Due to the poor wording of the Act itself, a number of questions have arisen concerning compliance with the Act and how to enforce it We have revised our letter to describe how enforcement will occur in Butte County, and are again conducting a mailing to notify pool contractors. This revised letter should clarify several common questions or problems concerning our enforcement of the Swimming Pool Safety Act including: 1. In our review of legislative considerations, we discovered that when accommodation was provided to allow exit alarms on doors providing direct access to the pool, it was assumed that a conforming perimeter fence was already in place. However, in many cases there is no pre-existing pool or parcel enclosure, and unless the residence is one side of an enclosure which entirely surrounds the POOL installation of exit alarms alone does not constitute compliance. 2. The 1994 Uniform Building Code, Appendix Chapter 4, Division 1, and the 1997 Uniform Building Code , Appendix Chapter 4, Division 1, specifically allow the use of chain link fencing - as pool barrier material. In Butte County we will continue to allow the use of 11 gage, 2-1/4 inch mesh, chain link fencing as pool barrier material. Other types of fencing will be considered on a case by case basis, based upon the requirements of the Swimming Pool Safety Act- Please call for clarification prior to installation. 3. All access gates through the enclosure shall open away from the swimming pool, and be self- closing with a self -latching device placed no lower than 60 inches above the ground. As used in this article the following terms have the following meanings: a) "Swimming pool" or "pool" mems any structure intended for swimming or recreational bathing that contains water over It inches deep. "Swimming pool" includes in -ground and aboveground structures and includes, but is not limited to, hot tubs, spas, portable spas, and non-portable wading pools. b) "Public swimming pool" means a swimming pool operated for use of the general public with or without charge, or for the use of the members and guests of a private club. Public swimming pool does not include a swimming pool located on the grounds of a private single-family homes. c) "Enclosure" means a fence, wall, or other barrier that isolates a swimming pool from access to the home. d) "Approved safety pool cover" means a ma u211y or power -operated safety pool cover that meets all of the perform2rice standards of the American Society for Testing and Materials (ASTM), in compliance with standard F1346-91. e) "Exit alarms" means devices that make audible, continuous alarm sounds when any door or window, that permits access from the residence to the pool area that is without any intervening enclosure, is opened or is lilt ajar. Exit alarms may be battery operated or may be connected to theelectrical wiring of the building. . 115922. Commencing Jamury 1, 1992, except as provided in Section 115925, whenever a construction permit is issued for construction of a new swimming pool at a private single-family home it shall be equipped with at least one of the following safety features: a) The pool shall be isolated from access to a home by an enclosure that meets the requirements of Section 115923. b) The pool shall be equipped with an approved safety pool cover. c) The residence shall be equipped with exit alarms on those doors providing direct access to the POOL d) All doors providing direct acceself-dosing, ss from the home to the swimming pool shall be equipped with a selosing, self - latching device with a release mechanism placed no lower that 54 inches above the floor. e) Other means of protection, if the degree of protection afforded is equal to or greater than that afforded by any of the devices set forth in subdivisions a) to d), inclusive, as determined by the building official of thejurisdiction issuing the applicable building permit Any ordinance governing child access to pools adopted by a political subdivision on or before January 1, 1997, is presumed to afford protection that is equal to or greater that afforded by any of the devices set forth in subdivisions a) to d), inclusive. 115923. An enclosure shall have all or the following characteristics: a) Any access gates through the enclosure open away from the swimming pool, and are self-closing with a self latching device placed no lower than 60 inches above the ground. b) A minimum height of 60 inches. c) A maximum vertical clearance from the ground to the bottom of the enclosure of two inches. d) Crips or voids, if any, do not allow passage of a sphere equal to or greater that four inches in diameter. e) An outside surface free of protrusions, cavities, or other physical characteristics that would serve. as handholds or footholds that could enable a child below the age of five years to climb over. 115924. Any person entering into an agreement to build a swimming pool shall give the consumer notice of the requirements of this article. 115925. The requirements of this article shall not apply to any of the following: a) Public swimming pools. b) Hot tubs or spas with locking safety covers that comply with the American Society for Testing Materials -Emergency Performance Specification (ASTM ES 1349). c) Any pool with the jurisdiction of any political subdivision that adopts an ordinance for swimming pool safely that includes requirements that are at least as stringent as this article. d) An apartment complex, or any residential setting other than a single-family home. 115926. This article does not apply to any facility regulated by the State Department of Social Services even if the facility is also used as the private residence of the operator. Pool safety in those facilities shall be regulated pursuant to regulations adopted thereof by the State Department of Social Services. 115927. Notwithstanding any other provision of law, this article shall not be subject to further modification or interpretation by any regulatory agency of the state, this modification or interpretation by any regulatory agency of the state, this authority being reserved exclusively to local jurisdictions, as provided for in subdivision (e) of Section 114922 and subdivision (c) of Section 115924. The material . is fiberglass reinforced plastic, 1/4 inch thick, composed of isophthalic resin, vinyl ester resin, fiberglass and ceramic. The surface finish is a gel coat. Viking Pools, Inc. produces various styles of swimming pools and spas, the overall pool dimensions, depths and capacities are shown in Table 1. For mini pools - see Table 2, for spas - see Table No. 3. �"•� The fiberglass has an average tensile strength of 13,308 psi, and an average flexural strength of 41,976 �.. T ««- psi. The upper portion of the pools and spas is constrained by a concrete bond beam. Some pools and all spas can be placed nineteen -and -one-half (191/2") inches above ground as shown in i..W - es Table 4. Vertical supports consisting of 1 inch by 11/2 inches wood member integrated in the fiberglass reinforced TAHOE BERRYESSA plastic application process at four feet six inch (4'6') intervals are required. The spas do not require the vertical LOS OS supports. These pools and spas in Table 4 do not require concrete or wood decking. Fig. 2. All plumbing and electrical work must comply with the code currently in effect at the construction site. The pool or spa excavation is to be performed to permit excavation profile to coincide to the contours of 0 the pool. The overexcavation is approximately 6 inches on the sides and 12 inches on the ends. At the deep end, the width of the pool is over excavated from 8 to 24 inches in order that the first portion of the backfill may be manually adjusted for the initial 12 inches of backfill. The overexcavation of the bottom of the pool varies from approximately 3 to 6 inches, depending on soil type. The backfill for the bottom of the pool or spa is accomplished by spreading a layer of bedding sand. Compaction of the sand layer is by means of manual tamper and water. ..... A hydraulic crane is present to pick up the pool and lower it carefully into SHASTA CLEARLAKE the excavation. Mini pools and spas are usually manhandled into place. LRS SS LEVELLING THE POOL The qualified pool installers then check the level of the pool and its fit with the excavation by walking around on the inside of the pool feeling for any voids that might be present. T 471140- The pool is then lifted out of the excavation and set back as many times as necessary to achieve a perfect L- fit. The perfect fit is realized by using the following techniques, namely, raking the surface of the sand in order to see where the pool is touching after it is removed and also walking around on the inside of the pool to detect low spots. When the level of the pool is within one-half inch, the setting procedure is complete. PLACID - BOSS The filling of the pool with water and simultaneous sand backfill operations are then commenced. The sand is compacted with a tamper and water. Care should be exercised to insure that the backfill level and water level are approximately the same throughout this procedure. r 7 This pool is designed to be kept full at all times. The pool shell could be damaged if the water level is -� allowed to drop below the pool inlet. When appreciable draw -down is noticed, or if it becomes necessary to drain f" the pool, contact VIKING POOLS, INC., or their agents for instructions. These pools are manufactured by the Firm VIKING POOLS, INC. in Williams, California. The ability of the pool structure to carry the loads imposed on it (which are primarily static loads, due to water pressure, ground settling, and dynamic loads due to earthquakes) depends on the strength and energy absorption qualifies of the fiberglass reinforced plastic material composed of isophthalic resin, vinyl ester resin, fiberglass, and ceramic.
