Rev'd 11/4/2004 Brute County Department of Development Services ADMINISTRATION * BUILDING * GIS * PLANNING 7 County Center Drive Oroville, CA 95965 (530) 538-7541 Telephone (530) 538.2140 Facsimile Dear Property Owner: An application for a building permit has been submitted in your name listing yourself as the builder of the property improvements specified. For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a permit. Building permits are not required to be signed by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if that person applies for the proper permit in his or her name. Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by law to put their license number on all permits for which they apply. If you plan to do your own work, with the exception of various trades that your plan to subcontract, you should be aware of the following information for your benefit and protection: o If you employ or otherwise engage any persons other than -your immediate family, and the work (including materials and other costs) is $200 or more for the entire project and such persons are not licensed as contractors or subcontractors, then you may be an employer. o If you are an employer, you must register with the state and federal government as an employer and you are subject to several obligations including state and federal income tax withholding, federal social security taxes, workers' compensation insurance, disability insurance costs, and unemployment compensation contributions. o There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious with respect to workers' compensation insurance. o For more specific information about your obligations under federal law, contact the Internal Revenue Service (and, if you wish, the U.S. Small Business Administration). For more specific information about your obligations under state law, contact the Department of Benefit Payments and the Division of Industrial Accidents. If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their work personally or through their own employees, without a licensed contractor or subcontractor, only under limited conditions. A frequent practice of unlicensed persons professing to be contractors is to secure an "owner -builder" building permit, erroneously implying that the property owner is providing his or her own labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work personally. Information about licensed contractors may be obtained by contacting the Contractors' State License Board in your community or at 1020 N Street, Sacramento, California 95814. Please complete and return the enclosed owner -builder verification from so that we can confirm that you are aware of these matters. The building permit will not be issued until the verification is returned. ly, C. Vieirq, C.B.O. Ida Road. Thank you very much for your patience. I am submitting these documents directly to you since you are likely the only member of the department familiar with the project. I am requesting the plan check be performed by Butte County personnel only. The structure is very small; simple, and pre-existing. Other than placing felt and composition shingles on the Toof, no,substantive work has been done since the summer of 2003. All 4 " the ftaming,an&sheathing is exposed for easy inspection. -The,original structure did not have a proper foundation. A new foundation was constructed by a licensed contractor in 2002. The footing, stem wall, and reinforced concrete slab were poured monolithically. Reinforcing steel was placed according to code. I excavated the footings by hand and can verify their adequacy. Attached are copies of the correction notice from Mr. Aznoe, my response letter with site plan, and your letter. Please note that full disclosure was made within the 10 days requested by the correction notice. Your letter claims I am in violation of the Butte County Code in failing "to obtain the required permits, inspections and approvals... for the construction of a single-family residence and pump house." As shown on the enclosed site plan, the residence at the rear ". of the property has existed for sixty some years. No work has been done to it since I purchased the property in the year 2000. As previously stated, the pump house has been enlarged to 120 sq.ft. which, I believe, does not require a permit. The existing 400 sq.ft. Cottage (or Guest House) is being repaired from the foundation up but has not been enlarged. I am willing to obtain permits and pay any fees I am truly required to under the law. However, your letter does not cite any code references violated. Due to the absence of appropriate documentation, I am respectfully requesting a legal opinion rendered by Butte County Counsel, clearly explaining how, and which law empowers the Building Department to require permits and demand payment of fees from a homeowner performing his own repairs to structures which have existed for over half a century on a piece of property to which the owner has clear title. Thank you very much for your consideration. Res7rsefl, Jim. I purchased this property "as is" in poor condition in the spring of 2000. As time and money allows I have been slowly making substantive repairs to.two of the four existing structures. This property was developed circa 1940-50. The long-time existence of these .structures can be verified by any historical aerial photo of the area, and by next door neighbors who have resided there for more than 30 years. The roof area of the cottage is now smaller due to the removal of an attached car port which was integral to the original structure. The well house has been enlarged from 6'x 8' to 10'x 12'; for which, as I understand it, a permit is not required. The enclosed site. plan was created in the spring of 2001. At that time, I inquired at three departments at Butte County: Building, Planning, & Environmental Health. All three departments denied having any information regarding this parcel or any improvements thereon. Please contact me at the above address for future correspondence. Thank you, Jim'Pursell, P.E. Rd., APN 036-130-048 Dear Sir: Thank you for your concern regarding repair work to structures at the above referenced address. Enclosed are copies of a complete site plan. I purchased this property, "as is" in poor condition in the spring of 2000. As time and money allows I have been slowly making substantive repairs to two of the four existing structT.es. This property was developed circa 1940-50. The long-time existence o these structures can be verified by any historical aerial photo of the area, aqd by next door neighbors who have resided there for more than 30 years. The roof area of the cottage is now smaller due to the removal of an attached car port which was integral to the original structure. The well house has been enlarged from 6'x 8' to 10'x 12'; for which, as I understand it, a permit is not required. The enclosed site plan was created in the spring of 2001. At that time, I inquired at three departments at Butte County: Building, Planning, & Environmental Health. All three departments denied having any information regarding this parcel or any improvements thereon. Please contact me at the above address for future correspondence. Thank ou, J im sell, P. Ida Rd., APN 036-130-048 Dear. Sir: Thank you for your concern.regarding repair work to structures at the above referenced address: Enclosed are copies of a complete site plan. I purchased this property "as is" in poor condition in the spring of 2000. As time and money allows I have been slowly making substantive repairs to two of the four existing structures. This property was developed circa 1940-50. The long-time existence of these structures can be verified by any historical aerial photo of the area, and by next door neighbors who have resided there for more than 30 years. The roof area of the cottage is now smaller due to the removal of an attached car port which was integral: to the original structure. Since permits and inspections are required for the above work, please submit three (3) complete sets of plans, apply for the required permits, and pay the appropriate fees. All work must stop until these permits are issued and, you are authorized by our field inspector to proceed. The field authorization cannot be made until the existing work is inspected and approved. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means. of enforcement if voluntary compliance is not obtained. Enforcement may be pursued through the issuance of citations, fines and the recording of a ivotice of Violation including a descripiion of the action necessary to abate the violation. You have thirty (30) days to voluntarily comply with the above directions or to present an acceptable plan for abatement or corrective actions to be taken by you. (530) 533-2131 FAx (530) 534-0902 The content of your letter dated 10-19-04 causes me to question whether you received the information I sent to your department on 10-14-04. Attached are copies of the correction notice from Mr. Aznoe, my response letter with site plan, and your letter. Please note that full disclosure was made within the 10 days requested by the correction notice. Your letter claims I am in violation of the Butte County Code in failing "to obtain the required permits, inspections and approvals... for the construction of a single-family residence and pump house. As shown on the enclosed site plan, the residence at the rear of the property has existed for sixty some years. Respectfully, Jim Pursell, P.E.
