Because of the documentation you presented, plus additional
collaboration and -no documentation 'to the contrary, it appears
that you have established a. pre-existing, nonconforming use of a
second dwelling on your A -R (Agricultural Residential) parcel.
The nonconforming use may not be expanded unless a use permit for
an expansion of a nonconforming use is applied for and granted.
The second dwelling is,.therefore, limited to a one bedroom with
one bathroom unit.
If the . use is discontinued for a period of twelve consecutive
months it shall no longer be a legal nonconforming use. Pursuant
to law the party asserting the right to a legal nonconforming use
has the burden of proof to. establish the lawful and continuing
existence of the use.
The other concern regarding your parcel was the unauthori'zed
business (cabinet shop) that, is existing. in your garage. I

On November 8, 19ea, I met with Mr. Eufusia at his house and trailer
located at the above stated address.'
The sept SY stem was functioning satisfactorily with the exception
that the 4Wrwater discharged onto the surface of the ground. Mr.
Eufusia agreed to replumb the wash water into the septic tank.
Based an Mr. Eufusia's description of the septic tank, there is at
least a one thousand (1000) gallon septic tank.
The sail on this lot is usually good for the foothills, and should it
be �necessary to completely --replace the septic system, there is
adequate sail and space to install a septic for a total of three
bedrooms: i.e. a.two (2) bedroom house and a one (1) bedroom trailer.

CDF FIRE SAFE REQUIREMENTS

by the Butte County Fire Department and are made a part of this permit.
These requirements are minimums and will be superseded by Butte County
local regulations which equal or exceed these standards. Field
inspections will be made by the Butte County Building Department for
compliance.
1272.00 Maintenance of Defensible Space. To ensure continued
maintenance of properties in conformance with these
standards and measures and to assure continued avail-
ability, access and utilization of the defensible space
provided for in * these standards, annual maintenance
must be provide for by the land owner.
Driveway Standards
1273.02 Surface. All driveway surfaces and structures (bridges,
1273.07 culverts and other app.-,rtenant structures which supple-
ment the roadway bed or shoulders) shall provide unob-
structed access to conventional drive vehicles, includ-
ing sedans and fire apparatus weighing up to 40,000
pounds.
1273.03 Grade. Not to exceed 16 percent unless paved.
1273.04 Driveway Radius
1. No roadway shall have a horizontal inside radius of
curvature of less than 50 feet and additional sur-
face width of 4 feet shall be added to curves of 50-
100 feet radius; 2 feet to those from 100-200 feet.

of gutters, ditches and drainage structures designed
to hold or divert water shall be not less than 100
feet.
