application are
for Plan Check and administration. The Plan Check portion of fees is refundable only if the permit is cancelled or withdrawn
before any plan checking is done. Building Division costs will be deducted prior to authorizing a refund and a charge of
$54.99 to process the refund application will be assessed. Refunds on permits (issued) may be requested prior to the expiration
of the permit, provided no work has been done pursuant to the permit. An Inspection may be required (and deducted from any
refund amount) to determine no work was done.

Special Inspections — California Building Code section 1701: In addition to the inspections
required by Section 108, the owner or engineer or architect of record acting as the owner's agent
shall employ one or more special inspectors who shall provide inspections during construction
-on the types of work listed under Section 1701.5. The special inspector shall be a qualified
person who shall demonstrate competence, to the satisfaction of the building official, for
inspection of the particular type of construction or operation requiring special inspection.
Duties and Responsibilities of the Special Inspector:
1. The special inspector shall observe the work assigned for conformance with the approved
design, drawings and specifications.
2. The special inspector shall furnish inspection reports to the building official and the engineer
or architect of record. All discrepancies shall be brought to the immediate attention of the
contractor for correction, then, if uncorrected, to the proper design authority and to the building
official.
3. The special inspector shall submit a final signed report to the Butte County Building Division
stating whether the work requiring special inspection was, to the best of his or her knowledge, in
conformance with the approved plans and specifications and the applicable provisions of this
code.
4. The special inspector shall advise the contractor that Butte County Building Division
inspections cannot be delegated to him or her, so inspections must also be made by the Butte
County Building Division.
5. Any change in special inspection firms made after permit issuance shall be approved by the
Butte County Building Division prior to the new firm performing any inspections.
6. Special inspections are in addition to the regular inspections performed by the Butte County
Building Division. Butte County inspection approval and sign off is not to be construed as
authorization to proceed with work which obscures, covers or otherwise prevents proper special
inspection.
