ASSESSOR'S PARCEL NO.
Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the
special conditions set forth below: Robert & Mary Ann Apodaca are hereby granted a
Use Permit in accordance with application filed: December 1, 1992 to change the
occupancy of a temporary second dwelling on property zoned AR -MH 2.5, located at
2671 Pinecrest Avenue, Oroville.
Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the
Permittee, the permit shall become null and void and reapplication and a
new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors,
and assigns of the Permittee.
SPECIAL CONDITIONS:
1. Occupancy of the mobile home is limited to Grace Apodaca and her son.
2. No rent is to be charged to the occupancy of the mobile home.
3. Applicant shall maintain 30 feet of clearance from the mobile home to the
property line.
4. The mobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County Code.
5. The Use Permit shall expire one (1) year from the date of issuance of the Use
Permit. Upon application, the Planning Commission may grant an extension of
the Use Permit not exceeding one (1) year.
6. In the event that the applicant who is residing within the mobile home or the
conventional residence, for any reason, moves to another location or is deceased,
then in that event, the Use Permit granted herein shall automatically expire and
the mobile home shall be removed within one hundred twenty (120) days. In the
event the mobile home is not removed within one hundred twenty (120) days
pursuant to the terms of the Use Permit, the County shall remove the mobile
home and store it at the owner's expense.
7. The $1,500.00 deposit provided for the existing permit shall carry over and apply
to this project.
8. Applicant must also comply with all other applicable State and local statutes,
ordinances, and regulations.
I hereby declare under penalty of perjury that I have read the foregoing
conditions, that they are in fact the conditions which were imposed upon the granting of
this use permit, and that I agree to abide fully by said conditions.

NOTE: Issuance of this Use Permit does not waive requirement of obtaining Building
and Health Department permits before starting construction, nor does it waive any other
requirements.
Minor changes may be approved administratively by the Directors of Environmental
Health, Planning or Public Works upon receipt of a substantiated written request by the
applicant and only to those conditions or requirements recommended by their respective
departments. Prior to such approval, verification shall be made by each Department or
Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major
or significant in nature by the respective/affected Department Head shall require the
applicant to submit an amendment.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte
and the special conditions set forth below: Robert and Maryann Apodaca
is hereby granted a Use Permit in accordance with application filed:
11/15/89 to allow a mobile home as a temporary seconddwelling on property
Zoned ARM -MH -2.5 located on the north side of Pinecrest Avenue,
approximately 1/2 mile west of Upper Palermo Road, Oroville.
1. Failure to comply with the conditions specified herein as the
basis for approval of application and issuance of Permit,
constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County
Zoning Enabling Ordinance.
2. Unless otherwise provided for in a condition to a use permit,
all conditions must be completed by the permittee within 12
months of the delivery of the countersigned permit to the
permittee.
3. If any use for which a use permit has been granted is not
established within one year. of the date of receipt of the
countersigned permit by the permittee, the . permit shall be
come null and void and reapplication shall be required to
establish the use.
SPECIAL CONDITIONS:
1. Occupancy to the mobile home is limited to Mrs. Cecilia B. Sanders
and her children.
2. No rent is to be charged to the occupant of the mobile home.
3. Install a sewage system under permit and inspection from the County
Health Department for the second dwelling unit.
4. Provide sufficient proof to the Butte County Environmental Health
Department that the existing well water is potable and meets all
health requirements and standards.
5. The mobile home is to be a temporary use on the property pursuant to
the requirements of Section 24-304 of the Butte County Code.
6. The Use Permit shall expire two (2) years from the date of issuance
of the Use Permit. Upon application, the Planning Commission may
grant an extension of the Use Permit not exceeding one (1) year.
7. In the event that the applicant who is residing within the mobile
home or the conventional residents, for any reason, moves to another
location or is deceased, then in that event, the Use Permit granted
herein shall automatically expire and the mobile home shall be
removed within one hundred and twenty (120) days. In the event the
mobile home is not 'removed within one hundred and twenty (120) days
pursuant to the. .terms of the Use Permit, the County shall remove the
mobile home and store it at the owners expense.
8. The applicant is to supply a certificate of deposit or annuity, or
post a bond to cover the cost of removal in the amount of $1,500.00
for a single -wide mobile or $2,000.00 for a double -wide mobile.
9. Meet the requirements of the Butte County Public Works Department
for the driveway and approach to the project site.
10. Meet the requirements of the Building Division of the Butte County
Department of Public Works.
11. Applicant must also comply with all other applicable State and local
statutes, ordinances, and regulations.
I hereby declare under penalty of perjury that I have read the

imposed upon the granting of this use permit, and that I agree to abide
fully by said conditions.
