Boundary Issues The affected parcel is contiguous to District boundaries, as depicted on the map attached as Exhibit 'A" and staff supports.the annexation.as proposed. Proceeding No. 04-09 ■ Report and Recommendation ■ December 4, 2003 Land Use The unincorporated parcel is zoned AR (Agricultural Residential) with a General Plan designation of Low Density Residential. The parcel is developed with a single family home. The connection to sewer service will not significantly alter the land use functions on the property or stimulate a significant change of land uses. Any future land use entitlements or discretionary permits must be approved by the County of Butte in a manner consistent with the County General Plan. Significant Issues A Property Tax Exchange Agreement was executed by the Lake Oroville Area Public Utility District Board of Directors on September 9, 2003. The Property Tax Exchange Agreement, which provides for revenue neutrality, has been scheduled to be heard by the Butte County Board of Supervisors on December 2, 2003. Should the Agreement not be heard on December 2, 2003, this proposal will be continued. There are no other significant issues associated with this annexation request. Environmental Review The Lake Oroville Area Public Utility District has found the project to be Categorically Exempt from the California Environmental Quality Act pursuant to Section 15319(a)(b), annexations of property that are fully developed or suitable for development of exempt structures such as a single family dwelling. Staff has no significant additional information to question this determination. The Notice of Exemption is attached as Exhibit °C." Support/Protest As this proposal is an uninhabited annexation (less than 12 registered voters) and has 100% support of the affected property owners, the Commission can waive the Protest Proceedings pursuant to §56663, as requested by LOAPUD in Resolution No. 17-03 adopted September 9, 2003.
