Oroville; CA 95966 Re: Response to Complaint Letter — 3041 Oro Bangor Hwy., Oroville Dear Ms. Tobias: Thank you for your patience in allowing us time to research the records regarding your letter of complaint of "poorly done work on Equilla Stovall's home at 3041 Oro Bangor Hwy" dated 01/02/04. Unfortunately, the loan records from 1988 through 1990 are no longer available. We were able to review the building permit file and a more recent (2000) file provided by Connerly and Associates. Findings from these files are summarized with Exhibits A -D attached to this response letter. The facts we were able to ascertain from the Building files are as follows: • July 16, 1980 Building permit taken by Walter Luczak Jr. (contractor) for re -roof (5 sq), install plumbing vents (3), replace interior doors. This work was inspected by a Butte County Building Inspector and deemed complete on July 23, 1980. • August 28, 1988 Equilla Stovall was notified by a letter from Connerly and Associates that she qualified for the Emergency Home Repair program. In that letter she was asked to obtain contractor estimates for repairs the staff determined to be most urgent. A list of contractors that had worked with the program in the past was supplied along with the letter. The letter also stated, "You may contact any other contractors you feel will do a good job, provided they have a license." Mrs. Stovall was asked to supply three estimates for the six (6) items outlined by Friday, September 16, 1988. (Exhibit A) • March 27, 1989 Connerly and Associates requested a written inspection report from the County as they were requesting permission from Housing and Community Development (HCD) to make a $20,000 loan under the current grant. • February 7, 1989 Equilla Stovall applied for a building permit for re -roof, gas wall heater and electrical clean-up. Mrs. Stovall completed an "Owner -Builder Verification" indicating she was acting as her own contractor. Subsequently, on 08/29/89 the Building Inspector for Butte County inspected and determined the roofing looked properly installed and indicated the remainder of the work applied for on the permit still needed to be done. • April 26, 1989 Equilla Stovall was sent an inspection letter from Public Health indicating the repairs or corrections required that needed to be done to rehabilitate the dwelling. (Exhibit B) • July 18, 1989 Equilla Stovall applied for a building permit to relocate vent pipe, reside house, foundation work, replace steps. Records indicate this permit was not issued, meaning work was never authorized to begin. Notes in the building file indicate: o Mrs. Stovall again filled out an "Owner -Builder Verification" to act as her own contractor but showed her intent to contract with Kevin Jones, and unlicensed contractor to do the work. Records show State Farm insurance submitted information on November 29, 1989 indicating that Mrs. Stovall's homeowner coverage covered Worker's Compensation insurance for employees including but not limited to painters, roofers, remodeling and repair contractors, chimney sweeps, etc. Mrs. Stovall was notified the Owner Builder verification information was not valid with her statement to hire Kevin Jones. Records indicate Mrs. Stovall was called on January 5, 1990 and advised of 4 Fannie Tobias 14 April 2004 Page Two this as well as need to supply sufficient plot plan and building plan information. Notes attached to this building permit application indicate: ✓ (no date) "Stovall, unlicensed contractor, ordered off by Connerly, 2 complete plans, $7,000, Carl Moore" ✓ March 19, 1990 "Ward Connerly advised we needed complete plans and new contractor must apply for new permit and we can refund other permit to Stovall. Connerly to advise contractor". ✓ April 16,1990 "Tanga/Connerly" Going to job with another contractor to try to straighten out" Facts we were able to glean from the file sent to us from Connerly and Associates are as follows: • . 08/21/00 Butte County Central Collections notified Connerly and Associates that Fannie Tobias had notified County that Equilla Stovall had passed away (6/1/2000) and had provided a copy of the death certificate. At that time notes indicate $800 or eight (8) months of payments were delinquent. • 12/15 Note indicates, "daughter is living in home — paying rent, children (7) inherited property". • Connerly began working with heirs on an "assumption to convert to rental dwelling". Application was sent 12/18100. • 9/17 Note indicates, "Fannie does not live in property, sister (Helena) does, home is in Fannie's name. She still has assumption application, says it is very "complicated" and she will mail it in as is and I'll [Connerly] get back to her with what we need." • 11/7101 Letter to Fannie Tobias indicating information needed — Signed "Information Release Authorization" for all persons on title, Source(s) of income for all persons on title, "Tenant Income Verification" and "Tenant Information Release authorization" — Helena Heard. There was also a reminder the rules governing rental properties and owners of rental properties were quite different than owner/occupied units with a strong recommendation that the option of refinancing with a conventional lender be explored. (Exhibit C) • 09/02/02 Letter to Connerly and Associates from Fannie Tobias. (Exhibit D). • 9/25/02 Connerly note indicates staff attempts to work with the family for almost 2 years to get them to assume Equilla Stovall's loan. Options of refinancing and assumption were discussed. The family did not like the fact that the original 0% loan would be converted to an interest loan as an investment (rental) property. Staff was unable to get Income verification on each of the heirs with a vested interest in the property. Family was now requesting a reduction of the loan balance. Decision was made to recommend foreclosure. Summary of findings in response to complaint: Rolled roofing (901b), as verified by our Building Official has a short life expectancy and it is reasonable to expect that it would need to be replaced every 2-4 years (compared to shingle roofing of 230lbs that has a 10-15 year life). Your letter states,"repairs have been done 3-4 times since the original rolled roofing was put on". We can only assume you mean since the building permit for roofing finaled on 8/29/89 as there were no other permits taken for additional roofing, so any other repairs were done without obtaining the required permits. It also appears that other work you are disputing also was done without benefit of permits, so the Building Department did not have an opportunity to review the quality of work or pass it upon inspection and there are no records of this work on file. File information clearly shows that Mrs. Stovall was advised to select a licensed contractor to perform the required work. Mrs. Stovall clearly at times acted as her own contractor and file information indicates that although she was told work must be done by a licensed contractor she attempted to have work done by Kevin Jones, an unlicensed contractor. Connerly and Associates reports that Mrs. Stovall would have had discretion to authorize and release payments for work she deemed complete. An attempt was made to get records of payments from the Butte County Title Company, but we were advised that after seven years the records were purged. 0) Fannie Tobias 14 April 2004 Page Three The file from Connerly and Associates picks up in 2000. Loan payments were delinquent, the County and Connerly were made aware that Mrs. Stovall had died, and the heirs were renting out the home. The record shows that Connerly worked with Fannie Tobias in an' attempt to get the loan assumed as a rental and encouraged exploring conventional financing. Staff at Connerly and Associates who worked with the family recall there were no complaints regarding work on the home during the entire period that assumption of loan converting it to a rental was in process until the letter of September 2, 2002. The letter of September 2, 2002 seeks a reduction of the pay-off amount due to allegations that "contractors" chosen by Mrs. Stovall were dishonest.. It appears that a complaint was appropriately made to the State Contractors Board, but it is unclear why this wasn't pursued to compensate for the allegations made against the "contractors". Again, the County's position is that Mrs. Stovall chose the contractors to work on her home and that Connerly intervened when it was discovered that Kevin Jones, an unlicensed contractor was performing work. On October 7, 2002 a recommendation was made to the Butte County Loan Committee to foreclose on the property and a copy of the September 2, 2002 letter was attached. On October 22, 2002 the Butte County Loan Committee approved the recommendation to foreclose. On November 13, 2002 a certified letter was sent to Fannie Tobias, Catherine Harris and Florence Young "Official Notice of Foreclosure Action". The note balance was paid in full February 12, 2003. There is no documentation, of any complaints other than those noted in the building file of Kevin Jones (an unlicensed contractor) being ordered off the job by Connerly and Associates and Connerly working to "straighten things out". Notes indicate that Connerly and Associates worked with Mrs. Stovall to resolve this issue when it arose and disbursement of payments which required Mrs. Stovall's authorization would indicate the work proceeded under her oversight and to her satisfaction. The Stovall heirs benefited from the 0% interest loan in place from the time Mrs. Stovall died on 611/2000 until the note was finally paid off on 2/12/03, over 31 months of interest free loan while the assumption of the loan and conversion to rental property or conventional financing to pay-off the loan was explored and the home was utilized as a investment rental. Please be assured that this matter was reviewed thoroughly. Due to the facts presented above, the fact that there are no building permits on record for the rehabilitation work, and the family benefiting from 31 months of interest free loan, we consider this matter closed. The inspection was made as Part of the rehabilitation program currently underway in th,_- El Medio area south of Oroville. The dwelling is a single story structure with wooden siding, composition shingle roof., concrete slab.at north end, pier, and po--t south end, served by community watery natural gas, electricity and private sewage disposal system. The house exhibits weak and sloping floors in living room and bedroom off living room. There is ground to wood contact on north side. Water heater lacks proper discharge line on temperature -pressure relief valve, lacks proper flue and adequate combustion air. Roof is deflectincj badly on north end. Dwelling lacks proper roof and underfloor.vents. Sliding door and front door laces: proper stairs. Exposed unprotected wiring evident in kitchen and in west exterior wall. In order to rehabilitate the dwelling under this program the following repairs or corrections are required. 1. Complete all corrections or repairs as listed in the Butte County Emergency Home Repair Program letter to Mrs. Equilla Stovall dated August 29, 1988 (Attached). 2. Provide an adequate underfloor support system by adding Piers and girders as required and replacing all damaged materials.- Remove and replace all damaoed or deteriorated floor joists, sub -floor and. floor covering. Provide. adequate underfloor ventilation and crawl space.' Equilla Stovall April 26, 1989 Page 2 3. Strip walls to frame and provide bracing, studding, etc. as necessary. Replace damaged or deteriorated . materials in walls and make all exterior walls weathertight. Insulate walls to R-11 standards. 4. Flake all doors and windows ooeriabie and weathertight. 5. Provide an adequate roof support system by adding rafters, ceiling joists and bracing_ as required. Remove and replace roof covering replacing all damaoed o- deteriorated sheathing. Provide adequate ventilation and insulate -to R- 19 standards. 6. Cleanup electrical wiring; eliminate all deteriorated or damaged wiring, outlet boxes and fittings; unprotected wiring; open or exposed splices, etc. Provide additional outlets as, needed. 7. Provide adequate plumbing fixtures with effective traps and vents. Provide proper supports for all drain waste and vent piping. Provide proper leak free plumbing for all.drains, waste, vent, water and gas lines. 8. Remove and replace cas heater in living room. Verify that wood stove in bedroom is properly installed. 9. Provide adequate combustion air and proper flue for water heater, provide discharge line fortemperature--pressure relief valve. 10. Provide wood to ground clearance on north side of house (newest portion). Regrade lot to divert water from slab and side of house. 11. Provide proper exterior siding on north end of house (newest portion). 12. Provide proper stairs for kitchen and living room doors, and sliding door in bedroom. 13. Provide smoke detectors. The following items, although. not required, are strongly recommended to effectively prolong the useful life of the dwelling, and/or to make the dwelling more habitable. 1. Provide continuous concrete perimeter foundation. 2. Provide new cooling system. Equilla Stovall April 26., 1989 Paoe 3 9 Most of the corrections or repairs listed will` require permits and inspections from the Butte County Department of Public Works. Permits may be obtained at 7 County Center Drive, Qroville, CA, All work shall be completed to the extent necessary to provide the desired -finished product. This may require tile, linoleum, shingles, wallboard, paint, vents, or whatever is necessary to accomplish the finished product. The Stovall family would like an aoljusted pay off amount in consideration to the money taken by Carl Moore the contractor suggested/assigned by you. - Mr. Moore was the second contractor to work on thetbouse. There was also a first contractor, a Mr. Kevin Jones (who was also assigned by ;you), also took a considerable amount of materials that were supposed to be used in remodeling the home. We tried to report Mr. Jones and Mr. Moore. When I attempted to .seek compensation for these losses, the State Contractors Board, informed us that there was only one $5000.00 bond purchased as insurance for all the homes that were being remodeled at that time. I have kept records or copies of paperwork showing monies that were issued to Carl IV[oore in 1990; which totals to over $22,000,000 for Carl Moore and Kevin Jones. Marta. Sierra finished up with an additional loan or grant which wasn't enough to do all that was neded. The finished product in no way looks like a house repaired to the tune of $45,000. I was also promised money by you for my mother to live with me while the remodeling job was taking place. I never received anything. I had to forgo it because there was not enough money to finish the job because of the. dishonesty of the first two contractors. I feel that I should be compensated for this and the losses resulting from Kevin Jones and Carl Moore's dishonesty. When I attempted to seek compensation for these losses, the State Contractors Board, informed us that there was only one $5000.00 bond purchased as insurance for all the homes that were being remodeled at that time. I have kept records or copies of paperwork showing monies that were issued to Carl Moore in 1990; which totals to over $22,000,000 for Carl Moore and Kevin Jones. Marta Sierra finished up with an additional loan or grant which wasn't enough to do all that was needed. The finished product in no way looks like a house repaired to the tune of $45,000. I was also promised money by you for my mother to live with me while the remodeling job was taking place. I never received anything. I had to forgo it because there was not enough money to finish the job because of the dishonesty of the first two contractors. I feel that I should be compensated for this and the losses resulting from Kevin Jones and Carl Moore's dishonesty. I'm asking for this to be shown or reflected in the pay-off amount for this HUD loan, #34039. A copy of this letter is being forwarded to HUD and another copy to the Attorney. General. I've been given the run-around regarding this matter for the last twelve years. If satisfactory results are not granted, I shall proceed with pursuing legal action. Oroville, CA 95966 Re: Response to Complaint Letter — 3041 Oro Bangor Hwy., Oroville Dear Ms. Tobias: Thank you for your patience in allowing us time to research the records regarding your letter of complaint of "poorly done work on Equilla Stovall's home at 3041 Oro Bangor Hwy" dated 01/02/04. Unfortunately, the loan records from 1988 through 1990 are no longer available. We were able to review the building permit file and a more recent (2000) file provided by Connerly and Associates. Findings from these files are summarized with Exhibits A -D attached to this response letter. The facts we were able to ascertain from the Building files are as follows: • July 16, 1980 Building permit taken by Walter Luczak Jr. (contractor) for re -roof (5 sq), install plumbing vents (3), replace interior doors. This work was inspected by a Butte County Building Inspector and deemed complete on July 23, 1980. • August 28, 1988 Equilla Stovall was notified by a letter from Connerly and Associates that she qualified for the Emergency Home Repair program. In that letter she was asked to obtain contractor estimates for repairs the staff determined to be most urgent. A list of contractors that had worked with the program in the past was supplied along with the letter. The letter also stated, "You may contact any other contractors you feel will do a good job, provided they have a license." Mrs. Stovall was asked to supply three estimates for the six (6) items outlined by Friday, September 16, 1988. (Exhibit A) • March 27, 1989 Connerly and Associates requested a written inspection report from the County as they were requesting permission from Housing and Community Development (HCD) to make a $20,000 loan under the current grant. • February 7, 1989 Equilla Stovall applied for a building permit for re -roof, gas wall heater and electrical clean-up. Mrs. Stovall completed an "Owner -Builder Verification" indicating she was acting as her own contractor. Subsequently, on 08/29/89 the Building Inspector for Butte County inspected and determined the roofing looked properly installed and indicated the remainder of the work applied for on the permit still needed to be done. • April 26, 1989 Equilla Stovall was sent an inspection letter from Public Health indicating the repairs or corrections required that needed to be done to rehabilitate the dwelling. (Exhibit B) • July 18, 1989 Equilla Stovall applied for a building permit to relocate vent pipe, reside house, foundation work, replace steps. Records indicate this permit was not issued, meaning work was never authorized to begin. Notes in the building file indicate: o Mrs. Stovall again filled out an "Owner -Builder Verification" to act as her own contractor but showed her intent to contract with Kevin Jones, and unlicensed contractor to do the work. Records show State Farm insurance submitted information on November 29, 1989 indicating that Mrs. Stovall's homeowner coverage covered Worker's Compensation insurance for employees including but not limited to painters, roofers, remodeling and repair contractors, chimney sweeps, etc. Mrs. Stovall was notified the Owner Builder verification information was not valid with her statement to hire Kevin Jones. Records indicate Mrs. Stovall was called on January 5, 1990 and advised of Fannie Tobias 14 April 2004 Page Two this as well as need to supply sufficient plot plan and building plan information. Notes attached to this building permit application indicate: ✓ (no date) "Stovall, unlicensed contractor, ordered off by Connerly, 2 complete plans, $7,000, Carl Moore" ✓ March 19, 1990 "Ward Connerly advised we needed complete plans and new contractor must apply for new permit and we can refund other permit to Stovall. Connerly to advise contractor". ✓ April 16,1990 "Tanga/Connerly" Going to job with another contractor to try to straighten out" Facts we were able to glean from the file sent to us from Connerly and Associates are as follows: • 08/21/00 Butte County Central Collections notified Connerly and Associates that Fannie Tobias had notified County that Equilla Stovall had passed away (6/1/2000) and had provided a copy of the death certificate. At that time notes indicate $800 or eight (8) months of payments were delinquent. • 12/15 Note indicates, "daughter is living in home — paying rent, children (7) inherited property". • ' Connerly began working with heirs on an "assumption to convert to rental dwelling". Application was sent 12118/00. • 9117 Note indicates, "Fannie does not live in property, sister (Helena) does, home is in Fannie's name. She still has assumption application, says it is very "complicated" and she will mail it in as is and I'll [Connerly] get back to her with what we need." • 11/7101 Letter to Fannie Tobias indicating information needed —Signed "Information Release Authorization" for all persons on title, Source(s) of income for all persons on title, "Tenant Income Verification" and "Tenant Information Release authorization" — Helena Heard. There was also a reminder the rules governing rental properties and owners of rental properties were quite different than owner/occupied units with a strong recommendation that the option of refinancing with a conventional lender be explored. (Exhibit C) • 09/02/02 Letter to Connerly and Associates from Fannie Tobias. (Exhibit D). • 9/25/02 Connerly note indicates staff attempts to work with the family for almost 2 years to get them to assume Equilla Stovall's loan. Options of refinancing and assumption were discussed. The family did not like the fact that the original 0% loan would be converted to an interest loan as an investment (rental) property. Staff was unable to get Income verification on each of the heirs with a vested interest in the property. Family was now requesting a reduction of the loan balance. Decision was made to recommend foreclosure. Summary of findings in response to complaint: Rolled roofing (901b), as verified by our Building Official has a short life expectancy and it is reasonable to expect that it would need to be replaced every 2-4 years (compared to shingle roofing of 230lbs that has a 10-15 year life). Your letter states,"repairs have been done 3-4 times since the original rolled roofing was put on". We can only assume you mean since the building permit for roofing finaled on 8129/89 as there were no other permits taken for additional roofing, so any other repairs were done without obtaining the required permits. It also appears that other work you are disputing also was done without benefit of permits, so the Building Department did not have an opportunity to review the quality of work or pass it upon inspection and there are no records of this work on file. File information clearly shows that Mrs. Stovall was advised to select a licensed contractor to perform the required work. Mrs. Stovall clearly at times acted as her own contractor and file information indicates that although she was told work must be done by a licensed contractor she attempted to have work done by Kevin Jones, an unlicensed contractor. Connerly and Associates reports that Mrs. Stovall would have had discretion to authorize and release payments for work she deemed complete. An attempt was made to get records of payments from the Butte County Title Company, but we were advised that after seven years the records were purged. 2 *�A Fannie Tobias 14 April 2004 Page Three The file from Connerly and Associates picks up in 2000. Loan payments were delinquent, the County and Connerly were made aware that Mrs. Stovall had died, and the heirs were renting out the home. The record shows that Connerly worked with Fannie Tobias in an attempt to get the loan assumed as a rental and encouraged exploring conventional financing. Staff at Connerly and Associates who worked with the family recall there were no complaints regarding work on the home during the entire period that assumption of loan converting it to a rental was in process until the letter of September 2, 2002. The letter of September 2, 2002 seeks a reduction of the pay-off amount due to allegations that "contractors" chosen by Mrs. Stovall were dishonest.. It appears that a complaint was appropriately made to the State Contractors Board, but it is unclear why this wasn't pursued to compensate for the allegations made against the "contractors". Again, the County's position is that Mrs. Stovall chose the contractors to work on her home and that Connerly intervened when it was discovered that Kevin Jones, an unlicensed contractor was performing work. On October 7, 2002 a recommendation was made to the Butte County Loan Committee to foreclose on the property and a copy of the September 2, 2002 letter was attached. On October 22, 2002 the Butte County Loan Committee approved the recommendation to foreclose. On November 13, 2002 a certified letter was sent to Fannie Tobias, Catherine Harris and Florence Young "Official Notice of Foreclosure Action". The note balance was paid in full February 12, 2003. There is no documentation, of any complaints other than those noted in the building file of Kevin Jones (an unlicensed contractor) being ordered off the job by Connerly and Associates and Connerly working to "straighten things out". Notes indicate that Connerly and Associates worked with Mrs. Stovall to resolve this issue when it arose and disbursement of payments which required Mrs. Stovall's authorization would indicate the work proceeded under her oversight and to her satisfaction. The Stovall heirs benefited from the 0% interest loan in place from the time Mrs. Stovall died on 6/112000 until the note was finally paid off on 2/12/03, over 31 months of interest free loan while the assumption of the loan and conversion to rental property or conventional financing to pay-off the loan was explored and the home was utilized as a investment rental. Please be assured that this matter was reviewed thoroughly. Due to the facts presented above, the fact that there are no building permits on record for the rehabilitation work, and the family benefiting from 31 months of interest free loan, we consider this matter closed. Connerly: I am writing this letter in reference to loan #34039 which was granted to Equilla Stovall who is now deceased. -She passed away on June 01, 2000. The Stovall family would like an adjusted pay off amount in consideration to the money taken by Carl Moore the Mr. contractor suggested/assigned by you. MMoore was the second contractor to work on t. . the house. There was also a first contractor, a Mr. Kevin Jones (who was also assigned by you), also took a considerable amount of materials that were supposed to be used in remodeling the home. We tried to report Mr. Jones and Mr. Moore. When I attempted to seek compensation for these losses, the State Contractors Board, informed us that there was only one $5000.00 bond purchased as insurance for all the homes that were being remodeled at that time. I have kept records or copies of paperwork showing monies that were`issued to Carl Moore in 1990; which totals to over $22,000,000 for Carl Moore and Kevin Jones. Marta. Sierra finished up with an additional loan or grant which wasn't enough to do all that was needed. The finished product in no way looks like a house repaired to the tune of $45,000. I was also promised money by you for my mother to live with me while the remodeling job was taking place. I never received anything. I had to forgo it because there was not enough money to finish the job because of the dishonesty of the first two contractors. I feel that I should be compensated for this and the losses resulting from Kevin Jones and Carl Moore's dishonesty.
