Since the purchase of the property the following. failures and.problems have. occurred due' to poor or faulty workmanship, deceit and . misrepreGentations relating to compliance with the Universal Building Codes, National Electrical Code & Uniform Plumbing Code adopted by Butte County. II CODE VIOLATIONS 1- UNIVERSAL BUILDING CODE A. Garage Roof - Our garage roof has leaked every winter and has gotten worse each year. The original leak was in the area where the water heater vent goes through the roof_. �Thete"also`was watdf"r`that7"fan down the"exterior"gar_age "Walls- stalnng"the'stiicc'P The Martins sent Mr. Diaz to repair it. He caulked and wet patched around the vent. It helped, temporarily, but didn't stop the leaking. The water-i-�runnizlg down the, exterior-, of -!,the vent pipe j ended up' on -'the "'.66PP %f the water" heater and =pori` tiie�`garage' floor. When we complained of the leaking the following year the Martins sent Mr. Diaz to caulk and patch again, with the same results. When showed Mr. Martin the staining_of the stucco on the N.E. corner of the garage, .he sent over his "tile roof installer" who -put a piece of lead against the... wall in an attempt to divert the water running down thegarage wall into the end of the roof gutter on the East side of the house. It didn't work. This allowed water to go down the stucco wall and also seep back under the roofing material. . This last winter, with the extremely heavy rains, the old leaks returned and there developed. new leaks in the roof arid_ along the entire width of the West wall. (See I I INCN1l L The walls of the garage Zcame increasingly stained and our sporting and camping equipment, as well as other belongings stored in the garage cabinets were soaked. We had to empty most of the cabinets and stack our equipment on a small, dry section of the garage floor. This summer, I contacted some roofing contractors and had one of them inspect.the roof on August 21, 1995. He found that the roof was applied without any hot mopping and'that there were roofing nails through the cap sheet, allowing water to penetrate. He also found that there was no flashing to carry the water into the gutter and that this allowed water to seep. back under the roofing materials and run down the stucco. walls, staining them. On_;Aug:._21.�95_we.Lfirst_discoyered the fraud. (See attched-jetter dated 9-25-950ytdchmer)f 4-1 With winter coming and because of the half-hearted or indifferent responses by the Martins to correct problems with our house in the past, I had R.L. Greene & Sons re -roof the garage and install the missing flashing at a cost to us of $880.00. (See attached bill) . Aftdchme)jj-4�2• , `'The Butte County Building Dept. told me the requirements for that roof should have been: Under Universal Bldg, :Code, Section 3203 -Tables 32-E,F,& G. This calls for a minimum of a layer of 15 lb. felt which should be nailed, hot mopped and a second layer of 15 lb. felt, hot mopped, and then the cap sheet applied. Th6 code also says that metal flashing shcu'ld' be` ins talled"'wherevbF the *roof -meets the vertical -wall surface. At the bldg. dept. I was told that the garage roof was, probably.not, inspected by a County inspector. He stated "We ordinarily don't look at the roof. We look for slope and gutters". B- Down -Spouts & Gutters - The licensed contractor who did the garage roof repair informed me that the down' -spouts` =are--Yegiiired o be`"' 9d 'more'"rhari '40' "fi.partOur-front. dowry-spout�''i.'9`41 ° ��`:'0 from the opposite end of the gutter. In addition to this, all of the water that falls on one half of the tile roof of the house and all of the water on the garage roof is expected to be carried off by one down- spout. It is often overwhelmed by the volume of water and overflows down the stucco wall, flooding the patio. C- Attic Access - I have had to go up into our attic on a number of occasions. This acces`e--opening is located.in the ceiling of the master bedroom closet. I found it difficult, as did men working for me on several occasions, to enter the attic because the roof trusses are so low over the opening. I was told by another licensed builder employed by me that .it didn't seem to be built to code. It now appears that he was right. PAGE'3 1 The Universal Building Code states that "Thirty inch 2 minimum clear headroom in the attic space shall.be provided at or above the access opening" (Section 3205a): I 3 measured ours and found that it doesn't meet this requirement. (See attached sketch of attic entry). 5__(!f RHadh1e)1-ts 34-y 4 C- Wallboard - The flat area under the eaves of the house and the ceilings of the bedroom patio and -the breiewy are made of wallboard - not exterior plywood. If these -i-6 '' 5 become wet they can absorb moisture, swell.and then crumbles this has already happened.'at'the home of a neighbbr:- 6 The Universal Building Code states: General "Gypsum ca. wallboard shall not be installed on exterior surfaces.`.�- 7 Section 4711a) The areas I have described above are all exterior surfaces. This code violation was discussed with 8 Mr. Martin and he assured me that wall board could be used on 9 exterior surfaces. Once again he knew, or should have known, this was a code violation and did not, at any time, inform me 10 of such ( 611ach Me -4 45) 11 _ III NATIONAL 9LECTRICAL. CODE A- Wiring - We have encountered some electrical problems in the.house. 12 The outside plugs on the two patios, both bathrooms and the garage wall plugs (3 double) and -the garage light are all 13 on one circuit connected to the G.F.I. plug on the patio. In the past we might have the G.F.I. re -set button kick 14 out and not know it. This happened once when we were gone for five days, in the summer, and we returned to find that 15 we had lost almost $400.00 worth of meat, fruit , berries and fish in the freezer as well asa horrible mess to clean up. 16 We partially corrected this by putting night lights in both bathrooms which could tell us when the G.F.I. re -set button 17 had kicked out. We also had 2 more circuits run to the garage so that we could put our freezers and washer & dryer 18 on their own circuits (12 guage wire and 20 amp. circuit breakers). This was done at considerable expense to us. 19 Before adding these new circuits we found that we were lucky not to have had a fire due to the way the garage was 20 originally wired; with some 14 guage wire and a 20 amp. circuit breaker. Dept. and asked to see what the 1986 National Electrical Code 22 said about guage of wire and ampereage of circuit breakers. I was told that 14 guage wire should not be used with larger 23 than 15 amp. circuit breakers. I was then shown the Natiokial Electrical Code Section 240 24 Protection of Conductors and also_Table 310-16 showing 25 Ampacities of Insulated Conductors.`-, This chart states that you "should not exceed 15 amperes ".____ __ _over current protection for 14 AWG wire". There was oniy one vent in. the / house handle 2 toilets, 3 sinks, two showers, 1 bathtub, a ange and a microwave_oveny, This problem was never corrected—a�hough-we ma"ae repeated .'demands,of Robert Martin, an employee of Frieda Martin. The problem has now been corrected by a professional plumber at'our expense.Mr:.-ii&rtiri repeatedly -.promised..to..correct this condition & had no=intentio of .doing. so..& in fact did not do so.GSee RffachMeh+#8 B- Guest Bathroom - The toilet .in'the,guest bathroom was improperly, negligently and incorrectly installed in that it slanted to one side and the sewer pipe was not plumb. This resulted in the wax seal not sealing properly, allowing moisture to'travel under the vinyl floor covering. This contributed to the mildew forming under the vinyl causing large dark stains on the floor covering. The cement around the sewer pipe was chipped out, the pipe straightened and .re-cemented,and the toilet was re seated with a new wax - seal. (See page 5 C) V IMPROPER, INCORRECT, NEGLIGENT WORKMANSHIP A- Air-Conditioner/Furnace - Was incorrectly, improperly and negligently installed in that the unit sits on a concrete .= pad approximately 40"x50"x4" thick - outside the north.wall'. of the house.. The concrete pad has no footings._ To match the ducting & hole in the exterior wall the pad was. poured on a mound of sand which keeps eroding away with the winter rains. Now the pad has tilted causing large gaps to.form 'be ' tween Warm the wall and the unit releasing large amounts of arm or. . cool air outside when the unit is in operation. This, of course, results in large P.G.&E. bills. Nothing has been done about this even though I pointed the problem out to Robert Martin several times. At a later date Mrs. Martin looked at the unit and, again, nothing was done. (SMORM, 0)6trp-trk E-5-, ijelice). B- Vinyl Floor Covering - Vinyl floor covering was installed in the kitchen, service -pantry area and guest bathroom, leaving two square patches, approximately 18 (eighteen) inches across, unsealed, which resulted in unacceptable outlines of these squares in front of the kitchen range - which worsened over time. Mrs. Martin agreed to install new floor covering as she had no more of the original pattern. To do this the refrigerator, range and washer and dryer had to be moved out of the way. When an employee of Mrs. Martin re -installed the stove, he dragged it across the newly laid vinyl -leaving a 3" to 4" gouge. My wife was working outside at the time. This water, plus leakage from the improperly°installed toilet in the guest bathroom (See page 4, Paragraph -IV B) caused mildew to form under the floor covering and dark stains started to appear in the vinyl several weeks later. This damage was never repaired although repeated requests and demands were made to Robert Martin,.an employee of Frieda Martin. We replaced this vinyl on July 22, 1993, at a cost to us of $1, 600. 00. ('See Y�4f�dcAed 13111- 14++6c.h kMehfi+'T D- Kitchen Sink - There was a chronic leak under thhe kitchen sink which caused damage to the cabinet and the supplies which were stored there. This was reported many times to Frieda Martin and Robert Martin. They sent Mr. Diaz over and -he -would tighten the fittings and leave. I also did this repeatedly. Soon there would be water }'.' deep under the sink again. Mr. Martin said that he would, again, send Mr. Diaz to repair it. My wife said that she would prefer that someone else come to the house. A professional plumber was sent and he replaced and re -seated the metal outlet in the bottom of the sink, which had been negligently installed. That corrected the problem. E- Concrete..Wall- In the Spring of 1986 we talked to the' Martins about buying a house at 145 Melrose Drive, Oroville CA 95966. We agreed upon.a purchase price and shortly after the agreement was made they informed us that they had to increase the price'several thousand dollars. To compensate for the increase, Bob Martin said that he would help me build a concrete wall around the property. This would "bo in keeping with the Spanish motif of the house." He promised to work with me and one of Frieda Martins employees; pour the wall in sectionslin forms)on the ground and then lift and lower them into concrete pilasters to form the wall. It could be stuccoed or painted. After we moved into the house it became apparent that he had no intention of keeping his word about the wall. We asked about it a number of times and he told us that he was too busy to start the project. After repeated stalling he said he was not going to do the job but that he would give us $1,400.00 in compensation. We were forced to have a stugco wall built by Luczak Construction at a cost of over $5,500.00. In our estimation, Bob Martin never had any intention of building the wall to start with.
