Since permits and inspections are required for the above work, please submit three (3) complete sets of plans,. apply for the required permits, and pay the appropriate fees for the addition and the kennel. Because a Use Permit is required for a kennel (six or more dogs) in an A-5 zone, please contact the Planning Department immediately. The field authorization cannot be made until the existing work is inspected and approved. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means of enforcement if voluntary compliance is not obtained. Enforcement may be pursued through the issuance of citations, fines and the recording of a Notice of Violation including a description of the action necessary to abate the violation. You have thirty 30) days to voluntarily comply with the above directions or to present an acceptable plan for abatement or corrective actions to be taken by you'. During this inspection I observed a newly constructed septic system which was installed but not yet covered with dirt. Our office has no record of a sewage disposal permit being either issued or applied for, for this septic system. Butte County Code Section 19.5 (a) states in part, "no person shall begin... construction of...any sewage disposal system without first... obtaining a permit therefor from the health officer." Therefore the septic system I observed appears to be in violation of County Code. Further Butte County Code Section 19.6 states in part, "If... any sewage disposal system ... shall be begun prior to obtaining the required permit, the permit fee ... shall be doubled, but shall not relieve any person from fully complying with the requirements of this chapter nor any other penalties prescribed..." Therefore is you wish to keep the septic system we observed on the parcel you must within thirty (30) days apply with our office to obtain the required permit. The fee required with the application is $930. Should you wish to. no longer keep this septic system within thirty (30) days you must apply for a permit to either completely remove the system from the property or abandon the septic system in place. In either case the fee for this permit is $128. Your failure to comply with these requirements may result in our office issuing a citation to court.
