Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below, the Butte County Office of Education is hereby granted a Use Permit to allow
programs for the instruction of students with developmental disabilities, have low vision, or are'blind
in typical indoor and outdoor domestic/residential activities. Barbecue and picnic events associated
with the programs are also permitted.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 24 months of the delivery of the
countersigned permit to the Permittee.
Minor changes may. be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee, Prior to such approval, verification shall be made
by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
4. If any use for which a use permit has been granted is not established within two years of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Conditions of Approval:
No more than fifteen students shall utilize the facility at one time.

2. Hours of operation shall be from 8:00 a.m. to 5:00 p.m., Monday through Friday.
3. No more than 4 program picnics/program barbecues shall be permitted each year.
Picnicibarbecue events shall be limited to weekdays only. No more than 50 persons shall
attend each event.
4. Nine on-site parking spaces (4 full size, 4 compact, and 1 handicap stall) shall be provided.
5. The existing wire fencing shall be maintained in good condition along the property lines and
the right -of ways of Greenbank Avenue and Foothill Boulevard.
6. No outdoor music or amplified public address systems are allowed during any activity
related to this Use Permit. (Mitigation Measure #1)
7. Should neighbors perceive the noise level obtrusive, efforts shall be made to be less
obtrusive. The site operator shall provide a phone -number to adjacent neighbors for the
purpose of allowing contact with the instructor on duty. (Mitigation Measure #2)'
Upon the written request of neighbors complaining about noise levels from the facility, the
Use Permit shall be brought before the Planning Commission where the complaining parties
can state their concerns. The Planning Commission shall determine if subsequent review is
needed and, if required, set a hearing date to review the Use Permit. (Mitigation Measure
#3)
9. Any improvement or activity which would increase the number of students to more than
fifteen shall be reviewed by the Planning Commission to determine if an amended Use
Permit is necessary.
10. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
11. The existing address signage for the property shall be made to conform to the Fire Safe
Regulations (Public Resources Code Section 4290)..
12. The facility shall comply with the requirements of the State Fire Marshal to the extent
required by law.
13. The applicant is to participate in a general solution for drainage when a plan is developed for
the general area.
I hereby declare under penalty of perjury that I have read the foregoing conditions, that they
are in fact the conditions which were imposed upon the granting of this use permit, and that I agree
to abide fully by said conditions.
